SABER FA521521B0001

CONSOLIDATED QUESTIONS & ANSWERS

1. The SF1442, Box 13b notes that an offer guarantee is required. Section H, No. 6 says that a Bid Guarantee is required. Please provide the amount of the bid bond and whether the bid bond should be included in Volume I-Price or Volume II-Contract Forms/Responsibility Bid guarantee is not required at the IDIQ LEVEL, SF 1442/Section H changed to reflect it. The price of the bonding capacity shall be included in your coefficient calculation.

2. Statement of Work, Page 13-14, Section 4.5.1 notes "The Quality Control Manager, Senior Project Manager, and Site Superintendent must be different people. Section 17.3.6.1, page 41 notes that the Superintendent and QC Manager may be the same individual. Please advise whether the QCM and Superintendent can be dual hatted or if they have to be separate people. Or can they be dual hatted just on smaller projects. If dual hat is allowed for smaller projects what is the contract value threshold for the dual hat?

Please see SOW section 4.5.1: The QCM and Superintendent can be dual hatted. The CO will notify the Contractor if a project will require the QCM and Superintendent to be separate roles. Contractor can assume this will happen on projects approaching the $1M+ level.

3. SF1442 Block 13.b is marked YES, an Offer Guarantee is required, however Section M.3.1 and L.2.1.3.c only reference a bonding capacity letter as a required submittal. Please advise if a bid bond is required for this solicitation.

Please see response to question 1.

4. Please confirm that the coefficient as described in L.2.1.2. can be adjusted each fiscal year to accommodate inflation/cost.

Please see SOW 2.7.3.1 of SOW The Coefficient is fixed for the length of the ordering period. An adjustment has been made to include one 5-yr base period and one 2-yr option period. Yearly Inflation and price/wage increases is captured in RSMeans and City Cost Index data.

5. Please confirm that in accordance with paragraph 2.7.3.3, that management oversight of subcontractors is covered under the coefficient.

Yes, it shall be included as part of the coefficient.

6. Will design, ENV, Archaeological fall under the NPI-MEC category?

No A&E support is required for TOs under this contract. Design beyond 35% will not be covered under this contract. Archaeological and MEC work will classify as a NPI.

7. Please confirm that GRT is covered under the coefficient.

Assuming “GRT” means general excise tax (GET), yes it should be part of the proposed coefficient.

8. The conceptual design states 35% but there is no reference to how often the need is anticipated. Please clarify.

A conceptual design is the mutual understanding of the requirement between Government and Contractor, a proposed solution (either in narrative form and/or supported by shop drawings, depending on the project) and an identification of the level of effort needed to meet the requirement. A conceptual design is not a formal design effort and will never require stamped PE drawings. Section 3.2 states that “Minimal design (up to 35%) effort may be required and will be determined based on the requirements of each Task Order (i.e., building or system reconfiguration, life safety and/or environmental requirements). In such cases, the Contractor shall submit a conceptual design, not to exceed 35%, for each TO.”

9. Please confirm whether work clearance permits will be covered under the NPI or coefficient Work clearance permits will be covered under the coefficient.

10. As a result of the COVID-19 pandemic, there has been discussion on a hold imposed on the Bona Fide Office requirements in several regions. In light of the SBA’s April 2020 Federal Contracting Guidance for Small Businesses Impacted by Coronavirus, we request that the Government suspend this requirement due to the ongoing pandemic and limitations which it has caused, not only on qualified small businesses, but also on the SBA.

SBA confirmed the geographical area and bona fide place of business requirement stated in the solicitation is applicable. Please reach out to your assigned SBA for additional assistance.

11. Currently, the Bona Fide place of business rules appear only in the procedures applying to competitive 8(a) procurements in FAR 124.507(c)(2). As such the Government has not historically enforced the requirement with regularity. Therefore, we request clarification on the application of the Bona Fide Office requirement, and suggest suspension until uniformly applied.

See response to question 10

12. As of November 16 2020, the requirements of the Bona Fide Office as amended by the SBA through Executive Order 13771/ Docket SBA-2018-0006, have not been incorporated into the FAR and therefore, we request that requirements be paused until further guidance.
