Evaluation Factors for Award

The following clauses were modified:

52.212-2Evaluation-Commercial Products and Commercial Services.Oct 2021 hereby reads as follows:

52.212-2 Evaluation--Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers in a comparative evaluation:

(1) Price

(2) Contractor Responsibility

(3) Past Performance

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, will result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2, Evaluation - Commercial Products and Commercial Services

The following is inserted as new paragraphs (d) and (e) of the provision:

(d) This is a competitive award conducted in accordance with (IAW) Federal Acquisition Regulation (FAR) Basis for Contract Award: best value Parts 12 and 13. By submission of its offer IAW the instructions provided in provision FAR 52.212-1, Instructions to Offerors - Commercial Products and Commercial Services, the offeror accedes to all solicitation requirements, including terms and conditions and representations and certification. Failure to meet a requirement may result in an offer being determined unacceptable. Award will be made to the offer that is the best value to the Government, price and other factors, i.e., contractor responsibility and past performance, considered. The Government reserves the right to award a contract to other than the lowest Total Evaluated Price (TEP). The evaluation process will include the following:

(1) Price analysis will be conducted to determine the offeror's Total Evaluated Price (TEP) fair and reasonable. The Government reserves the :Price right to perform price realism analysis. If the Government elects to perform a price realism analysis, the Government reserves discretion over the method within which it performs its price realism analysis. If the Government elects to perform a price realism analysis and finds an offer unrealistic, the Government may withhold award to that offeror. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

A TEP will be computed for each offer in order to meet the requirements of FAR Parts 6 and 17. The Total Evaluated Price (TEP).

price of a six-month extension authorized by FAR 52.217-8, Option to Extend Services, will be added to the offered price for each potential contract performance period.

The TEP is a two-part computation. First, the offeror's total quoted price will be determined by multiplying the quantities identified in the Pricing Schedule (SF 1449, continuation of blocks 19 - 24) by the unit price, limited to two decimal places, for each Contract Line Item Number (CLIN) to confirm the extended total amount for each CLIN; the sum of all extended amounts will be the offeror's total quoted price. Second, the total quoted price (total amount for CLIN X001) plus the sum of FAR 52.217-8 formula (shown below) will constitute the TEP.

The formula for the Option to Extend Services amount is as follows:

Base Year = CLIN 0001 Extended Amount x 0.5* Option Year 1 = CLIN 1001 Extended Amount x 0.5* Option Year 2 = CLIN 2001 Extended Amount x 0.5* Option Year 3 = CLIN 3001 Extended Amount x 0.5* Option Year 4 = CLIN 4001 Extended Amount x 0.5*

Note: *0.5 is the multiplicative factor used to derive the 6 months quantity value.

Evaluating the Option CLINs does not obligate the Government to exercise the Option(s).

(2) The Government will evaluate the Contractor Responsibility by Subfactor 1 (Education) and Subfactor 2 (License:Contractor Responsibility /Certification) submitted by the offeror. The Government will evaluate the Contractor Responsibility on a pass/fail basis and assign an Acceptable or Unacceptable rating as described in the table below. The offer that fails to present the information of Subfactors 1 and 2 to the Contracting Officer may not be considered "responsible" IAW 9.104-1 rendering them ineligible for award.

CONTRACTOR RESPONSIBILITY RATINGS

Quotation meets the requirements of the solicitation. Acceptable:

Quotation does not meet the requirements of the solicitation. Unacceptable:

(i) : The factor is met when the offeror presents a proof of four-year college degree in any field to the Contracting Subfactor 1 - Education Officer IAW addenda to FAR 52.212-1, paragraph 2(m)(2)(iii)(A).

(ii) : The factor is met when the offeror presents a proof of diploma or specialized training and Subfactor 2 - License/Certification certification in one or two cultural or related program areas IAW addenda to FAR 52.212-1, paragraph 2(m)(2)(iii)(B).

(3) The Government will evaluate the offeror's past performance and rate the offeror's past performance with either "Past" or :Past Performance "Fail". To receive a "Pass" rating, the offeror must have demonstrated successful performance within the past four (4) years and no record of termination for cause or termination for default. If the offeror has record of unsatisfactory performance to include a record of termination for cause or termination for default within the past four (4) years, the offeror's past performance will be rated as "Fail". The Government reserves the right to perform additional analysis of the CPARS records or consult other Government agencies to adequately assess the offeror's past performance within the past four (4) years. In case of unknown record, the Government will consider the offeror's past performance is unknown and the other offeror's /offerors' successful past performance result(s) will prevail.

(e) Offerors are cautioned to submit sufficient information and in the format specified in FAR 52.212-1 of this solicitation. The Government intends to award a contract without further interchanges with offerors. Consequently, offerors are highly encouraged to offer their best quote in their initial submissions. However, the Government reserves the right to have interchanges with any or all offerors, if it is determined advantageous for the Government to do so. This statement is not to be construed to mean that the Government is obligated to have interchanges with every offeror (note that FAR Part 15 procedures do not apply to FAR Part 13 procedures; therefore, formal discussions are not applicable). An offeror may be eliminated from consideration without further interchanges if its quote is not among those considered most advantageous to the Government based on a best value determination.
