ATD ATA Questions

CompanyQuestion NumberReference
(CLIN, SOW, P-Spec, etc.)Question / CommentAnswer
CTI001Sections+LM+ATA+ATD+(2+Jun).pdf, Appendix 1 to Section L, Subfactor A, Aspect 2, Item 2The reference for this includes PWS App 1, Para A1.1 - A1.1.5, however, the PWS only shows A1.1, and Tables A1.1 and A1.2. Should there be sections A1.1.1 through A1.1.5?Updated Section M, 3.0 Evaluation Factors, 3.1 Factor I- Technical, Aspect 2, Item 2 as well as Technical Cross Reference Matrix to reflect correct paragraphs listed in PWS Appendix 1. It is only paragraphs A1.1 and A1.2. in Appendix 1, no additional paragraphs.
CTI002Sections+LM+ATA+ATD+(2+Jun).pdf, Appendix 1 to Section L, 6.1B, 7.1Section L, 6.1B states “IAW FAR 52.219-8, 52.219-9, 19.705-2(d) and 19.708 (b)(ii), a Subcontracting Plan shall be submitted with the offeror’s proposal IAW Technical Subfactor C below. The RFP requirement for subcontracting is 20% of the total dollars of the effort.”

Section L, 7.1 states “The evaluation of the offeror’s/joint venture present/past performance WILL NOT include the present/past performance of any subcontractor(s) even though they may perform major or critical aspects of this requirement.”

Major portions of this effort are mandated to be sub-contracted to meet SB requirements. This Full and Open competition does not restrict the amount of work sub-contracted as a Small Business Set Aside does. Other teams also plan to sub-contract major portions of the past performance to ensure we provide the most capable team to the government. To increase competition and to provide best value to the goverment, will the government change the requirement in 7.1 to allow the use of subcontractors past performance?

Allowing teams to showcase their teams past performance will increase competition for the government all-the-while it would allow offers to layout their full plan for performing the work in all volumes of their submission. It is reasonable to allow offerors to showcase their team's proven capabilities on very similar/like contracts. See updated Sections L&M. Section L, 7.1 now says "7.1 The offeror shall submit Present and Past Performance Information for itself and any joint venture member in accordance with the format contained in the “FACTS Sheet” (See Appendix II to Section L) and the following paragraphs. A total of four (4) FACTS sheets will be submitted for each offeror. Do not submit more than four FACTS sheets with Volume II. The evaluation of the offeror’s/joint venture present/past performance MAY include the present/past performance of any subcontractor(s) that may perform major or critical aspects of this requirement. The offeror’s/joint venture’s are allowed to submit four (4) total FACT sheets, with up to two (2) from any subcontractor that will be used to perform this requirement."

Updated FACT sheet verbiage to reflect updates.

Section M, Section titled "Subcontractors" now says "Subcontractors. The evaluation of the offeror’s/joint venture’s present/past performance WILL include the present/past performance of any subcontractor(s) as they may perform major or critical aspects of this requirement. No more than two (2) of the total four (4) provided FACT sheets may be for subcontractors. Any additional FACT sheets from subcontractors beyond two will not be evaluated. "

CTI003Section M, 2.0 Source Selection Methodology: Section L, 5.5 and 9.1Section 2.0 Source Selection Methodology: "Any inconsistency, whether real or apparent, between technical and price must be clearly explained in the price proposal." L, 5.5 Copies and Page Limits: The Price volume is for price only - technical information shall not be included in this volume."
Technical information shall not be included in the price volume however any inconsistencies in price must be validated in the Price Volume. There is not a section within the Price Volume to provide the narrative, if needed. Where should we provide the narrative within the Price Volume? We are only given a Table in Section L, 9.1 as a possible location to put it.Added to Section L, Paragraph 9.1 is the following statement: "Supporting data may be submitted in a format (such as a Word or Excel document) selected by the offeror, but must address the information requested in this paragraph. Include in the supporting price backup data section, any narrative needed to explain any inconsistency, whether real or apparent, between technical and price as well as any other information to support price development the offeror believes to be necessary."
Vali004Solicitation / 37 of 57; Paragraph 252.204-7012Background: This DFARS clause regards Safeguarding Covered Defense Information and Cyber Incident Reporting.
Question: Will the government confirm that the 2019 version of this clause is not intended to be the cited version?Yes, this is the correct version.
Vali005Sections LM ATA ATD (2_Jun)/ 1 of 20; SPECIAL NOTICES TO OFFERORSBackground: The paragraph indicates that “A virtual pre-proposal conference will be held on 8 Jun 22 via Zoom from 1100-1300 EST.”. A SAM.gov Notice posted on 5/13/2022 indicated that a pre-proposal conference would be held on Jun 8, 2022.
Question: Since this virtual pre-proposal conference was not conducted as scheduled prior to the release of the solicitation, will the government consider extending the proposal response due date until 30 days following the completion of this “pre-proposal conference” and government issuance of Answers related to questions submitted at the conference? No. Pre-Proposal conferences may be held after the solicitation has been released.
Vali006Sections LM ATA ATD / 7 of 20; Paragraph 7.1
Background: The paragraph states that “The evaluation of the offeror’s/joint venture present/past performance WILL NOT include the present/past performance of any subcontractor(s) even though they may perform major or critical aspects of this requirement.”

FAR 9.603 states that “The Government will recognize the integrity and validity of contractor team arrangements; provided, the arrangements are identified and company relationships are fully disclosed in an offer or, for arrangements entered into after submission of an offer, before the arrangement becomes effective.”

FAR 15.305 (a)(2)(iii) states that “The evaluation should take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition.”

Additionally, 13 C.F.R. 125.2 (g) states “Capabilities, past performance, and experience. When an offer of a small business prime contractor includes a proposed team of small business subcontractors and specifically identifies the first-tier subcontractor(s) in the proposal, the head of the agency must consider the capabilities, past performance, and experience of each first tier subcontractor that is part of the team as the capabilities, past performance, and experience of the small business prime contractor if the capabilities, past performance, and experience of the small business prime does not independently demonstrate capabilities and past performance necessary for award. This regulation is limited and applies only when four factors are met: (1) the prospective prime contractor is a small business; (2) the prospective prime does not independently demonstrate the past performance “necessary for award; (3) the subcontractor is a first-tier subcontractor; and (4) the subcontractor is itself a small business.

Question: Will ACC AMIC/PKB comply with the SBA regulation requiring procuring agencies to consider subcontractors’ past performance when all four of the factors apply?

Vali007Sections LM ATA ATD / 5 of 20; Paragraph 6.1.BBackground: The paragraph indicates IAW FAR 52.219-8, 52.219-9, 19.705-2(d) and 19.708 (b)(ii), a Subcontracting Plan shall be submitted with the offeror’s proposal IAW Technical Subfactor C below. The RFP requirement for subcontracting is 20% of the total dollars of the effort. This is also addressed under Subfactor C:.
Question: Is this a requirement for Small Business as well as Large?FAR 52.219-9, Small Business Subcontracting Plan (Nov 2021) does not apply to small business concerns; so, no, SBs do not need to comply with this part of the RFP.
Vali008LM ATA ATD / 6 of 20; Paragraph G, Subfactor A: Aspect 2 Item 2)Background: The paragraph indicates “Outline a detailed manning workload analysis/methodology that depicts the proposed labor categories, skill level, and number of personnel for both full and part time positions”
Question: Will the government clarify as the required manning is provided in the PWS?Please refer to PWS Appendix 1, Workload, for the required and optional FTEs for this requirement.
SDI009ATD/ATA PWS Version 0 31 May 2022, Appendix 3, DELIVERABLES. Para A3.1Para A3.1 specifies that the contractor will coordinate the format and content of each deliverable with the government’s COR (A3.1). Paras A3.2 and A3.2.1 specify that the Quality Control Plan and Phase-In/Phase-Out Plan will be delivered with the proposal.
Will the government specify the format and content of these Plans or allow the offeror to determine essential Plan details and presentation format within the proposal discussion? If the government provides the format and content, will the government consider allowing the offeror to include the deliverables as attachments to the technical proposal? Please refer to PWS Para 4.7.1 for the Quality Control Plan and PWS para 4.10 for the Transition Plan. Coordinating the format and content of each deliverable with the government's COR refers to deliverables during contract. The QCP and Transition Plan pages count against the Technical Volume.
SDI010Section LM ATA ATD (2 June) Price Backup DataPara. 9.1 states supporting price backup data shall be provided in table format. The paragraph later states supporting data may be provided in a format selected by the offeror. Typically a cost narrative is provided to explain indirect rates, fringe development, productive hours used, etc.
Will the Government please clarify if it's acceptable to provide narrative content within the price volume to support all aspects of our price development? This would of course be in addition to a cost workbook to show dollar amounts by CLIN of labor. If not acceptable, please clarify the Governments intent for "table format".Added to Section L, Paragraph 9.1 is the following statement: "Supporting data may be submitted in a format (such as a Word or Excel document) selected by the offeror, but must address the information requested in this paragraph. Include in the supporting price backup data section, any narrative needed to explain any inconsistency, whether real or apparent, between technical and price as well as any other information to support price development the offeror believes to be necessary."
SDI011Section LM ATA ATD (2 June) L.6.1B & G Subfactor C - Subcontracting PlanConfusion exists when interpreting Para. 6.1.B and the subsequent Para. G. Subfactor C. Aspect 1. Paragraph 6.1.B references the subcontracting plan as an element within the Technical Contents of Volume I Technical. Paragrah G clearly shows Subfactor C. Aspect 1 is the Small Business Participation Plan - which is clearly not included in the 25 page limit for Volume 1.
Will the Government please clarify Section 6.1.B "Technical Contents" and what is necessary to maintain compliance since the Subcontracting plan will be contained within Subfactor C of the Technial Volume?Subcontracting Plan will be included as an attachment within the Technical Volume and will not count against the page count.
SDI012Section LM ATA ATD (2 June) L.5.7.1 Executive Summary and ExceptionsThis section refers to exceptions to the RFP and states if no exceptions are taken, a statement to this effect is required at the front of each proposal volume in the Executive Summary. Only L.6.1.E refers to an Executive summary which is only contained within Volume I. No other volumes contain instructions for an Executive Summary.
Does the Government require an Executive Summary within Volume II & III of the proposal? If not, where does the Government desire Exceptions, or a statement that no exceptions are taken, within Volumes II & III?Updated section L, Paragraph 5.7.1 to say "5.7.1 If the offeror takes no exception to any of the stated requirements in the solicitation, a statement to this effect is required at the front of Volume I – Technical in the Executive Summary."
SDI013Section LM ATA ATD (2 June) M.3.1. Subfactor A. Aspect 2. Item 2 - PWS Appendix ReferenceItem 2 references Appendix 1, Para. A1.1 though A1.1.5. Page 36 of the PWS contains Appendix 1, but only includes Table A1.1 and A1.2. We note the previous draft had each option labor category in separate tables.
Will the Government please confirm tables A1.3 through A1.1.5 are not missing?Updated Section M, 3.0 Evaluation Factors, 3.1 Factor I- Technical, Aspect 2, Item 2 as well as Technical Cross Reference Matrix to reflect correct paragraphs listed in PWS Appendix 1. It is only paragraphs A1.1 and A1.2. in Appendix 1, no additional paragraphs.
SDI014Section LM ATA ATD (2 June) FACTS SheetsNumbering withing the FACTS Sheet is inconsistent going from Para. G to J then back to G followed by H.
Does the Government desire FACTS sheets be lettered sequentially or maintain the Governments provided format?Updated FACTS sheet numbering.
SDI015Section LM ATA ATD (2 June) L.4.3 - AgentsThe second bullet of Para. 4.3 references that proposals signed by "Agents" shall be accompanied by evidence of that agents authority. Will the Government please clarify what an "Agent" is considered? Shall we assume an agent is a third party designee of the offeror? Please clarify. An agent is someone who is legally allowed to bind the company when signing a contract.
SDI016DD 254Dates and Contract numbers within the Draft DD 254 appear incorrect. Does the Government wish to update these prior to proposal submission? No. The DD254 is a draft and the date and contract number will be updated in the finalized copy.
SDI017General Formatting QuestionWill the Government allow reduced font size in headers and footers? No. Please follow all prescribed font sizes listed in Section L.
First Light JV018Sec L & M; para 5.3 and 6.1Comprehensive QCP and Transition Plan can be large. First Light JV019PWS; para 4.7.1 and 4.10Comprehensive QCP and Transition Plan can be large. Since the RFP notes these plans will be submitted as part of the RFP Technical volume, request the USG confirm if these documents can be presetned as attachments to the Technical volume and not count against proposal page count.No. The QCP and Transition Plan pages count against the Technical Volume.
First Light JV020PWS; Appendix 1Table A1.1 appears to present a directed manning solution for the solicitation's requirements. Request the USG confirm this indication and if no, provide additional information regarding annual workload requirements by training device suported to allow offerors the ability to fully assess the manpower requirements. This is a Firm-Fixed Price Level of Effort requirement. This means that the Government is asking the offeror to provide a proposal which provides a price for the FTEs the Government has prescribed in PWS, Appendix 1, Workload. Please provide an offor based off the FTEs given in Appendix 1.
First Light JV021PWS; para. 4.3A Strike Mitigation Plan is required but the USG only provided a DOL WD for the labor category and wage determinations. Have the incumbent personnel become an organized labor force covered by a CBA. If yes, please provide the recognized CBA for the work force. If no, does the USG have information that the work force has requested a recognition certification via an DOL monitored vote. If this is yes, when is that vote projected to occur?See PWS para A3.2.2.1. Strike Mitigation Plan (if required). There is no CBA currently so a SMP is not required with this proposal.
First Light JV022General; SolicitationThe USG presents an expectation to accomplish this labor via an FFP-LOE contruct. Please confirm if the following DOL-related work statuses will be authorized as billable hours on the program; Federal holidays, sick time, vacation timePWS lists federal holidays observed on this contract... all labor hours should be included in your proposal on the FFP LOE CLIN and should be in accordance with your payroll system.
First Light JV023PWS; Appendix 1The USG presents a labor position as Computer Specialist in the referenced section but this labor category does not exist in the DOL WD provided. Request the USG provide a job description or listing of key position skill requirements to allow all offerors the ability to align their proposals to the approriate DOL WD labor category. Please refer to FAR 52.222-42 STATEMENT OF EQUIVALENT RATES FOR FEDERAL HIRES (MAY 2014) in the solictation for the respective computer specialist DOL WD position. Section 4.2 also refers to the job descriptions.
First Light JV024DOL Wage Det.; VacationThe DOL WD provides vacation requirements based on length of service on the program. Request the USG provide service dates of incumbent personnel (names redacted) so offerors can properly determine the productive man year data for each labor categoryThe government does not currently possess this information. Ref FAR 52.222-41(n), the government will provide this data to the successor contractor, but has no authority to compel the incumbent to release such data outside of the reference. No request for equitable adjustment will be entertained after award based on this data, therefore offerors are cautioned and advised to us their best judgment in composing their proposal.
First Light JV025Pricing; TemplateWill the USG be providing a solicitation standard pricing template for all offerors to ustilize during proposal subbmission? Please refer to Section L, Paragraphs 8.1 , 8.2., and 9.1 for what to provide in regards to pricing.

DRG028Section L, 5.3Please clarify what the govt considers normal proportional spacing. Is that single spacing with double space between paragraphs? The Government does not have a preferred spacing between lines other than it shall not be less than single spaced. This guidance hopes to prevent proposals from being edited in such as way that spaces between words and lines are smaller than the standard spacing in an attempt to include more words on a page.
DRG029Section L, 5.3Para. 5.3, under What Counts as a Page, it states "Page numbering shall be in sequential order (i.e., 1 thorugh 25). Do not number each section of the proposal volume separately." Please clarify if TOC, glossary are to be numbered the same as the rest of the volume.TOC and glossary to not count towards page count. If offeror chooses to include them in the numbering of the entire volume instead of not numbering those pages, the volume shall start with 1 on the first page of numbering and end with the final number. This guidance hopes to prevent proposals from number a section starting with the number 1 and then numbering the next section also starting with the number 1.
DRG030Section L, Appendix 2Please confirm that "BRIEF DESCRIPTION OF EFFORT" should be labeled H instead of J, that "RELEVANCY TABLE" should be labled I instead of G and that "SUBCONTRACTING PLAN COMPLIANCE" should be labeled J instead of H.Updated FACTS sheet numbering.
