PERFORMANCE WORK
STATEMENT
North Warning System — Fixed-Wing
Heavy Airlift/ Medium Fixed-Wing Airlift Service
Description of Services.
1.1 The Contractor shall provide all personnel, services, equipment, tools, oil, facilities, supervision and direct materials necessary for the performance of the air transportation services hereunder, including sufficient number of ground personnel for adequate maintenance and ground operation, except as otherwise noted in this contract. The Contractor’s price includes all costs of performance (including spares, aircraft basing, lodging, crew rotation costs, and aircraft heaters) and costs for fuel handlers, except for items covered under reimbursable expenses.
1.2. Prior to contract start the Contractor shall furnish the Contracting Officer/Contracting Officer’s Representative (CO/COR) with the name, address, and telephone number of an agent who will serve as a liaison between the Contractor and the CO/COR. The agent must have authority to schedule contract services. The agent shall be available by telephone at all times.
1.3. Contractor uncontrollable delays/diversions. In the event a flight is delayed/diverted because of weather or other uncontrollable factors, a minimum waiting period of four (4) hours is required before a flight can be canceled. The final decision for flight cancellation due to weather rests with the aircraft commander. Canceled flights shall be rescheduled and operated within 24 hours or as mutually agreed between the Contractor and the O&M Contractor Within an information copy to AMIC/Det 1. If the crew must remain overnight (RON) through no fault of the Contractor, it will be reimbursed per diem rates consistent with Treasury Board of Canada, www.tbs-sct.gc.ca. Food and lodging arrangements are the Contractor’s responsibility at the Base of Operations. The Government will reimburse the Contractor in accordance with the appropriate CLIN.
1.4. Flight delays/diversions caused by such events as maintenance and crew problems are considered Contractor controllable delays and shall be at the Contractor’s expense.
1.4.1. The contractor shall maintain a 95% reliability rate computed monthly by subtracting the total number of contractor-controllable delayed departures at the originating and en route stations from the contractor’s total number of scheduled departures and stating this as a percentage of total departures. Provide matrix IAW Attachment XX.
1.4.2. A delay shall be deemed to have occurred at the originating or en route station if the contractor’s aircraft departs the blocks more than 20 minutes after the scheduled departure time, except in those instances when the aircraft arrives at the next scheduled destination on time. Delays at originating and en route stations caused by factors beyond the control and without fault or negligence of the contractor shall be considered as contractor uncontrollable; a delay for any other reason shall be considered contractor-controllable and must be recorded using the Aircraft Unavailability Record. The contractor uncontrollable delay time experienced at the origination and en route stations on a mission shall be added to the scheduled departure time at the next en route station for purposes of determining the scheduled departure time at that station on that mission.
1.4.3. Failure to maintain a 95% schedule reliability rate will be reason for terminating the contract pursuant to FAR 52.212-4; however, nothing in this paragraph shall limit the right of the Government to terminate this contract for cause for other reasons or to limit any other rights and remedies provided the Government by law or under this contract.
1.4.4 The contractor may refuse any mission for safety reasons. However, missions must be rescheduled and flown as agreed to by NWS O&M Contractor.
1.5. The Contractor will obtain a flight number from the Operations & Maintenance (O&M) Contractor prior to leaving the base of operations. This flight number will remain unchanged until the aircraft returns to where the mission originated. Note that each trip must be assigned a new flight number (the next number in sequence).
1.6. The aircraft offered for the performance of this contract shall be Instrument Flight Rules/ Visual Flight Rules (IFR/VFR) equipped. The type of aircraft will depend on weather, urgency of requirements, estimated time to perform the work and absolute limitations of civil twilight.
1.7. The Contractor shall be required to carry a survival kit, and two fire extinguishers on the aircraft.
1.8. The Contractor shall be responsible for the removal, from all North Warning System (NWS) sites, of all hazardous, unused and waste materials owned or generated in the operations of the Contractor owned aircraft.
Examples of such materials include, but are not limited to, unserviceable aircraft component and parts, used engine fluids, and any used or unusable petroleum, oil, and lubricants (POL) products.
1.9 The Contractor shall provide a daily flight log within 24 hours upon completion of each mission to the NWS O&M Contractor through the Logistic Support Site (LSS) Manager, if possible, or a commercial facility. Flight Log will include the flight manifest, any required per diem, lodging and landing fees. In addition, the contractor shall perform a visual fuel sampling, a clear and bright test, each time NWS fuel is taken and the flight log will be annotated to reflect fuel sampling has been accomplished. If commercial fuel is acquired, then the contractor shall annotate the cost and location of where the fuel was purchased. (CDRL)
1.10. PROHIBITED ACTIVITIES
1.10.1. All air carrier employees are prohibited from possessing alcoholic beverages on any North Warning System site.
1.10.2. Weapons are normally prohibited on North Warning Sites. The Contractor must ensure that weapons are secured at all times in a designated area as determined by the O&M Contractor.
1.10.3. Smoking is allowed in designated areas only.
1.11 LIABILITY FOR PERSONAL CARGO. The contractor shall be responsible for the loss and/or damage to the passenger baggage and personal equipment while such items are in his custody or on board his aircraft. Liability for these items is limited to the actual value thereof, not to exceed $2,800.00 US per passenger. In the event it should become necessary to off load passengers at any location or station, other than at the direction of the Contracting Officer, the Contractor shall be responsible for such off loading, passenger care, and safeguarding personal baggage from loss, theft, and/or weather damage, reloading, and all costs incident to such services until such time as the Contractor moves or causes to be moved such passengers to their intended destination or to such other location as directed by the Contracting Officer. The Contracting Officer shall be notified immediately of any off loading.
1.12. RESPONSIBILITY FOR GOVERNMENT CARGO. To the extent insurance required by this contract is not required for payment of third party claims, the balance of said insurance shall apply to Government cargo loss, damage or destruction thereto. In the event of an accident, the Contractor shall be responsible for providing continuous protection of all cargo aboard the aircraft and for delivery of the cargo to the point designated by the COR or HQ ACC AMIC Detachment 1.
1.13. ORDERS.
The CO will issue all task orders. After task orders are issued, the Operations and Maintenance Contractor will provide the Contractor with a tentative flight schedule for the following month. At least 24 hours prior to the scheduled departure time, the O&M Contractor and the Contractor shall mutually agree to the actual flight departure time. The Contractor shall not initiate any action to perform any work under this contract, which would exceed the amount on the delivery order. The government shall provide at least 72 hours notice to the contractor of any missions ordered that are not listed on the monthly schedule. The contractor shall have the aircraft positioned and ready to take on passengers or cargo in accordance with this PWS and shall meet all scheduled take-off times.
The CO/COTR/designated representative reserves the right to supersede or deny any flight requests made by the NWS O&M contractor to the Contractor if the CO/COTR/designated representative determines that the request is not in compliance with NWS Concept of Operations that have been agreed to by the USAF and CF. It reserves the right to schedule a flight if deemed it serves the interests of the USAF/CF for the NWS; this request will supersede any requests made by the NWS O&M contractor.
1.14. RESERVED.
1.15.. MINISTRY OF TRANSPORTATION (Transport Canada) Following the completion of any Civil Aviation Agency inspection, copies of the inspection report shall be forwarded to the Contracting Officer, HQ ACC AMIC/PKB, 11817 Canon Blvd. Ste. 306, Newport News, VA USA 23602.

3. General Information
3.1. Contractor Representative. The airlift contractor shall furnish the name, address, and 24-hour phone number of a person who will serve as the airlift contractor’s representative to Government. This person shall have the authority to dispatch aircraft, adjust schedules, make decisions pertinent to airlift service in the name of the contractor, and must be available during all normal flight operations.
3.2. Notice of Accidents for DOD Missions. When a Contractor’s aircraft is involved in an accident or incident in support of a DOD mission as defined in 49 CFR, Part 830, the Contractor will transmit the following information by the most expeditious means available, to the Transportation Branch (757-225-2377) at HQ ACC AMIC/PLGT, 11817 Canon Blvd. Ste. 306, Newport News, VA USA 23606. On the next business day, notify the CO at HQ ACC AMIC/PKB (757-225-3913), the COR at HQ ACC AMIC/PLG (757-764-9490), the CCC (613-947-9663) and the HQ ACC AMIC Detachment 1 at 613-297-5015 or 613-296-2149
3.2.1. Carrier and trip number
3.2.2. Aircraft type and number

3.2.4. Last point of departure and point of intended landing of the aircraft.
3.2.5. Nature of the accident and the extent of known damage to the aircraft.

3.2.8. Condition of baggage or government-owned material, if any, on board.
3.3. Notice of Accidents for Non-DOD Missions. When a contractor's aircraft is involved in an accident or incident in support of a non-DOD mission, as defined in 49 CFR, Part 830, the contractor will transmit the information in paragraph 4.2.1 above, by the most expeditious means available on the next business day to HQ ACC AMIC/PLGT (757-225-2377), the CO at HQ ACC AMIC/PKB (757-225-3913), the COR at HQ ACC AMIC/PLG (757-764- 9490), the CCC (613-947-9663) and the HQ ACC AMIC Detachment 1 add 613-297-5015 or 613-296-2149
3.3.1. Aircraft Medical Incidents. Report all aircraft medical incidents in flight, or while DOD passengers are under control of the aircraft captain, to the first available HQ ACC AMIC Detachment 1 representative within 48 hours.
3.3.2. DOD Casualties. In cases where a death occurs on a contractor’s aircraft, the following information shall be furnished via telephone to the numbers listed below: Name, Social Security Number (SSN) and component of service identified as Army-USA, Air Force-USAF, Navy-USN, Marine Corps-USMC, Coast Guard-USCG. The following is a list of phone numbers for service casualty offices:

3.4. CANCELLATIONS: In the event a flight is canceled prior to the scheduled departure time due to contractor controllable reasons, movement of any aircraft into and out of scheduled service will be at the Contractor's expense. The Contractor shall notify the Contracting Officer Representative (COR) at (757) 225-2377 or Det 1 at 613-297-5015 or 613-296-2149 immediately of any delay of aircraft departure including the reason thereof. Should the Government cancel a scheduled flight after the contractor's aircraft has already departed (has left the ground) its home base enroute to position, or has already positioned for a scheduled flight when notice of cancellation is given, the Government shall reimburse the contractor for the entire scheduled positioning leg and depositioning leg, even if the aircraft does not arrive at the positioning destination, at the mileage rate set forth in the mileage CLIN in the schedule. The government will incur no liability for costs until the aircraft departs the base of operations to position at the scheduled location.
3.5. Crew Expenses. When flights conducted in the performance of this contract are diverted to points other than NWS stations through no fault of the contractor or at the specific request of the HQ ACC AMIC Detachment 1, crew expenses for food and lodging are authorized. All expenses will be reimbursed in accordance with FAR 31.205- 46(a)(2). Paid receipts shall be furnished for lodging expenses.
3.6. Landing fees. In the event the airlift contractor is directed by the Government to stop at a commercial airport, other than the named points in the Pricing Schedule, and is assessed a landing fee, the Government will reimburse the contractor for such landing fees and all en-route navigational service charges. Paid receipts shall be furnished for landing fees.
3.7. Loading and offloading costs. In the event the contractor is directed to load or offload at an airport not identified in the Schedule of Supplies and Services and the contractor is required to pay for such loading/offloading, the Government will reimburse the contractor the amount of such costs. Paid receipts shall be furnished with invoices for payment of such loading/offloading costs.
3.8. Positioning and De-positioning costs. The Government will reimburse the contractor positioning and depositioning costs based on actual GCSM flown.
3.9. Fuel reimbursement. The Government will reimburse the contractor for all fuel used to perform services required under this contract that is purchased commercially only if government fuel is not available; however, every attempt should be made to plan the mission accordingly utilizing government fuel to the greatest extent possible. If government fuel is available it will be provided at no cost. To determine the amount of fuel used in the performance of this contract, multiply the contractor’s fuel burn rate in the Pricing Schedule by the flying hours computed from block out to block in. The contractor shall provide dated receipts for fuel along with the monthly invoices. The price of fuel is for product only and excludes all taxes and accessories charges, such as GST and HST, which shall be borne by the contractor.
3.10. Insurance: The contractor shall procure and maintain a level of insurance coverage commensurate with the commercial standard and in accordance with the host nation’s statutory limits during the entire period of performance under this contract.
4. METHOD OF MEASURING DISTANCE
In the event a flight is diverted or put in a holding pattern due to adverse weather conditions or other direction by the Government, payment will be calculated by multiplying flight time minutes times the block speed of the aircraft (see Attachment XX, List of Aircraft) then divided by 60, then multiplied times the unit price in the schedule. Fligth time minutes shall be computed from block out to block in. Payment will then be made in accordance with the schedule.
4.1. The Contractor shall submit a flying/cost summary report within 15 days after completion of the overall mission, containing the following information:
4.1.2. Total hours/miles billed on current invoice and copy of flight logs/cargo lists for that period.
4.1.3. Total passengers, and total cargo carried.
4.1.4. Total of reimbursable expenses on current invoices and applicable receipts.
4.1.5. Contractor’s fuel burn rate.
Appendix 1 Fixed-Wing Heavy Airlift Service (C-130 Hercules)
1.0. Specifications for Fixed-Wing Heavy Airlift Service
1.1. Provide all aircraft, personnel, equipment, and supervision necessary to perform the transportation of bulk Petroleum, Oil, and Lubricants (POL), outsized cargo, and supplies to Canadian and U.S.
Government North Warning System (NWS) sites during the period of 1 July through 15 Sept each year.
1.1.1. Multi-engine aircraft shall be capable of carrying at least 45,000 lbs and landing on 5,000 ft unimproved runways. Aircraft shall also include seating capacity for four logistics/fuel handling passengers.
1.1.2. Aircraft must be capable of transporting a minimum of 3,700 Imperial or 4,750 U.S. gallons of bulk POL per trip from Hall Beach (Fox-M) to Dewar Lakes (Fox-3). Estimated stage length is 258 Great Circle Statute Miles (GCSM) one-way. Requirement is for 15-24 consecutive flights in support of the refueling effort of Fox-3. An additional requirement of cargo movement per paragraph 1.1.3.1 and shall be scheduled within the 3 month period of performance with the possibility of utilizing between 3 to 24 flights between all 6 points listed in Table X. Point of origin will be Yellowknife or any other locations listed in Table 1 that has been requested by the contractor with notification provided to the CO/COR or HQ ACC AMIC Detachment 1 for final approval.

1.1.3. The contractor shall notify the NWS O&M contractor and HQ ACC AMIC/PLGT or Detachment 1 within 30 days of the desired delivery date if the aircraft will not be available to meet the 3 month required Heavy Airlift delivery window.
1.1.4. Upon Government approval, the contractor shall be authorized to bring one additional crew (four people) toHall Beach for increased frequency of operations. If this additional crew is mobilized, the contractor shall be reimbursed for their travel expenses from Yelowknife to Hall Beach and back to Yellowknife upon completion of operations. The contractor may submit invoices for air fare or similar travel expenses and for lodging and meals.
The crew shall travel by ticketed, scheduled air service unless it is not available. Any use of charter aircraft must be approved by the Contracting Officer prior to start of travel. All invoices shall be supported by attached paid receipts, including airfare. If the additional crew is brought to Hall Beach to support the fuel transfer missions, fuel transportation missions will be operated 24 hours a day, around the clock, until completed.
1.1.4.1. In the event a loaded aircraft is delayed because of weather and/or airstrip unserviceability, the CO at HQ ACC AMIC/PKB (757-225-3913) or COR at HQ ACC AMIC/PLG (757-764-9490), or the Program Manager at HQ ACC AMIC Det 1 (613) 297-5015 or (613)296-2149 may request a waiting period of up to four (4) hours.
1.1.5. The Contractor shall be responsible for all cargo being shipped until received by authorized personnel at destination.
1.1.5.1. The Contractor shall provide for proper en-route care of the cargo necessitated by climatic conditions.
1.1.5.2. If cargo is offloaded at any location not designated by NWS O&M contractor, the contractor shall be responsible for the offloading and safeguarding of such cargo from loss, theft, weather damage, reloading, and for all costs incidental to those services until the cargo arrives at the intended destination or another location as directed by the CO or HQ ACC AMIC/PLGT or HQ ACC AMIC Detachment 1.
1.1.5.3. Offloaded cargo shall not remain at an unspecified point in excess of 24 hours unless weather prohibits operation of the aircraft. The NWS O&M contractor, HQ ACC AMIC/PLGT or HQ ACC/AMIC Detachment 1 will be notified immediately of any offloading.
1.1.6. Petroleum, Oil, and Lubricant (POL) Support. When POL support is furnished by the North Warning System (NWS) Operations and Maintenance (O&M) contractor, the NWS O&M contractor shall furnish personnel and equipment to assist the airlift contractor in refueling. However, the personnel shall be under the supervision of the airlift contractor. Any loss or damage caused by or resulting from such operations will be the responsibility of the airlift contractor. An airlift contractor representative shall effect static grounding and tend the hose nozzle to include opening and securing of aircraft tank caps during refueling.
2. GOVERNMENT FURNISHED PROPERTY AND SERVICES
2.1. Aircraft fuel and refueling capability is available and will be provided at no cost to the airlift Contractor at Hall Beach and Cambridge Bay.
2.1.1. Fire protection

2.1.8 . Minimum 50’ of two or three inch hose at each destination from the aircraft pump to the receiving facility.
2.1.9 . Maintained airstrip or ice-strip together with communications, markers, and lights at the NWS stations.
2.1.10 . Food and lodging for airlift contractor personnel directly engaged in the performance of this contract.
2.1.11 . Communications traffic in connection with this contract will be carried on the available NWS, Canadian, and U.S. Government communication systems.
3. Facilities
3.1 The airlift contractor personnel must be knowledgeable of NWS O&M contractor safety procedures and participate in NWS O&M contractor fire prevention and safety training programs.
3.2 . The NWS O&M contractor shall provide communications and weather information (WX) facilities for enrouteflights between rearward areas and NWS stations. The facilities will be operated in accordance with the standards imposed by the Transport Canada.
Appendix 2 Medium Fixed-Wing Airlift – 9,000 lbs, Zone 1-5 (ATR)
1.0 Specifications for Fixed Wing Airlift Zones 1-5, 9,000lb capacity
1.1 Cargo and Personnel Movement. The Contractor shall provide fixed wing aircraft equipped with removable and/or foldable passenger seating with seat belts, which must have the capacity of transporting any combination of passenger(s) and/or cargo totaling minimum of 9,000 pounds. This payload does not include aircraft crewmembers and Contractor equipment required for the performance of this contract. The aircraft shall be capable of transporting the total payload a range of 350GCSM nonstop. The aircraft shall be in compliance with established Canadian safety requirements and be equipped with tie-down devices to restrain the movement of cargo.
1.2. The airlift contractor must furnish an aircraft capable of completing the missions without requiring regularly scheduled maintenance. No scheduled major overhaul or repairs except en-route or turnaround service shall be performed at NWS stations.
1.3 The Contractor shall position the aircraft at the applicable LSS a minimum of two (2) hours prior to scheduled flight departure time. All flights shall originate at the applicable LSS. The Contractor shall be responsible for transporting personnel and cargo from origin to Long Range Radar (LRR) sites. (NOTE: The airstrips at the LRR sites are gravel inactive airstrips that are not maintained and are not under NOTAM Regulations. The type of aircraft ordered will be the smallest aircraft commensurate with mission requirements. Request for cross-zone flying shall be submitted to either the CO/COR or HQ ACC AMIC Detachment 1 for review and approval prior to flying the mission.
1.4. The airlift contractor shall supervise loading the aircraft and be responsible for proper weight and balance of all cargo loaded on the aircraft. Actual weight shall be used for each mission when transporting passengers and or cargo. Actual weight is defined as interrogated or scaled weight when transporting passengers. Scaled weight shall be used when loading and transporting cargo. An additive weight of 20 lbs. per person may be used for hand carried baggage

2. GOVERNMENT FURNISHED PROPERTY AND SERVICES
2.1. The Canadian Government, through the NWS O&M Contractor, shall provide:
2.2.1. 115V electricity and electrical hook-up, at some NWS sites.
2.2.2. Coordination of all hazardous material shipments with the Contractor.
2.2.3. Fuel from NWS locations shall be given the priority, if available, in scheduling refueling for aircraft vice commercial. Once the efficiency is determined and fuel is still purchased at a commercial location in direct support of this contract, the cost will be reimbursed.
2.2.4. Government personnel will provide the contractor a list of personnel and cargo authorized for flight prior to boarding. The contractor shall not permit any unauthorized personnel to board the aircraft.
2.2.5. Fuel.
2.2.5.1. The Contractor shall obtain written authorization from National Defense Headquarters, Attn: Director Aerospace and Engineering Project Management (DAEPM), Radar & Communications System (R&CS3), MGen George R. Pearkes Building, Ottawa, Ontario K1A 0K2 prior to establishing a fuel “cache” at any NWS sites. The request shall reference applicable contract number.
2.2.5.2. The aviation fuel used at NWS sites is JET A-1 (A-3) fuel with three additives consisting of a fuel system icing inhibitor (FSII), static dissipater and a corrosion inhibitor. This fuel has a pour point of -52C degrees and has been designated as JET A-1 (A-3).

2.2.14 . Communications traffic in connection with this contract will be carried on the available NWS, Canadian, and U.S. Government communication systems.
2.2.14. In the event of an overnight stay due to weather conditions or mechanical, food and lodging will provided at Cambridge Bay and Hall Beach and any applicable LRR for Contractor personnel involved in the performance of this contract. The Contractor is responsible for their toiletries and towels. (Washer and dryers are available.) When operating from Iqaluit, Inuvik, or Goose Bay, food and lodging will be at the Contractor’s expense on a NON-cost reimbursable basis. Food and lodging at all other locations will be at the Contractor’s expense on a cost reimbursable basis by the government when government accommodations are not available.
