c. If yes, without provided CAD drawings and fixture locations, how can we possibly provide this?
| This information is not required as part of the initial submittal, however the Contractor is required to provide end-state photometric light readings as proof of compliance with UFC/ASHRAE requirements. | ||
| 21 | Would the government consider lowering the 322 calendar day – government acceptance period for our proposals? Mentions of tariffs, or trade disputes can cause a spike in the cost of fixtures, and these type of scenarios are hard to account for over 300+ days (and required bidders to include contingency funds in our bids). An alternate solution would be for the government to have a 90 day acceptance period. At the end of the 90 days (if funds are not currently available to make an award), the government could allow the bidders to “confirm their pricing” and resubmit their bids if there have been any changes in the market. The prevents the government from paying additional “contingency” in case an award is made quickly, while also protecting the contractor – who can adjust their pricing (as needed) every 90 days. (Most sureties will only guarantee a bid bond for 90 days anyways.) | No |

Per UFC 3-530-01, para 2-8.3, replacement fixtures (luminaires) must be compatibile with NEMA SSL 7a dimmers and dimming systems. In the case that the existing controls are non-compatible with proposed fixtures, contractor may seek a contract modification to correct/replace controls or propose an alternate brand fixture that meets all other requirements. |
| 26 | RFI #134.2 (and #136.2) indicate that restroom/stairwell fixtures ARE included in the scope of the contract, but are NOT included in the numbers provided in the SOW. Can the government please clarify or provide an overall quantity for additional fixtures that have not been included in the SOW quantities? This will ensure pricing can be reviewed for competitiveness and that all bids can be viewed “apples to apples” as an even comparison. | Questions 134.2 and 136.2 of the original RFIs were specific to building 1550 and 3500, respectively. For bidding purposes, Contractors should be proposing based on the fixture counts provided in the SOW. Fixture counts/types be verified by the winning bidder. Contractor may seek additional payment for additional fixtures exceeding the total overall fixture count, and the government reserves the right to seek a credit for actual quantities less than those provided in the SOW. |
| 27 | To ensure that all bidders are quoting the same number of fixtures/conditions (and to provide a clearer price comparison between bidders), it would be extremely helpful if the government would provide the quantities we should use for the 4 pricing line items on the AF3052. Due to the number of buildings on this project, and the volume of fixtures involved, minor deviations between bidder assumptions on things such as the number of emergency fixtures required (which the government has told us to assume/estimate) – could result in large differences/deviations in cost. If the government were to clearly indicate the quantities on the AF3052 (and clarify the assumptions/estimates mentioned in the previous RFI’s), all bidders would be providing an “apples to apples” bid which the government could review for competitiveness. | See RFI #26 answer. |

Issue: If the govt is requiring offerors to include a list of equipment WITH cut/spec sheets for each equipment type, then the govt is providing its APPROVAL at time of award. Requiring the contractor to go through another round of the same submittals is redundant and counter-productive (the govt is apparently reserving the right to reject what it has already approved by virtue of making the contract award). a. Question: Would the govt please remove this clause from the Specifications; it is unreasonable for the contractor to risk having its list of materials face line-item rejections prior to and after installation, when the govt will have already approved the LOM at the time of award (beforehand)?
b. Question: Will the govt reimburse the contractor for equipment changes from the LOM established in the proposal and award?
c. Question: Will the govt restrict its rejections to only those equipment items that do not meet USC?

Issue 1: Respectfully, this reads like a govt escape clause. By this definition, “unapproved” can mean anything that the contractor installs before the govt has re-approved, or possibly having rejected what was already contractually approved, and then, even when the contractor has a signed contract that includes a list of approved materials/equipment, the govt can later reject those items after the contractor has installed them. This also seems to run counter to the purpose of “firm fixed” price.
A. Question: Would the govt please revise SOW 1.4.c to state that if the govt requires a change to the list of materials at any time after award, then the govt will negotiate the new requirements with the contractor and issue a modification to the contract accordingly?
B. Question: Will the govt approve all submittal items prior to installation?
