PERFORMANCE WORK STATEMENT
FOR
VERTICAL TRANSPORTATION EQUIPMENT MAINTENANCE, REPAIR, & INSPECTION SERVICES
Cannon Air Force Base, New Mexico

PERFORMANCE WORK STATEMENT
1. DESCRIPTION OF SERVICES. The Contractor shall provide all management, tools, supplies, equipment, parts and labor necessary to maintain, repair, and inspect the real property vertical transportation equipment (VTE) at Cannon Air Force Base (CAFB), New Mexico in accordance with all Federal, State, and local laws and regulations. The contractor shall ensure continuous and safe operation (full maintenance and repair with the exception of the exclusions listed in Paragraph 2 below). The VTE and their locations are listed in Appendix A.
NOTE: The term “VTE” in this PWS includes all equipment listed in Appendix A: VTE Equipment Listing, and may include wheelchair/stair lifts.
1.1. The Contractor shall take total service responsibility for the equipment identified in the contract. The contract fixed price includes all inspections, maintenance, repairs, replacements, and routine and emergency service calls. The Contractor assumes all responsibility and determines the amount of service visits and types of service required to keep the VTE operating safely and within the performance objectives of Paragraph 6.
1.1.1. The Contractor shall provide the name of a Contract Manager (CM) who shall be responsible for the performance of the services. The name of the CM shall be provided to the Contracting Officer (CO) in writing no later than (NLT) five (5) days after award date. The CM must be able to read, write, speak, and understand English.
1.2. Work conducted on VTE shall be in accordance the Contractor’s Safety Plan (Paragraph 10 & APPENDIX C), and with the publications and instructions listed in APPENDIX B.
2. EXCLUDED SERVICES. The following are not covered in the full maintenance service arrangement and are considered Over and Above (O&A) services (APPENDIX D & E):
2.1. Alterations (such as modernizations or changes beyond maintaining full and safe operation) (See Paragraph 3.2).
2.2. Acts by parties other than the Contractor of vandalism, abuse, negligence, damage resulting from rescue and recovery operations, acts of God (including damage resulting from power spikes and low quality power).
2.3. Additional items: cosmetic, construction, ancillary components of the VTE system including the finishing, repairing or replacement of the cab enclosure, ceiling frames, hoist way door panels, door frames, sills, car flooring, floor covering, main line power switches, main power breaker(s), hydraulic elevator jack outer housing, buried piping, smoke and fire sensors, fire service reports, main communication feeders to controller, security systems, batteries for emergency lighting and lowering that are not solely dedicated to the VTE, air conditioners, and heaters.
2.4. Routine cleaning and refinishing of the interior of cars and the exterior of the hoist way doors and frames is not included in the basic full maintenance service.
2.5. In the event that the Contractor encounters an item of work included in Paragraph 2.1 through 2.4, the Contractor shall report the situation to the Contracting Officer’s Representative (COR). The report shall include the work location, a detailed scope of the required work, justification for Contractor determination that the work was not included in the contract, and an itemized cost estimate (including time to repair, all required parts and a breakdown of labor hours). NOTE: Any part, component or assembly unavailable from the manufacturer due to obsolescence, remains the Contractor’s responsibility to obtain an engineered equivalent product from a commercial source, unless waived by the CO.
3. DEFINITIONS.
3.1. Maintenance, Repair and Replacement. Maintenance, repair and replacement are on existing VTE and included in the contract scope of services. Maintenance, repair and replacement are actions to restore equipment to a state in which it may safely perform its required operations as installed in accordance with the manufacturer’s recommendations. See ASME A17.1 for requirements. All repair work shall be in accordance with standard commercial practices using only new parts of equal quality specified by the VTE manufacturer in effecting repairs (substitution of a different component is only permitted where it is equivalent to that which was tested, as determined by the certifying agency).
3.2. Alteration. Although not included under the full maintenance and repair service arrangement, alteration/modernization may be covered on an O&A Contract Line Item or it may result in a modification to the contract. The typical alteration results in a betterment to the safe operation of the equipment. When an alteration is made, all affected safety requirements must be complied with. All work as part of an alteration is required to comply with specific requirements of the current ASME A17.1.
3.2.1. Manufacturers reserve the right to improve the design of components and parts at their discretion. Regarding replacement components and parts required for the full and safe operation of VTE, improved design does not constitute alteration/modernization.
4. MAINTENANCE AND INSPECTION SERVICES.
4.1. The Contractor, with the CO or COR, shall determine the working order and condition of all VTE listed in Appendix A within fourteen (14) calendar days of contract award. The Government will either replace missing items or repair all items not in working order or serviceable condition, or the CO may direct the Contractor to replace the missing items, accomplish the repair, and reimburse the Contractor in accordance with the contract. The CO will give instructions for situations where a unit requires a level of repair potentially constituting alteration as described by Paragraph 3. The Contractor and the CO shall certify their agreement as to the working order of the equipment. All repair work shall be in accordance with standard commercial practices using only new parts of equal quality specified by the VTE manufacturer in effecting repairs (substitution of a different component is only permitted where it is equivalent to that which was tested, as determined by the certifying agency).
4.2. The Contractor shall develop a written Maintenance Control Plan (MCP) for each VTE and submit to the Government within thirty (30) calendar days after the working order and condition of all VTE listed in Appendix A is established (Paragraph 4.1). The MCP shall, at a minimum, include required inspections, timelines for inspections and maintenance to be performed. The Contractor shall perform inspections and maintenance of all VTE in accordance with the MCP. The MCP shall ensure compliance with all code requirements.
4.3. The Contractor shall perform maintenance in accordance with the MCP to ensure reliable and continuous safe operation. The maintenance work shall be in accordance with commercial practices or manufacturer’s specifications, if available, and shall be intended to maintain the VTE in safe and reliable operating condition. The MCP is required to specify appropriate intervals for specific maintenance items.
4.4. The Contractor shall provide a clean work site and remove all trash/debris in conjunction with maintenance, inspections, tests, and repairs as required.
4.5. The Contractor shall perform necessary inspections and tests as required under ASME A17.1 Appendix N, using a Qualified Elevator Inspector (QEI). The first annual test shall include the five (5) year test for all traction and roped hydraulic elevators regardless of due date.
4.6. The Government may perform inspections of the VTE at no cost to the Contractor for purposes of capital asset management and quality assurance. If discrepancies are discovered during these inspections, the Contractor will be notified in writing of any determination and may be responsible for the corrective actions, as determined by the CO.
4.7. The Contractor shall prepare and submit reports following any onsite work event. The Contractor shall submit a copy of the onsite report (paper or electronically) within two (2) business days following the work visit, to the CO. The Contractor shall submit a typed report electronically within five (5) business days following the work visit, to the CO. The report shall identify each VTE, the location, maintenance work performed, repairs needed, date of inspection, name of inspector, and overall condition of the VTE.
4.8. The Contractor shall maintain a consolidated record of all VTE inspections, along with an index indicating the location, date inspected, and date of the next required inspection. The index and certificates shall be delivered electronically to the CO no later than one (1) business day after the inspection visit.
5. REPAIR SERVICE CALLS. The Contractor shall provide service calls (routine and emergency) under the full maintenance service agreement at no additional charge. All repair work shall be done in accordance with standard commercial practices. The Contractor shall repair and replace components of the VTE at no additional cost to the Government. When a component or part is replaced, it must comply with the applicable manufacturer’s specifications. Substitution of a different component or part is only permitted where it is equivalent to the manufacturer’s specifications. All parts must comply with the Unified Facilities Guide Specifications (UFGS), and Unified Facilities Criteria (UFC) shall be used to benchmark acceptable replacement components (APPENDIX B).
5.1. The Contractor shall, upon request by the CO or COR, perform service calls on all VTE listed in Appendix A. The Contractor shall not accept service calls from any individual other than those authorized to place service calls. If the Contractor does receive a service call from anyone other than the authorized individuals, the Contractor shall advise the individual to contact the CO or COR. The Government is not responsible for calls placed by individuals other than the CO or COR.
5.2. Routine Calls. Service calls will be classified as routine when the work does not qualify as an emergency call.
5.2.1. The Contractor shall, upon request by the CO or COR, perform routine service calls on VTE listed in Appendix A. The Contractor shall be available to receive telephone calls and emails containing service call requests during normal duty hours (See Paragraph 8.3).
5.2.2. The Contractor shall respond in-person to the VTE and begin work on routine service calls at no additional cost to the Government within three (3) business days after receipt of the call on regular scheduled work days/hours. The Contractor shall contact the COR prior to arrival on Cannon AFB when responding to a routine service call.
5.2.3. If the Contractor estimates the repairs may fall under EXCLUDED SERVICES in Paragraph 2 of this PWS, the Contractor shall provide the COR with a written estimate of time and cost of repairs necessary to bring the VTE back to full and safe operation. The Contractor shall commence repair work after notification from the CO/COR.
5.3. Emergency Calls. Emergency calls are defined as calls made for services when a VTE system fails and constitutes a danger to personnel; threatens to damage properties; or threatens to disrupt activity, operations, and/or training missions.
5.3.1. The Contractor shall, upon request by the CO or COR, perform emergency service calls on VTE listed in Appendix A. The Contractor shall be available to receive telephone calls and emails containing emergency service call requests during normal duty hours (See Paragraph 8.3)
5.3.2. The Contractor shall respond in person to the VTE and begin work on emergency service calls within 24 hours after receipt of the call. The Contractor shall contact the COR prior to arrival on Cannon AFB when responding to an emergency service call.
5.3.3. If the Contractor estimates the repairs may fall under EXCLUDED SERVICES in Paragraph 2 of this PWS, the Contractor shall provide the COR with a written estimate of time and cost of repairs necessary to bring the VTE back to full and safe operation. The Contractor shall commence repair work after notification from the CO/COR.
5.4. Documentation. The Contractor shall prepare, as a minimum, the following documentation and/or reports:
5.4.1. Upon completion of the specified interval servicing visit, i.e. quarterly maintenance, service repair call, the Contractor shall submit a copy of the onsite report (paper or electronically) within two (2) business days following the work visit, to the CO. The Contractor shall submit a typed report electronically within five (5) business days following the work visit, to the CO. The report shall include the date and time of the work visit, the location of the VTE, the repairs performed, and the name of the technician who performed the repairs.
5.4.2. The Contractor shall maintain a consolidated record of all VTE inspections, along with an index indicating the location, date inspected, and date of the next required inspection. The index and certificates shall be delivered electronically to the CO no later than one (1) business day after the inspection visit.
5.4.3. Once per calender year, the Contractor shall perform an annual safety inspection for all the passenger and freight elevators. The inspection shall be performed in accordance with the requirements of ASME A 17.1. The Contractor shall submit a copy of the onsite inspection report (paper or electronically) within two (2) business days following the work visit, to the CO. The Contractor shall submit a typed inspection report electronically within five (5) business days following the work visit, to the CO. The report shall include the date and time of the work visit, the location of the VTE, any repairs performed, and the name of the technician who performed the inspection.
6. SERVICES SUMMARY.
The Government will evaluate the Contractor’s performance in accordance with the following criteria. Performance evaluations will be rendered in one or more Government databases for that purpose.

7. GOVERNMENT FURNISHED PROPERTY AND SERVICES.
7.1. The Government does not anticipate providing any Government Furnished Property (GFP).
7.2. The Government will allow the use of electricity (as necessary) and facility water for accomplishment of services IAW this PWS.
8. GENERAL INFORMATION.
8.1. Quality Control. The Contractor shall develop and maintain a Quality Control Program (QCP) to ensure maintenance and repair services are performed IAW ASME A17 series (APPENDIX B), commercial practices or manufacturer’s specifications. The Contractor shall develop and implement procedures to eliminate reoccurrence of once identified/repaired defects. As a minimum, the Contractor shall develop quality control procedures that address the areas identified in Paragraph 6, Services Summary and APPENDIX C. The QCP shall demonstrate how the Contractor ensures quality performance during the contract period of performance. The Contractor shall maintain the QCP throughout the period of performance of the contract. The CO shall be provided updates to the QCP as they occur during the period of performance. The QCP shall identify the procedures in writing for inspections, individual responsible, VTE MCP, and the location of all inspection records and key control logs which shall always be available to the Government upon request. The QCP shall have the inspection forms and records which shall be used for the service. The Contractor shall identify to the CO or COR the responsible quality control inspector to notify in case of customer complaints.
8.2. Quality Assurance. The Government will periodically evaluate the Contractor’s performance in accordance with the Quality Assurance Surveillance Plan, using a COR as the primary means of assessment.
8.2.1. The COR is an authorized Government representative who will perform assessments of the Contractor’s performance. Subsequent to contract award the identity of the COR, with a letter defining their duties and authority will be furnished to the successful bidder/offeror. The COR will evaluate the Contractor’s performance through on-site inspections, the Contractor's QCP and receipt of customer complaints. The COR may inspect each task as completed. The COR will investigate complaints received from customers. The COR will determine validity of customer complaint(s). In cases of disagreement final determination will be made by the CO.
8.3. Hours of Operation. Normal hours of operation are 0730-1630. The Contractor may work, with prior approval of the CO, extended hours to ensure timely completion of work at no additional cost to the Government.
8.3.1. Recognized Holidays. Other than emergency services, the Contractor is not required to provide service on the following days: New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day. If the holiday falls on Saturday, it is observed on Friday. If the holiday falls on a Sunday, it is observed on Monday.
8.4. Security Requirements. The Contractor shall be responsible for all passes issued under this contract. Applications shall be coordinated through the CO. A background check may be conducted in connection with base pass requests. Upon termination of employment the Contractor shall be responsible for returning identification cards and base passes to 27th Special Operations Security Forces Squadron within 24 hours.
8.4.1. Traffic Laws. The Contractor and its employees shall comply with base traffic regulations. Violations may result in the loss of base driving privileges and/or debarment from the installation.
8.4.1.1 Employees shall wear a seatbelt when operating or riding in any military, Contractor owned, or privately-owned vehicle while on the installation.
8.4.1.2. All vehicle operators on the installation shall not use cell phones unless the vehicle is safely parked or unless they are using a hands-free device. The wearing of any other portable headphones, earphones or other listening devices (except for hand-free cellular phones) while operating a motor vehicle is prohibited.
8.4.2. Weapons, Firearms, and Ammunition. Employees are prohibited from possessing weapons, firearms, or ammunition on themselves or within military, Contractor, or privately owned vehicles while on CAFB.
8.4.3. Reporting Requirements. Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware may pose a threat to the security of DOD personnel, Contractor personnel, resources, and classified or unclassified defense information.
8.4.4. Physical Security. The Contractor shall be responsible for safeguarding all Government property and controlled forms provided for Contractor use. At the end of each work period, all Government facilities, equipment, and materials shall be secured.
8.4.5. Controlled/Restricted Areas. Contractor employees shall be escorted while in AF controlled/restricted areas on CAFB. When escorted, employees shall remain with their assigned escort at all times while in controlled/restricted areas. Escort responsibility rests with the sponsoring agency. Escort officials assume responsibility for the safe and secure conduct of escorted employees and are required to maintain constant surveillance and control of employees at all times while in a controlled/restricted area.
8.4.6. Photography. Photography in or within the close proximity of an AF controlled/restricted area, flight line, or taxiway is strictly prohibited. Contractors that wish to take photos shall coordinate with the COR who will coordinate with the appropriate facility personnel for clearance prior to taking photos.
8.4.7. Key Control. The Contractor shall establish and implement methods of making sure all keys and/or combinations issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. The Contractor shall not duplicate any keys issued by the Government.
8.4.7.1. The Contractor shall immediately report to the COR any occurrences of lost or duplicated keys, compromised lock combinations, or use by unauthorized persons.
8.4.7.2. In the event keys, other than master keys, are lost or duplicated, the Contractor may be required, upon written direction of the CO, to re-key or replace the affected lock or locks without cost to the Government. The Government may, however, at its option, replace the affected lock or locks or perform re-keying and deduct the cost of such from the payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the payment due the Contractor.
8.4.7.3. The Contractor shall prohibit the use of keys or combinations, issued by the Government, by any other persons other than the Contractor's employees and the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in performance of contract work requirements in those areas.
8.5. CONTINUATION OF ESSENTIAL DEPARTMENT OF DEFENSE SERVICES DURING CRISIS DECLARED BY THE NATIONAL COMMAND AUTHORITY OR OVERSEAS COMBATANT COMMANDER.
8.5.1. Performance of Service During Crisis or Heightened Security. In the event of crisis or heightened security caused by a national emergency, natural disaster, or other causes, continue performance as necessary in support of the Air Force mission for emergency calls for all VTE listed in APPENDIX A, as determined by the functional commander or civilian equivalent and as directed by the CO. The contract price and delivery schedule may be adjusted to reflect any change of work that may be directed. The Contractor shall submit a Mission Essential Contractor Services Plan with proposal documents IAW APPENDIX C to the CO. The Contractor shall reference the following in developing the Mission Essential Contractor Services Plan: DFARS 252.237-7023, Continuation of Essential Contractor Services and DFARS 252.237-7024, Notice of Continuation of Essential Contractor Services.
8.5.2. As found in DFARS 252.237-7024, the Mission Essential Contractor Services Plan shall address, at a minimum:
(1) Challenges associated with maintaining essential Contractor services during extended event, such as a pandemic that occurs in repeated waves;
(2) The time lapse associated with the initiation of the acquisition of essential personnel and resources and their actual availability on site;
(3) The components, processes, and requirements for the identifications, training, and preparedness of personnel who are capable of relocating to alternate facilities or performing work from home;
(4) Any established alert and notification procedures for mobilizing identified "essential Contractor service" personnel; and
(5) The approach for communicating expectations to Contractor employees regarding their roles and responsibilities during a crisis.
8.6. Special Qualifications. The Contractor shall be licensed by the State in which the work is conducted to provide the services specified in this contract. All work shall be performed by personnel who are trained and qualified for the systems and equipment. Contractor personnel shall be certified by appropriate federal and state regulatory agencies to meet federal and local certification requirements (license/certifications to be provided to CO as stated in APPENDIX C) in maintenance of VTE.
8.7. Schedule Coordination. The Contractor shall be responsible for coordinating all phases of his/her operations with the appropriate base personnel through the CO or COR. The facilities shall remain in operation while the Contractor is working, and it is up to the Contractor to coordinate around the normal activities of the facility.
8.8. Environmental Control. The Contractor shall comply, and assure that all subContractors comply, with all applicable federal, state, and local laws, regulations, ordinances, policies and standards related to environmental matters. Where applicable, the Contractor shall use environmentally safe products in the course of completion of their project. The Contractor shall maintain, in company vehicle on site, Safety Data Sheets (SDS) for all chemicals. A copy of all SDS’s shall be provided to the CO or COR. The SDS data is subject to random checks by the Government. The Contractor shall maintain, and provide on demand, an inventory of materials being brought into the Government facility. The Contractor shall complete, and provide on demand, monthly inventories of HAZMAT used, including but not limited to: solvents, paints, degreasers, greases, Ozone Depleting Substances, and oils brought into the Government facility. If the Contractor spills or releases any HAZMAT or other substance contained in 40 CFR 302 into the environment, the Contractor shall immediately notify the CO or COR and appropriate emergency responders. The Contractor is responsible for all costs associated with clean-up and restoration, including any applicable fines and/or penalties. The Contractor shall maintain a spill plan as required by federal, state, and local laws and regulations.
8.8.1. Environmental Management System (EMS). All Contractor personnel shall complete EMS Awareness training prior to commencement of any activities. Training is available through the learning management system called The Environmental Awareness Course Hub (TEACH) at https://usaf.learningbuilder.com/account/login/?ReturnUrl=%2f. The Contractor shall submit the Awareness Training Certificates of Completion to the COR prior to any on-base performance under this contract. Use of Microsoft Edge, Google Chrome or Mozilla Firefox is required to print certificates.
8.8.2. Hazardous Materials Handling. The Contractor shall comply with all federal, state, and local regulations (including Cannon Air Force Base & Melrose Air Force Range Civilian Contractor Environmental Guide) concerning the use, storage, and reporting of Hazardous Materials (HM). In accordance with AFI 32-7086, Hazardous Materials Management, the Contractor shall provide the following information to the CO for all HM to be used:
(1) Product identification or label

8.8.3. The above information must be submitted to the CO on a Cannon AFB Contractor Hazmat Worksheet and Cannon AFB Contractor HM Usage Worksheet. The Contractor may not bring a HM onto Cannon AFB, nor use a HM, until the Contractor receives all required authorizations. This HM information shall be submitted 30 calendar days prior to the HM being brought onto CAFB. The Contractor shall submit monthly reports thereafter, by the fifth business day after the completed month, to the CO that contains actual usage information. The CO will forward these reports to CAFB HAZMART and 27 SOCES Environmental Section for Hazardous Material inventory tracking purposes. HAZMART, in consultation with 27 SOCES Environmental Section, may determine after review of the initial report that follow-on reports are not necessary. For definition of HM, the Contractor shall refer to FED-STD-313D. HM includes pesticides and cleaning supplies. The Contractor shall not use EPA-prohibited chemicals and shall be encouraged to not use products which result in the generation of hazardous waste, air or water pollution. Class I Ozone Depleting Substances shall not be used for any requirement of this contract. The Contractor shall maintain a copy of current SDSs readily available to employees for HM in use or being stored. The Contractor shall be OSHA compliant.
8.8.4. In the event environmental laws/regulations change during the term of this contract, the Contractor is required to comply as such laws/regulations come into effect. The Contractor shall notify the CO at earliest knowledge of the law/regulation change.
8.9. Notification of Environmental Spills. If the Contractor spills or releases any substance contained in 40 CFR 302, Designation, Reportable Quantities, and Notification into the environment, the Contractor or its agent shall immediately report the incident to Cannon AFB Fire Dept. at 911 if on CAFB. The liability for the spill or release of such substances rests solely with the Contractor and its agent.
8.10. Asbestos. The Contractor shall comply with Section 29 CFR 1910.1001(j)(7)(iv). VTE may be located in facilities that may contain Asbestos Containing Material (ACM) or Presumed Asbestos Containing Material (PACM). The Contractor (not the Government) shall determine if any exposure to ACM may result in performing work under the contract.
9. GREEN PROCUREMENT PROGRAM (GPP).
9.1. In performance of this contract, Contractors shall use Environmental Protection Agency (EPA) designated recycled content products, Information Technology (IT) Energy Star products/appliances, Federal Energy Management Program (FEMP) Designated Energy Efficient Low Stand By Power products/appliances, U.S. Department of Agriculture (USDA) Bio based/Bio preferred products, Environmentally preferable products, Electronic Product Environmental Assessment Tool (EPEAT) registered products, Water Sense or other water efficient products, non- or Low Ozone depleting substances under the Significant New Alternatives Policy (SNAP), non or Low toxic or hazardous constituents (e.g. non-VOC paint) and any other environmentally sustainable product/method, to the greatest extent possible.
10. SAFETY PLAN.
10.1. In performing work under this contract, the Contractor shall develop and provide to the CO, within 21 calendar days of award, a safety plan for the protection of Government facilities and property and to provide a safe work environment for Contractor personnel (APPENDIX C).
11. INFRASTRUCTURE GROWTH.
11.1. Due to CAFB infrastructure growth, as new facilities remodified, constructed and demolished, Appendix A will be subject to change. Any changes to the contract will be accomplished with a modification to the contract.
12. CONTRACTOR MANPOWER REPORTING REQUIREMENTS.
12.1. Contractor Manpower Reporting Requirements. The Contractor shall report ALL Contractor labor hours (including subContractor labor hours) required for performance of services provided under this contract for the Air Force via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the help desk at: http://www.ecmra.mil.

APPENDIX D
OVER & ABOVE INSTRUCTIONS
1. O&A Work Definition. O&A work means work discovered during the course of contract performance that is not covered in the full maintenance service arrangement covered by the line items for the basic work under the contract, and necessary in order to satisfactorily return the VTE to a safe and operational condition. The Contractor shall identify needed repairs and recommend corrective action during contract performance. Using the O&A CLIN (0002 and subsequent option year CLINs) permits the Government and the Contractor to negotiate parts and labor which are necessary to make repairs or prevent malfunctions but are not specifically identified and priced. Examples of O&A work include, but are not limited to: EXCLUDED SERVICES identified in Paragraph 2.
NOTE: The Government reserves the right to utilize other contract vehicles for maintenance/repair or replacement of equipment or infrastructure system upgrades/modifications.
1.2. O&A Work Procedures.
1.2.1. The Contractor shall submit to the COR an O&A request form describing the O&A work being proposed. The form, with all applicable fields completed, shall be submitted within five (5) business days for non-emergencies and as soon as possible for emergencies.
1.2.2. The COR will send the work request package to the CO for review/approval.
1.2.3. The Contractor and CO will negotiate a firm-fixed-price settlement for the work. The Contractor shall not begin work until receipt of a signed/approved work request form or approval memo from the CO. The Contractor shall commence work and complete work by the mutually agreed upon dates stipulated in the form/memo.
1.2.4. Failure of the Contractor to provide the information required on the O&A work request, within the specified timeframe, may be grounds for the Government to openly compete the O&A work. Additionally, if the Government and the Contractor cannot agree upon a firm-fixed price for the O&A work request, the Government has the right to openly compete the O&A work.
