About this file
This is a Contractor Questions and Answers document addressing EPA environmental compliance requirements for a Raider outboard engines procurement.
The document addresses a single substantive question regarding whether the procurement requires compliance with 40 C.F.R. § 1068.225, which provides an exemption from EPA engine and equipment standards for national security purposes under the Clean Air Act. The contractor inquired whether the Government or the contractor would be responsible for obtaining the required EPA endorsement under 40 C.F.R. § 1068.225(d). The Government's response clarifies that the procurement does require a formal exemption, and the contractor is responsible for working with the manufacturer to obtain the exemption in order to fulfill the procurement requirement. The answer does not address whether the Government will provide support or cost reimbursement for obtaining the exemption.

Contractor Questions and Answers
Q1. Could you please confirm whether the procurement of Raider outboard engines requires compliance with 40 C.F.R. § 1068.225, which provides an exemption from EPA engine and equipment standards for national security purposes under the Clean Air Act (42 U.S.C. § 7401 et seq.)?
Specifically, under § 1068.225(a)(1), engines owned by a federal agency responsible for national defense may be exempt from applicable EPA standards, provided that the required endorsement is obtained in accordance with § 1068.225(d).
In this regard, could you please clarify whether the Government will provide the endorsement required under 40 C.F.R. § 1068.225(d), or whether the contractor is responsible for obtaining and providing the required endorsement?
A1: Good afternoon. This procurement does require a formal exemption. The contractor will work with the manufacturer to obtain the exemption to fulfill the requirement.
