JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

BRANDNAMEREQUIREMENT

I. CONTRACTING ACTIVITY: 23d Contracting Squadron

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED:

A firm fixed price purchase order is anticipated to be awarded for preventative maintenance and unscheduled services for existing aircraft paint hangar insert booth, abrasive blast equipment, paint spray and surface preparation booths for Moody AFB, GA for a base period of one (1) year and four (4) one (1) year option periods. In accordance with FAR 6.302-1(c)(1)(ii), application for brand name descriptions shall be justified and approved if only a portion of the acquisition is for a brand-name product or item peculiar to one manufacturer, the justifaction and approval is to cover only the portion of the acquisition which is brand-name or peculiar to the manufacturer. The justification should indicate that the use of such descriptions in the acquisition or portion of an acquisition is essential to the Government’s requirements.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S

NEEDS: (FAR 6.303-2(b) (3); AFFARS MP5306.304; AFI 11-410 (4.4.1)). Among the equipment requiring maintenance services is a Booth Insert manufactured by Global Finishing Solutions (ACDW- FS-073022078), including a Booth Control Panel (CP-100). The controls are Original Equipment Manufacture (OEM) designed, built, and programmed specifically for the booth. Per the Global Finishing Solutions’ Industrial Preventative Maintenance & Service department, only GFS, qualified distributers, and certified service technicians are authorized to maintain their control panel due to their intellectual property. If another entity, without proper certification, attempts to maintain these controls it may result in an action that would make the booth operate out of design parameters. To procure a new booth insert and control panel would substantially increase cost.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION: 10 USC 2304(c)(1), as implemented by FAR 6.302-1 (FAR 6.303- 2(b)(4)). The justification for restricting competition is in accordance with Federal Acquisition Regulation FAR 6.302-1 (Only One Responsible Source). This is a Brand Name requirement.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED

ABOVE (APPLICABILITY OF AUTHORITY): FAR Part 13.501(a) permits for the solicitation for a Brand Name item that exceeds the simplified acquisition threshold. The requiring activity is already in possession of a booth insert and has identified the need for preventative maintenance of said insert. Per manufacturer instructions, Global Finishing Solutions, qualified distributers, and certified service technicians are the only entities authorized to maintain the control panel aspect of this booth and any contradicting action may void the warranty.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED

FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:

The maintenance required for this specific item may only be performed by Global Finishing Solutions, qualified distributers, or certified service technicians. All other items noted in the Performance Work Statement are unrestrictive.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

Prices will be determined fair and reasonable by competition as well as market research and comparison with prices found reasonable for similar services. (FAR 13.106-3(a)(2)(i-iv)).

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS,

OR A STATEMENT OF THE REASONS MARKET eRESEARCH WAS NOT CONDUCTED:

Market research was conducted through a Sources Sought posted to FBO as well as a DSBS search. The sources sought received one (1) response. These services are not currently being performed at Moody

AFB.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION: Not Applicable.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION:

The original equipment manufacturer; Global Finishing Solutions. Aerospace Facilities Group responded to our Sources Sought post.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT

ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED:

For any future requirements, the government will re-engage with the manufacturer to evaluate other potential sources (FAR 6.303-2(b)(11)). This item will be solicited as Brand Name due to manufacturer restrictions.

XII. CONTRACTING OFFICER’S CERTIFICATION:

(FAR 6.303-2(b) (12)) I certify to the best of my knowledge and belief that the information contained in this justification is accurate and complete. This is evidenced by the contracting officer’s signature on the Coordination and Approval Document.
