PWS
SERVICE FOR ALL HIGH-EXPANSION FOAM FIRE SYSTEMS ON BEALE AFB
1.0. Description of Services: The Contractor shall furnish all labor, supervision, tools, equipment, transportation, material and incidentals necessary to service Beale AFB foam fire system units listed in Appendix A. The Contractor shall perform services including, but not limited to full flow testing, annual and two year inspections, maintenance and repairs, foam replacement, retesting, certification of systems and clean-up and proper disposal of expended fire foam. The testing, inspection, repairs re-testing and certification of systems shall conform to the most current NFPA fire codes, Unified Facilities Criteria (UFC), and all federal, state, county, and local regulations.
1.1. Scheduling. Contractor shall submit a maintenance schedule to the Contracting Officer Representative (COR) within 10 working days after award of the contract. All scheduled maintenance and inspections shall take place no later than the 15th day of every inspection period.
1.2. Coordination. The Contractor’s loss of productivity resulting from failure to schedule, complete all work on schedule, or to coordinate with the COR shall be at no additional cost to the Government.
1.3. Clean-up. The Contractor is responsible for the complete cleaning of the work site at the end of each day. Upon completion of specified work, all materials and other property belonging to the Contractor shall be removed and the work site shall be returned to its original condition or as specified by the Contracting Officer (CO).
1.4. Security. Contractor shall be responsible for keeping and securing the work location, which he/she is working.
1.5. Damage. The Contractor will survey the area where work is to be performed and notify the COR in writing of any damage noted prior to beginning performance in that location. Damage not recorded prior to starting work will be repaired at the Contractor’s expense.
1.6. Interim Service Calls. Included are all interim calls deemed necessary to maintain equipment in good operating condition. The Contractor shall be on-site within 24 duty hours from the time the call is placed. Contractor working hours are 0700-1600, Monday through Friday. This service will be at no additional cost to the Government.
1.7. Documentation. After every inspection or maintenance and repair, the Contractor shall provide a signed checklist of the services performed on all foam fire systems to the COR. The checklist shall contain the foam fire systems and building locations, date of service, maintenance actions accomplished, parts/materials utilized and the person who completed the task.
1.8. Miscellaneous Requirements
• Practice water conservation;
• Turn off unnecessary lights;
• Report fire hazards, conditions, and items in need of repair to the COR;
• Turn in lost and found articles to the COR; and,
• The Contractor shall notify the COR of any condition, including adverse weather or special requests from government personnel, that may interrupt or delay performance under this PWS. Once the condition is resolved the Contractor shall resume interrupted work as soon as practical. When this period exceeds 24 hours, the COR must approve the delay.
2.0. Contractor Provided Equipment and Supplies
2.1. Equipment, Machines, and Tools. All equipment, machines, and tools used during the performance of the work shall be maintained in satisfactory operating condition, and used in the manner that the tool was designed to be used for. The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness, and materials handling, including hazardous materials. All work and materials shall conform to the latest edition, revision, amendment or version of UFC 3-601-02 and all federal, state, county and local regulations.
2.2. Replacement Parts. Before installation of any parts, the COR must approve any anticipated repair which exceeds the cost of $250.00. Approved parts must be listed separately on invoice.
2.3. Telephone Service. There are no Government telephones available for the contractor’s use.
The Contractor shall provide his/her own cellular telephone service at his/her own expense.
3.0. Environmental Controls
3.1. Compliance with Laws and Regulations. The Contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations/requirements change the term of this contract, the contractor shall comply with such law/regulation as changed. If there is an increase or decrease in cost as a result of the change, the Contractor shall immediately inform the CO.
3.2. Notification of Environmental Spills. If the Contractor spills or releases any substance listed in 40 CFR 302 into the environment, the Contractor shall immediately report the incident to the COR. The Contractor shall be liable for the spill or release of such substances.
3.3. Environmental and Hazardous Material Handling. The Contractor is responsible for advising his employees of all environmental and hazardous materials handling and is also required to have and maintain Material Safety Data Sheets (MSDS) on all materials that are required by state and federal laws and/or regulations. (Reference AFI 91-301 and OSHA requirements) to include Air Force and OSHA requirements.
4.0. Hazardous Material and Hazardous Waste (HM/HW)
4.1. Hazardous Material. Hazardous material includes all material hazardous to health, safety, or the environment, such as but not limited to, hazardous chemicals, hazardous substances, toxic chemicals, and extremely hazardous substances, as defined by any of the following:

The Government’s policy is to reduce the use of hazardous materials in keeping with federal pollution prevention goals. Beale AFB operates a Hazardous Material Pharmacy (HMP) to control and reduce the use of hazardous materials and to maintain a hazardous chemical inventory in accordance with policy and regulatory requirements. The Contractor shall use non-hazardous materials whenever possible.
4.1.1. Requirements. Hazardous materials must be approved by the HMP prior to being brought onto the installation. The Contractor shall submit a list of all hazardous materials intended for use, along with corresponding material safety data sheets (MSDS), to the HMP, through the contracting officer (CO), at least five (5) days prior to beginning work or bringing hazardous materials onto the installation. The listing shall include product name, chemical type, and quantity to be brought onto the installation, process for which it will be used, and disposal method for empty containers and any resulting hazardous or nonhazardous waste. The Contractor shall report how and when approved hazardous materials are used, including any amount spilled, evaporated as an air emission, or properly disposed of as solid or hazardous waste. Special reporting may be required at the Contractor’s expense. The contractor shall submit to the HMP, through the CO, an inventory of approved hazardous materials brought onto the installation within five (5) days after initial job start. The inventory shall include product name, chemical type, quantity on-hand, and quantity to be used. An updated quarterly inventory shall be submitted to the HMP, through the CO not later than the 10th of the month following the previous quarter listing quantities used during the previous month, total quantities used since job start (on an annual basis), and any amount disposed of as hazardous or nonhazardous waste. The contractor shall be responsible for knowing which materials are considered hazardous and shall comply with federal, state, and local requirements pertaining to the proper use, labeling, storage, transporting, and disposal of hazardous materials and hazardous wastes. Hazardous material will not be stored on base.
4.1.2. Cost or Fines. Any costs or fines levied against the installation due to the Contractor’s failure to comply with applicable federal, state, or local laws shall be borne by the contractor.
4.2. Hazardous Waste. Government policy is to reduce the disposal of hazardous waste in keeping with federal pollution prevention goals. Hazardous waste includes, but is not limited to, material discarded or disposed of which exhibits characteristics of toxicity, reactivity, corrosivity, or ignitability, or which is listed as hazardous waste by any of the following:

4.2.1. Spill Prevention and Response. The Contractor shall ensure all employees are knowledgeable of spill prevention and response procedures. If a spill does occur, the Contractor shall take immediate action to contain it and report the incident to the Fire Department by dialing 911 from any base phone. If calling by cellular phone, dial (530) 634-2117. The Contractor shall also notify CEV at 4-2844 (Government telephone) or (530) 634-2844 (commercial). The spill shall also be reported in writing by the contractor to the CEV within 48-hours. SPILL CLEAN UP: The Contractor shall clean up, containerize and properly dispose of any spills caused by Contractor employees such that no petroleum product, toxic chemical or hazardous substance enters any creek, gutter, or other appurtenance leading to natural drainage, storm drainage, or sanitary sewer systems. This includes any chemicals or substances that cause soil staining or other potential for air, water, or soil degradation as determined by the Base Environmental Flight. All spills shall be cleaned to the satisfaction of CEV.
4.2.1.1. Spill Report. The Contractor should anticipate that the Government will report any hazardous spills or discharges to federal, state, and local environmental regulatory agencies, as appropriate, and that the contractor will be held responsible for cleanup and remedial action according to federal, state, local and Government specifications. If required by the Government, the contractor shall sample, in the presence of CEV, the spill site to show adequacy of spill clean-up. If Government assistance is provided for the clean-up, the Contractor will be charged the cost of labor and materials used for this purpose.
4.2.1.2. Government Spill Clean-up. Spill clean-up using Government resources will be charged to the Contractor at an amount determined by the CO, based upon actual costs incurred.
4.3. Ozone Depleting Chemicals (ODC). The contractor shall not use, in performance of this requirement, Class I ODCs, nor shall the delivery of these Class I ODCs be any item of supply or part of any service. If no suitable substitute to a Class I ODC exists, the contractor must contact the CO.
5.0. Government Furnished Property and Services
5.1. Government Furnished Utilities. Reasonable quantities of electricity and water shall be provided to the Contractor without charge. The Contractor shall be responsible for installation, maintenance, repair, and removal of temporary connections or lines, and for returning all utilities connections to original conditions. No utility service shall be interrupted unless authorized by the
CO.
5.2. Government Furnished Supplies and Equipment. None
5.3. Government Furnished Covered or Secured Storage. None
5.4. Security, Fire and Medical Services. The Government will provide police and fire protection. In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis.
5.5. Refuse Collection and Disposal. The Contractor shall use existing bulk containers to dispose of trash or refuse generated from accomplishment of services detailed in this PWS. The Contractor shall adhere to all base level recycling programs.
6.0. General Information
6.1. Hours of Operation. Normal working hours are between the hours of 0700 and 1600, excluding Saturdays, Sundays and federal holidays. If the contractor desires to work during other periods, rescheduling of Government inspection forces may be required. The Contractor shall notify the CO three (3) working days in advance of the desired work period to allow assignment of additional inspection forces, if available. If such forces are available, the CO may authorize the Contractor to perform work during the requested periods; however, if inspectors are required to perform in excess of their normal duty hours solely for the benefit of the Contractor, the cost of the inspection at overtime rates will be charged to the Contractor.
6.2. Contract Manager. The Contractor shall establish and maintain an office through which the contract manager or alternate(s) can be contacted during work hours. The Contractor shall provide the CO with telephone number(s) where surveillance results and complaints can be reported. The Contractor shall also provide to the CO the names and phone/pager numbers of Contractor POCs for after business hours including nights, weekends, and holidays. This information will be kept updated by the Contractor whenever personnel changes occur.
6.3. Personnel. Contractor shall submit a list of all personnel, vehicles, and equipment to be used on the project to the CO for coordination with the Security Forces, Fire Department, and other base organizations a minimum of five (5) working days prior to first work under this contract.
Updates to the list shall be provided when changes occur.
6.3.1. Personnel Appearance. Contractor personnel shall present a neat appearance. Contractor personnel shall be easily recognizable while on the installation in conjunction with this contract.
This shall be accomplished through the wear of distinctive clothing, overcoats, rain gear, or hats, bearing the company name or logo. The coloring or design of the items selected should be such that identifies personnel easily and quickly for reasons of safety and personal protection.
6.3.2. Restrictions. The Government is authorized to restrict the employment under the contract of any Contractor employee or prospective Contractor employee, who is identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population.
6.3.3. Contractor Qualifications. All work shall be performed by or under the direct supervision of a Contractor who shall submit to the CO, documentation showing that they possess California C-16 contractor's license. Contractor shall also provide evidence of three (3) recent years of experience in work similar in type and scope, to include project titles, dollar amounts, and points of contact with current telephone numbers, and percent and description of work self-performed and/or subcontracted.
6.4. Work Site Access. Work areas will be made available to the Contractor to the greatest degree possible. Work shall be arranged by the Contractor so that interference with traffic is minimized. Most areas are restricted access areas and the Contractor will need an escort into each area. Coordination will need to be made with the COR five (5) working days prior to scheduled maintenance.
6.5. Safety. The Contractor shall comply with all applicable federal, state and local safety standards. Current Air Force Occupational Safety and Health (AFOSH) standards also apply.
6.6. Traffic Laws. The Contractor and its employees shall comply with base traffic regulations.
6.7. Weapons, Firearms, and Ammunition. Contractor employees are prohibited from possessing weapons, firearms, or ammunition, on themselves or within their Contractor-owned or privately owned vehicle while on BAFB.
6.8. Reporting Requirements. Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware that may pose a threat to the security of DoD personnel, Contractor personnel, resources, and classified or unclassified defense information.
6.9. Physical Security. The Contractor shall be responsible for safeguarding all government property and controlled forms provided for Contractor use. At the end of each work period, all Government facilities, equipment, and materials shall be secured.
6.10. Workload Variations. The Government may add/delete foam fire systems during the contract period. The cost for additions/deletions will be based on the existing scheduled maintenance per cost per foam fire system for the contract year at the time of the change.
6.11. Utility Shutdown. No utility service shall be interrupted to make connection, to relocate, or for any purpose without approval of the COR. Request for permission to shutdown services shall be submitted in writing to the COR 14calendar days prior to date of proposed interruption.
The request shall give relevant information, i.e., date, time, duration, etc.
6.12. Work Reservations. The Government reserves the right to accomplish any of the work outlined in this specification with its own resources. This reservation is extended to work that is integral to other contracts for the maintenance, repair, renovation, or construction of base facilities and infrastructure.
6.13. Contractor Manpower Reporting. The Contractor shall report ALL Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for Beale Air Force Base via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October – 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.
Uses and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.
User Manuals: Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.
7.0. Other Materials
7.1. Recycled Materials. In accordance with federal procurement goals, Contractor shall use recycled material where possible. Contractor shall identify the quantities and value of recycled material included in invoices submitted to the CO.
7.2. Disposition of Materials. The title to all scrap, salvage, waste and excess material generated as a direct result of this contract is vested to the contractor unless specifically exempted. The contractor shall dispose of scrap, salvage, waste and excess material off base in accordance with applicable federal, state, and local laws and regulations.
8.0 Fire Prevention. The contractor shall report any fire, no matter how small, by dialing 911.
8.1. General. Fire hoses and extinguishers shall not be moved or used for any purpose other than firefighting. Smoking is strictly prohibited in any federal facility or near flammables. The contractor shall notify the Fire Department of any utility outage that might affect fire suppression or detection systems. Prior to leaving the work site at the end of each day, the Contractor shall ensure the area is left in a fire safe condition. Bulk storage of gasoline and burning of any material is strictly prohibited.
8.2. Assistance. The Base Fire Department Technical Services Section is available to advise and assist on matters related to fire prevention and fire protection. They can be reached at (530) 634- 8677.
8.3. Fire Hydrants. Use of fire hydrants is prohibited without prior written approval from the Base Fire Department. Written requests for fire hydrant use shall be submitted to the Fire Department Technical Services Section a minimum of five (5) working days prior to the desired date of use.
8.4. Welding, Cutting, or Flame Operations. Any welding, cutting or open flame operations will require the Contractor to secure a welding permit from the base Fire Department Technical Services Section at (530) 634-8677.

9.0. Service Summary (SS). The contract service requirements are summarized in performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The SS and the Contractor’s Quality Control Plan provide information on contract requirements, the expected level of Contractor performance and the expected method of Government surveillance and confirmation of services provided. These thresholds are critical to mission success.
Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies. During the first initial 30 days of the contract, two additional errors on each task shall be allowed in an effort to identify normal phase-in problems.
When a performance threshold has not been met or Contractor performance has not been accomplished, the COR will initiate and provide the CO a Corrective Action Report (CAR) for issuance to the Contractor. The Contractor shall respond to the CAR in accordance with instructions provided and return it to the CO within 10 calendar days of receipt. The CO will have 10 calendar days to respond back to the Contractor with acceptance or rejection of the Contractor’s response to the CAR.
An initial performance review will be performed by the CO within 30 days of start of contract performance.

9.1. Surveillance Methods.
9.1.1. 100% Surveillances. This method requires the COR to inspect the service each time it occurs. Results shall be annotated on the Performance Assessment Report (PAR). Any deficiency shall be documented and the contractor shall re-perform service immediately, if appropriate, or within 8 hours at no increase in contract amount. Any unsatisfactory inspection identified but re-performed acceptably shall still be counted as an unsatisfactory inspection for trending purposes.
Receiving two or more unsatisfactory 100% surveillances within a 12 month period may result in unsatisfactory past performance documentation. Continued receipt of unsatisfactory 100% surveillances during the contract period shall constitute a negative trend and the Contracting Officer may take any appropriate action in accordance with the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance.
9.1.2 Customer Complaints. The COR will receive and investigate complaints. The COR shall be responsible for annotating the complaint on a Customer Complaint Record (CCR). The CO shall make the final determination of the validity of customer complaints in cases of disagreement with the COR and the Contractor. Validated customer complaints shall be immediately communication to the Contractor for re-performance within the re-performance thresholds of the SS.
9.2. Periodic Progress Meetings. The Contracting Officer, Functional Commander, COR, other Government personnel as appropriate, and the Contractor shall periodically meet to discuss the Contractor’s performance. The following issues shall be discussed, opportunities to improve the contract, any modifications required of the contract, unsatisfactory inspections and trends against each performance objective observed, positive performance and steps taken by the Contractor to prevent unsatisfactory occurrences in the future. The Contractor shall provide a summation of unsatisfactory inspections and customer complaints and provide insight into any identified trends.
The minutes of these meetings will be reduced to writing, signed by the CO and any other signatures as deemed appropriate, distributed to the functional area and the contractor. Should the contractor not concur with the minutes, the contractor will provide a written notification to the Contracting Office identifying areas of non-concurrence for resolution.
