1) Can you explain the reasoning or intent of the $750,000 Reserve Bond. We have talked with our surety company and they are unwilling to provide this document based on the terms and conditions of the solicitation. They find the clause particularly onerous for a small business, especially given that this contract is a Total Small Business Set Aside. Their concerns are that a potential liability would be written with no defined scope of work, nor the promise that the liability would ever be executed. Furthermore, that the liability could be renewed for a period of up to five years by the contracting authority with only the promise of $10,000 in work. There is a huge opportunity cost here for both the surety and the indemnified (contractor) in tying up that amount for that long. We are attempting to get a clearer definition of the intent of this document.

It seems from the wording in the solicitation that his bond would be used in an emergency situation. Having said that, the solicitation calls for emergency situations requiring contractor response within (1) hour and mobilization within

(4) hours. It further calls for expedited proposals to be completed within 3-5 calendar days of need. A surety company can turn a bond around within (24) hours. Is this bond to bridge the gap between formulation of emergency proposals, scope of work and task order issuance in emergency situations? Would not a Time and Materials Reserve Bond suffice in such a situation? Why the need for $750,000? It does not seem that anywhere near this amount of work would be completed in the time frame described.

The solicitation also states that the contractor has the option of "passing" on any work order or combination of work orders that exceed $1 million dollars at a given time. Is the work included in this Reserve Bond excluded from that provision? This again, is where the amount called for comes into question. Our surety does have a Renewable Bond that they offer, for a specified period of time. However, this document is renewed by consent of the Surety, not the contracting authority. We are looking for some guidance on this particular clause that both protects the contracting authority's position as well as the interests of the Small Business Owner.

Answer: Refer to amendment to solicitation. Requirement for Reserve Bonding is hereby removed. The SOW will be changed to reflect this upon contract award.

2) 01010: General Requirements page 3 of 130 - Please expand on the requirement of Quality Control for the inspection and testing as identified in 1.1 and 1.2

a) How is this to be priced? Per Task Order as a non-unit cost after scope of work determined by Task Order? Include justification for non-priced items?

Answer: Refer to the clause at 52.246-12 Inspection of Construction. You will have to price out each line item, for each roofing system.

3) 01010: General Requirements page 5 of 130 - 3.5 Assessment of work - Is assessment of work including the site visit and detailed scope of work preparation part of the task order proposal?

Answer: The site visit and assessment of proposed work are all a part of the Request For Proposal. In other words we will all visit the work site discuss the Scope of Work, then the Contractor will provide a Proposal.

4) Part 5.0 Applicable Drawings

a) What is the criteria for the sketches/shop drawings? ACAD drawings including the appropriate details per NRCA and Manufacturer?

Answer: All drawings are to be prepared in 2D CADD Format unless otherwise specified in the specific project delivery order. All Drawings (Submittals) shall either be hard copy or be 100% compatible with Autodesk Map 5 or later if electronic.

b) Will some of the Task orders be considered Design/Build due to the lack of drawings and professional design?

Answer: NO

5) Is a RCI - Registered Roofing Observer (RRO) required for inspections and testing, etc.?

Answer: No

6) Is a Roofing Consultant experienced in roofing design required for determining scope of work and details required?

Answer: No

a) Are CAD drawings required?

Answer: Yes, Autodesk Map 5 or later for submittals.

8) 3.0 Field Quality Control page 53 of 130 - Why is the QA/QC not required in other specification sections such as EPDM and Sheet Metal Roofing?

Answer: A QA/QC person is required on all Delivery Orders.

a) Research/Evaluation Reports - Should this be included within a design by a roofing consultant?

Answer: No, not required.

10) Section 07536 - Modified Bitumen Roofing

a) 1.4 B 2 page 69 of 130 - What are the qualifications for the appointment of a quality controller? Roof Consultant?

Answer: Refer to the clause at 52.246-12.

b) Quality Assurance page 70 of 130 - What is the criteria for the QA/QC for inspection of the construction?

Answer: Refer to the clause at 52.246-12.
