Contract Administration Labor checks by Contracting Interim Inspections by CE Daily Reports by the Contractor Payrolls and Invoices
Basis of Award Step 1:
CO shall announce bid opening time and publicly read aloud each bid received prior to the submission time.
Step 2:
All bids will be recorded in real time on an abstract of bids. Each offeror's proposed coefficients for the base period CLIN, four (4) option year CLINs, and six (6) month extension of services CLIN will be summated and averaged to determine the Total Evaluated Price. Rank bids from lowest to highest based on their Total Evaluated Price and announce the three (3) apparent low bidders to conclude the public bid opening.
Step 3:
Perform responsiveness review on all bids to assess compliance with the terms and conditions of the solicitation. Offerors determined nonresponsive with the terms and conditions of the solicitation may be eliminated from consideration for contract award.
Step 4:
Perform a price analysis evaluation on the proposed coefficients listed on the Coefficient Worksheet and details provided in the Coefficient Narrative submitted by three apparent low bidders to determine if the prices are reasonable and balanced in accordance with FAR 14.408-2. The price analysis techniques in FAR 15.404-1(b) may be used in the evaluation. For a price to be determined reasonable and balanced, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. If one or more of the three (3) apparent low bidders' prices are determined unreasonable or unbalanced, the Government will evaluate the next responsive bidder with the lowest Total Evaluated Price. Price analysis evaluations will continue until the Government identifies the three (3) lowest priced responsive offers with reasonable pricing.
Step 5:
Perform a responsibility determination on the three (3) lowest priced responsive and reasonably priced offers. In order to be determined responsible, an offeror must meet the following conditions:
Meet standards identified at FAR 9.104-1 Must have an active 8(a) status at the time of initial bid due date. Joint ventures must have an SBA approved Joint Venture Agreement or have submitted its Joint Venture Agreement to the SBA for approval prior to the initial bid due date.
Must possess an active California General Contractor's License, "Class A" or "Class B", or equivalent license from a state with a reciprocity agreement with State of California, registered in the prime contractor's name; or demonstrate a four-year history of experience in successfully completing multiple trade construction efforts. Multiple trade construction efforts are defined as projects which involve at least two separate and distinct construction trades including but not limited to carpentry, plumbing, electrical, mechanical, painting, pipe fitting, sheet metal, welding, roofing, site work, site utilities, excavation, concrete, masonry, pavement repair, asbestos abatement, lead paint removal, security hardware installation, or demolition.
Must provide evidence it is able to obtain a minimum single project bonding capacity of $5M and an aggregate bonding capacity of $25M from an approved surety listed in the Department of the Treasury Circular 570 or other security permitted by FAR Subpart 28.2, unless prohibited by law or regulation
Overall Bid Evaluation Offerors who are determined to be nonresponsible will be referred to the Small Business Administration (SBA) for a Certificate of Competency (COC). If a COC is denied by the SBA, the Government will resume price analysis as detailed in Step 4. Price analysis will continue until the Government identifies the three (3) lowest priced, responsive, reasonably priced, and responsible bidders.
Warnings Offerors are cautioned to thoroughly consider all potential costs, risks, economic trends and the proposal environment when developing proposed coefficients. Carefully consider consequences of a coefficient of less than 1.0000. Contract coefficients will remain fixed for the life of the resulting contract and no allowances will be made after award.
Line Item Quantities are vital, not only do they tell us how many widgets you are going to use, they are used, on occasion, to de-scope a project and are required to make an equitable resolution.
We will provide a Statement of Objectives, you will in turn provide a detailed Statement of Work in your own words telling us how you are going to complete a certain project.
On-Ramping The Government may choose at its sole discretion to On-Ramp any number of IDIQ contracts at any time during the term of the SABER IDIQ contract Purpose:
Ensure adequate number of awardees are available Replace poor performing awardees When Contracting Officer (CO) determines it is in the best interest of the Government
On-Ramping Method 1 On-Ramp Method 1 – Post IDIQ award to 3 lowest total evaluated priced awardees, Government will identify next 3 TBD IDIQ awardee(s) who will be notified of TBD/reserve on-ramp status.
TBD IDIQ awardee(s) must be active participant in the SBA’s 8(a) program to be eligible for on-ramping.
TBD IDIQ awardees will receive draft IDIQ with a TBD period of performance.
Government will conduct a responsibility determination annually and prior to on-ramping If responsible, Government will bilaterally modify the TBD effective date of the TBD awardee to activate it as of the modification date If the TBD IDIQ awardee is non-responsible, procedures for a Certificate of Competency and Determination of Responsibility will be pursued. TBD IDIQ awardee determined non-responsible may be terminated upon SBA concurrence If TBD IDIQ awardee does not accept the Government’s bilateral mod to make TBD IDIQ effective, they will be off-ramped and the next highest-rated TBD IDIQ awardee will be considered for on-ramping.
On-Ramping Method 1 On-Ramped IDIQ contracts will be made effective under the originally awarded SABER IDIQ terms and conditions. Relevant IDIQ modifications will be incorporated into on-ramp IDIQ.
Within 30 days of on-ramping, the Government will notify existing IDIQ awardees of any on-ramped contractors.
Newly on-ramped IDIQ awardees will immediately be able to compete for task orders (excluding the need to meet the minimum guaranteed amount).
Overall contract ceiling and length will not be extended for newly on-ramped effective IDIQ awardees
On-Ramping Method 2 If the Government runs out of TBD IDIQ awardees either due to non-responsible determinations, TBD IDIQ awardees not accepting the modification, or if the Government determines it to be in its best interest, the Government may resolicit the requirement by reopening competition to unsuccessful awardees, off-ramped contractors, and/or other interested parties.
This could happen at any time during the term of the SABER IDIQ contract to on-ramp new awardees utilizing the same evaluation criteria used in the initial SABER awards.
When re-competition to on-ramp a new contractor(s) is determined to be in the best interest of the Government, an advertisement on the System for Award Management (SAM) website. Current effective IDIQ awardees will not need to recompete.
On-Ramping Method 2 Within 30 days of on-ramping, the Government will notify all existing IDIQ awardees of any on-ramped contractor(s).
New SABER IDIQ awardee(s) will compete with the existing SABER IDIQ awardees for all task orders (excluding the need to meet the minimum guarantee amount).
The overall contract ceiling and length will not be extended for new on-ramp effective IDIQ awardees.
Off-Ramping The Government may, at its sole discretion, choose to off-ramp an IDIQ awardee at any time during the term of the SABER IDIQ to:
Replace IDIQ awardees with poor performance (i.e., late performance or being assessed liquidated damages on task orders, performance assessment ratings of Marginal or Unsatisfactory in CPARS, unresponsiveness to warranty work, failure to provide responsive customer service, unsafe site conditions, etc.), Replace IDIQ awardees within who to comply with SABER program requirements such as proposing on all fair opportunity proposal requests, or If the TBD IDIQ awardee does not accept the Government's bilateral modification action to make the IDIQ contract effective
The Government intends to review annually, at the anniversary date of the contract award, the overall performance of the effective IDIQ contract holders.
Following the review, the Government reserves the right to off-ramp contractors during the life of this IDIQ contract by using one (1) of the following approaches:
Termination in accordance with FAR Part 49, or By not exercising an option in accordance with FAR Part 17.
Effective IDIQ awardees being off-ramped where the Government decides not to exercise the option will be provided a 30-calendar day written notice of its intention to off-ramp.
From that day forward the effective IDIQ awardee will not be allowed to actively participate in upcoming task order proposal requests.
Off-ramped effective IDIQ awardees will, however, be required to complete all task orders awarded to them prior to the off-ramp determination date.
For TBD awardees, no written notice will be given
Minimum Guarantee Awardees will be issued a $2K task order after award of the IDIQ contract Task Order will require the contractor to attend a Pre-Performance Construction Meeting with 30 calendar days of IDIQ award Contractors may invoice for the $2K after the meeting
