SUMMARY OF CHANGES
Evaluation Factors for Award
The following clauses were modified:
52.212-2 - Evaluation-Commercial Products and Commercial Services. Nov 2021 hereby reads as follows:
Evaluation-Commercial Products and Commercial Services (Nov 2021)
(a) Basis for Award. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made on the basis of the Lowest Evaluated Price of Technically Acceptable quotes in accordance with FAR 13.106-2 to the Contractor who is determined to be responsible in accordance with FAR 9.103. The following factors shall be used to evaluate offers:
(i) Technical
(ii) Past Performance
(iii) Price
(b) Evaluation Methodology. After preliminary consideration of all proposals to determine responsiveness and responsibility, quotes will be evaluated from lowest to highest price before reviewing technical acceptability and then, if found technically acceptable, assessing past performance. If the lowest-priced quote is found technically acceptable and has acceptable past performance, award will then be made to that offeror and no other quotes will be evaluated for technical acceptability or past performance. If not, the next lowest will be evaluated in turn for technical acceptability and then past performance, so on until an offeror is found to be technically acceptable with an acceptable past performance rating. If after review of all quotes, no offeror is found to be rated both technically acceptable and acceptable for past performance, the Government reserves the right to cancel the solicitation in its entirety.
(c) Factors. The Government will evaluate the Offeror’s proposals using the following factors:
(i) Factor 1 – Technical Factor.
Technical shall be rated as acceptable or unacceptable. Technical acceptability will be established based on if the proposed narrative or plans satisfy the Government's minimum requirements as identified in the PWS.
Contractor’s proposal shall demonstrate an understanding of the Government’s requirements by including the following:
The Contractor shall submit their technical approach for the completion of this effort and statement acknowledging they have the technical capabilities to perform the requirements as stated in the Performance Work Statement.
The Technical Proposal should be specific and complete. Legibility, clarity, and coherence are very important.
Provide as specifically as possible the actual methodology you would use for accomplishing/satisfying the effort as outlined in the attached Performance Work Statement and demonstrate a thorough understanding of the work to be performed, including the following two (2) elements:.
a. Phase-In Plan: Submit a phase-in plan that complies with the PWS and demonstrates the contractor's approach for providing the resources necessary to ensure and maintain service quality levels and staffing levels as specified in the PWS. Provide startup methodology in logical sequence to ensure a smooth initial startup of the program; a timeline for completion; and identify any associated risks, issues and risk mitigation strategies.
FA461022Q00220001
b. Staffing Plan: Submit a staffing plan that complies with the PWS and demonstrates the contractor's approach for recruitment, training and placement to meet contract requirements, including key personnel. Provide methodology to manage and minimize impact of unexpected turnover (such as promotions, employees leaving the company, extended illnesses, or military duty, etc.) on contract performance; and ensure personnel coverage during absences (sick and personal leave of employees).
Address your technical solution for meeting or exceeding the government’s minimum performance or capability requirements. All the requirements specified in the solicitation are mandatory. By your proposal submission, you are representing that your firm will perform all the requirements specified in the solicitation. It is not necessary or desirable for you to tell us so in your proposal. Do not merely reiterate the objectives or reformulate the requirements specified in the solicitation.
Contractors will be evaluated as Acceptable or Unacceptable according to the following definitions:
Acceptable = The proposal clearly meets the minimum requirements of the solicitation.
Unacceptable = The proposal does not meet the minimum requirements of the solicitation.
(ii) Factor 2 - Past Performance.
Previous experience will be evaluated as “Acceptable or Non-Acceptable”. To be acceptable, offerors must provide information demonstrating they have successfully performed as prime contractor within the last five (5) years* on a least ONE (1) or as many as THREE (3) contracts with the same or similar scope of work as work identified in the PWS. This information shall be submitted through point of contact information (e.g. customer surveys, past performance questionnaire (Atch 4) replies, Contractor Performance Reporting System (CPARS) printouts, etc.). If using the past performance questionnaire (Atch 4), then no more than one questionnaire shall be submitted per contract. Additionally, past performance information shall be obtained by the Contract Specialist from any other sources available to the Government to include, but not limited to, PPIRS or other databases; interviews with Program Managers, Contracting Officers, and/or Contracting Officer Representatives.
*The (5) five years shall be calculated from the solicitation issue date.
**Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Past Performance Evaluation.
The past performance evaluation results are an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertains to the requirements outlined in the solicitation.
Past performance information will first be evaluated to determine if the effort meets the “Recency” requirement.
Recency, as it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency for this requirement is defined as experience within five (5) years of the solicitation posting date.
After determining Recency, Relevancy of the prior effort will be determined. Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance. Past Performance Relevancy Ratings are defined as follows:
Relevant = Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Not Relevant = Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
The final aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
Final Past Performance Determination. Once recency, relevancy, and overall performance have been reviewed, an overall acceptable or unacceptable rating will be assigned to each offeror based on the below definitions:
Acceptable = Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above.)
Unacceptable = Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
(iii) Factor 3 – Price:
ONLY bids that are evaluated as Technically Acceptable will be evaluated for Price. The price evaluated for this factor will be the sum of the base year and all five option years. Price will be evaluated for reasonableness in accordance with FAR 13.106-3.
(b) Clarifications and Discussions. The Government intends to make award based on the initial quote submissions without conducting clarifications or discussions, therefore, each offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to seek clarification on information or hold discussions if, during the evaluation, it is determined to be in the best interest of the Government. Discussions may be conducted with one, some, none or all offerors as the Government is not required to conduct discussions with any or all offerors responding to this solicitation.
(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
