52.212-2 Evaluation-Commercial Products and Commercial Services. Nov 2021

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Price: The quotations will be ranked according to their total evaluated price (TEP) as identified by contract line-item total pricing. The Government will evaluate offers for award purposes by adding the total price for all CLINs for the required period of performance.

The offeror's price quotation will be evaluated using one or more of the procedures and techniques defined in FAR 13.106-2 and FAR 13.106-3 in order to determine price reasonableness. For a price to be reasonable, it must represent a price that a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through competitive quotations as described in FAR 13.106-3. CLIN XX03 series will not be part of the overall price because this is government furnished and will be part of the future growth CLIN.

(2) Technical: The vendor will submit a plan addressing how they will meet the below criteria:

1. Shift schedule ensuring 24/7 manning with craft type to support 24hr, 365 day maintenance & operations. Per paragraph 1.2.2, 1.6, 4.1

2. Provide references for maintaining like equipment of the same age and total megawatt level facilities as per Paragraph 1.

-Cooper Bessemer model year 1970 -General Electric Alternating Current Generator Type ATI -Cummins Diesel Model year 2009 -GM Electro-Motive Model year 1995

3. Per paragraph 1 inclusive, provide work experience, certifications, training for personnel and corporate history for operating the following:

a. switch gears

b. transfer switches

c. generators

d. analog & digital types of power generation equipment and facilities

4. Provide a Standard Operating Procedure (SOP) for government ordered generator backup power outside of monthly tests such as DoD directed exercises and/or local Offutt AFB exercises per Paragraph 1.6

5. Provide work experience history showcasing capabilities for the following:

a. Operate a black start capable, synchronous transfer, multiple feeders, multiple generators, 10 Mega-Watt or a larger power plant.

b. Perform manual seamless parallel power transfers from commercial to generator, from generator to generator, and from generator to commercial.

c. Perform medium voltage distribution primary feeder and alternate feeder circuit operations

Quotes will be evaluated to be technically acceptable or not technically acceptable based on the evaluation factors listed above.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) Basis for Award. The Government will evaluate quotes in order starting at the lowest priced quote until three quotes are found to be technically acceptable, or until all quotes have been evaluated. If only one quote is received, award can be made if the Contracting Officer finds the quote to be technically acceptable and the price is found fair & reasonable in accordance with FAR 13. The Government intends to award the contract without discussions. If the Government decides to conduct discussions, all offerors will be notified as soon as possible.

Clarifications conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for a quote revision. The Government intends to award a contract without discussions (while keeping with FAR Part 12 and 13).
