1. The North American Industry Classification System Code (NAICS) for this opportunity is 238290 Other Building Equipment Contractors. Furthermore, Federal Acquisition Regulation (FAR)

52.219-14 Limitations on Subcontracting (JAN 2017) is included within the solicitation documents.

Therefore, certain rules apply specifically to acquisitions presumed to be above the Simplified

Additionally, it is commonplace and typical for vertical transportation equipment maintenance, repair, and inspection services to be performed by a union workforce.

does not have union personnel thus, the onsite daily labor for this contract would be performed entirely by our large business teaming partner. Subsequently, would the government consider providing a waiver for offerors to adhere to FAR 52.219-14?

Government Answer: The solicitation is for a service contract, which falls under 52.219-14(c)(1) requiring At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern. The government does not intend to issue a waiver to this subcontracting rule.

2. The solicitation does not contain a Contract Line Item Number (CLIN) to price any required approved overtime. Therefore, in order to provide the government the best pricing solution, would the government consider for offerors to present three (3) Time and Materials (T&M) overtime rates consisting of Monday – Friday, Saturday and Sunday, and holiday in order for contractors to invoice accordingly?

Government Answer: No. This full maintenance contract requires routine maintenance to keep passengers safe, all vte to operate in accordance with applicable codes, and to keep emergency calls to a minimum.

3. Recently, flooding appears to have occurred at multiple locations at Offutt AFB, NE. Can the government clarify any buildings that may have been impacted by such flooding corresponding to the Performance Work Statement (PWS) Appendix A: VTE Equipment Listing (Appendix A)? If any buildings represented within Appendix A have experienced flooding, can the government confirm that any work activities that Contractor’s would be required to perform, would be invoiced under CLIN 0002 titled “Over and above EST”?

Government Answer: It will be the Government’s decision whether or not to execute repairs under CLIN 0002. The amount of damage caused by flooding to any VTE has not been determined.

4. Pursuant to the opportunity Basis of Award, would the Government consider revising to Best Value Lowest Price Technically Acceptable?
