DIVISION l - GENERAL REQUIREMENTS
SECTION 01005
ADMINISTRATIVE PROVISIONS
1. DESCRIPTION OF WORK:
1.1. These specifications cover the drainage pumping station facility at up to six (6) Launch Facilities (LFs) A-11, F-07, M-08, N-04, N-06 & N-09.
Each drainage pumping station facility includes the precast housing unit complete with two pumps and all piping and the units electrically wired for operation; the drainage trough lining and cover and the 4-inch thick erosion control gravel surfacing on area back of the launching pad area that the pumping station serves. Project to be performed in strict accordance with these specifications and applicable drawings and subject to the terms and conditions of the contract.
1.1.1 The drawings attached to the specifications show the general arrangement and approximate dimensions at each site. THE CONTRACTOR SHALL BE
RESPONSIBLE FOR ACCURACY REQUIRED FOR THE PROPER ACCOMPLISHMENT OF THE WORK.
1.2 PRINCIPAL FEATURES: The work to be performed includes, but is not limited to, the following principle features:
1.2.1 Furnish and install to proper working condition two (2) sump pumps, floats, precast concrete manhole, trench lining, trench grating, heat tracing, SITE WORK, site grading and erosion control for up to six (6) LF’s.
This work is on a secure site which must remain in use during and after working hours, including weekends and holidays. All work shall be accomplished by contractor to make a working system. The work to be performed is in a restricted area. Therefore, the Contractor shall conform to all requirements of MAFB IDP 31 and AFI 31-101.
1.2.2 Work will be allowed on one site at a time, with that site being completed and a final inspection performed before work begins on the next. The work schedule will be submitted by the Contractor coordinating with the Contracting Officer to help maximize the efficiency of the Contractor’s schedule to the greatest extent possible. Wing operational requirements, both real and exercise, however, take precedence over the scheduling of this work.
The sites will be worked as determined by the Contracting Officer, without exception. The schedule, once established, shall be considered firm.
1.3 GOVERNMENT RESPONSIBILITIES IN THESE SPECIFICATIONS: The government shall accomplish or provide the following:
1.3.1 Permits to Construct and Notice to Proceed.
1.3.2 Government inspector/escort.

1.3.3 Contract specifications and drawings.
1.3.4 Signed and dated returned submittals.
1.3.5 Site and area access security.
1.3.6 Develop/process Entry Authorization List (EAL) for Contractor site access.
1.4 CONTRACTOR’S USE OF PREMISES: The Inter-Continental Ballistic Missile (ICBM) LF is under the control of and within the vicinity of the 91st Missile Wing, Minot Air Force Base, North Dakota. The LF is a secure installation. Specific security and access regulations apply. The general work areas are shown on the drawings. All work areas are within the secured areas and require a Government inspector/escort at all times, no exception.
1.4.1 Owner occupancy: The sites are operational facilities.
Adhere to all applicable United States Air Force (USAF) regulations and procedures regarding security, site access, inspection, and safety.
Continued functional use of the site by the USAF is required.
1.4.2 Construction Operations: USAF controls the site, the 25-foot perimeter area outside the security fence, and the access road easement.
1.4.2.1 Contractor vehicles and trailers shall be allowed to
park inside the security fence to deliver materials or equipment required to support the work under this contract. Vehicles and equipment trailers shall be allowed on site during work performance only and shall not remain parked inside the security fence overnight. Contractor vehicles and equipment will be placed so as not to interfere with gates, emergency escape routes, antennae and other above ground structures. Vehicles may be parked in the Air Force access area but any such parked vehicles must be clear of the boundary fence by a minimum of 25 feet and a minimum of 50 feet from the centerline of the access road. Privately owned vehicles are not allowed on the site. Vehicles that are needed to conduct the work must be registered to the company listed on the EAL.
1.4.2.2 The Contractor will be permitted to store
construction materials near the access road to the site in a location coordinated with the approval of the Government inspector/escort. The Contractor shall be responsible for arranging for storage of all other construction equipment and materials during the course of the project.
1.4.2.3 Once equipment and supplies are brought inside the
fence, Government inspector/escort personnel are required to accompany and advise Contractor personnel in placement and removal of such items. The Government shall not be responsible for loss of Contractor material, tools, or equipment.

1.4.2.4 The Contractor shall clean up the work area debris
and shall ensure the security of equipment, tools, and work/contract materials is accomplished or safely secured before the end of the workday.
1.4.3 SITE WORK SCHEDULE: Working hours for the Contractor will be five 8-hour days normally between the hours of 7:30 a.m. and 4:00 p.m., excluding Saturdays, Sundays, and the day’s federal holidays are observed.
Work can take place at only one site at a time, unless approved by a Missile Engineering Representative.
1.4.4 The Contractor shall, each afternoon, coordinate with Government escort/inspector, the proposed work and construction relative to the next day.
1.5 ENTRY, SITE AND SECURITY REGULATIONS
1.5.1 PROCESSING AN ENTRY AUTHORITY LIST (EAL) FOR USE ON MISSILE SITES.
Entry: In order to gain entry onto a facility, contractor personnel and mission essential contractor owned/leased vehicles must be listed on an Entry Authority List (EAL), identified by government inspector/escort personnel, and physically escorted on site by authorized government inspector/personnel.
1.5.1.1 Twenty (20) working days prior to the initial commencement of work, the contractor must submit to the Contracting Officer a summarized list of employees and vehicle information along with a legible photocopy of each employee's REAL ID Act approved picture identification (ID). These summarized lists and the legible photocopies of the Contractor’s employee's REAL ID Act approved picture IDs will be used to prepare the Contractor’s EAL referenced above. Foremen, supervisors, and superintendents must be identified as such on this Contractor's summarized list of employee information.
1.5.1.1.1 Each employee must have their identity proofed and
their access vetted through the National Crime Information Center database and the Security Forces Information Management System using their name, DOB, and SSAN. The employees DOBs and SSANs will only be used for this proofing and vetting process and are not used on the EAL used in the field for access.
1.5.1.2 The contractor’s summarized list of employee information must show each employee’s:
1) Full name exactly as it appears on the REAL ID Act approved picture identification (ID) submitted for used in conjunction with the contractor's
EAL.
2) Date of birth (DOB).
3) Full Social Security Account Number (SSAN).
4) The employee’s name and control number (exactly as it appears on the REAL ID Act approved picture ID) submitted for use in conjunction with the contractor's EAL.
5) Provide a legible copy of the individual's REAL ID Act approved picture ID. The following is guidance on the REAL ID Act approved picture IDs authorized for use:

1.5.1.2.1 Individuals, who do not possess a driver’s license or identification card compliant with the REAL ID Act and do not possess an acceptable alternate identification credential, must be escorted or denied access. For the current status on state and territories driver’s licenses and IDs that are approved, visit the Department of Homeland Security (DHS) website at the following location: < https://www.dhs.gov/current-status-states-territories >.
1.5.1.2.2 One form of the following documents below will be
accepted as proof of identity. The document must be a picture ID and all documents must be unexpired and valid. The goal is to minimize, within acceptable risk, the potential of improper screening and access credential issuance. NOTE: This information is from The Handbook for Employers, Instructions for Completing Form I-9 (Employment Eligibility Verification Form), U.S. Department of Homeland Security, U.S.
Citizenship and Immigration Services and REAL ID Act of 2005 Implementation: An Interagency Security Committee Guide:
- US Passport
- Permanent Resident Card/Alien Registration Receipt Card (Form I-551)
- Foreign passport with a temporary (I-551) stamp or temporary (I-551) printed notation on a machine readable immigrant visa
- Employment authorization document that contains a photograph (Form I-
766)
- Driver’s License that current and meets REAL ID Act it contains a photograph and biographic information such as name, date of birth, gender, height, weight, eye color, and address;
- Identification card issued by Federal, State, or local government agencies, provided it contains a photograph and biographic information such as name, date of birth, gender, height, eye color, and address.
- U.S. Coast Guard Merchant Mariner Cards/Credentials

1.5.1.3 The contractor’s summarized list of vehicle information must include:
1) Vehicle Make
2) Vehicle Model
3) Vehicle Year
4) Vehicle Primary Color
5) Vehicle License Plate # (State of Issue and Number). If no license plate, provide the vehicle identification number (VIN) or Serial Number.
6) Vehicles include: mission essential company owed/leased vehicles driven into restricted areas. Let us know if vehicles are owned/leased.
7) Mission essential equipment (skid-steers, bobcats, forklifts, loaders/backhoes, and any equipment being transported), trailers, and materials need not be listed individually on the EAL.
8) No privately owned vehicles (POVs) will be permitted on MAFs or LFs.
1.5.1.4 Upon arrival, the Government inspector/escort will
identify and search all Contractor personnel and vehicles. All Contractor personnel will provide the Government inspector/escort with two (2) forms of identification as listed above (one being photo) stating the employee’s full name and SSN. These two forms of identification shall be the same two forms of ID used to generate the EAL. The Contractor's vehicles will be checked and possibly searched prior to site entry. Contractor vehicles shall be clearly marked identifying each contracting firm.
1.5.1.5 If Contractor personnel are not listed on the EAL, or those who are listed cannot provide proper identification, they will not be permitted on the site. Delays caused by lack of proper EAL data or proper identification shall be at no cost to the Government.
1.5.1.6 Restricted Area. The work to be performed is in a
restricted area. Therefore, the Contractor shall conform to all requirements of MAFB IDP 31. Workers will be required to have an escort with them at all times. The Using Agency will provide an escort for the Contractor. The Contractor shall allow 60 minutes each day for personnel to process on and off the work site that will not be considered delay time. This hourly rate will also apply to Government-caused work stoppages when the entire work crew will be asked to evacuate the work area. All site access delays must be reported by the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence. All Government-caused work stoppages must be documented by Government personnel at the time of occurrence and reported by the Contractor, in writing, to the Contracting Officer within 48 hours of occurrence.
1.5.2 SECURITY: The Contractor shall:
1.5.2.1 Protect all Government property.
1.5.2.2 Comply with Base physical security regulations and
procedures.

1.5.2.3 The Government inspector/escort will be responsible
for on-site security.
1.5.2.3.1 While work is in progress, the Contractor
may be required to remove his personnel due to Alert status, real or exercise.
1.5.2.4 During all on-site work, the Contractor personnel
will be accompanied and continuously monitored by at least one (1) Government inspector/escort. Failure to remain within the area being monitored is a serious breach of security and safety regulations. The Contractor will take all necessary action to ensure compliance. The Contracting Officer reserves the right to deny entry to or take action with any Contractor personnel who refuses to conform to security and/or safety regulations. Delays resulting from such entry denial shall not result in any cost to the Government or schedule delay. Also, the Government can take any action necessary due to the security breach at no additional cost to the Government.
1.6 SAFETY:
1.6.1 The Contractor will comply with the most recent Occupational Safety and Health Administration (OSHA) regulations. OSHA Subpart 1926 and 1910 will be enforced.
1.6.2 The Contractor shall submit, within ten (10) working days prior to commencement of work, to the Contracting Officer, in writing, the name of the designated on-site person responsible for ensuring that all safety and accident prevention provisions of this specification are implemented and enforced. The Contractor shall ensure that all Contractor personnel receive safety training and briefings and that all safety inspections, practices, and procedures are complied with.
1.6.3 The Contractor shall indoctrinate each employee to ensure clear understanding of the following subject areas including, but not limited to:
1.6.3.1 The purpose of the accident prevention program (i.e., to minimize hazards and prevent injuries).
1.6.3.2 A review of the hazards inherent in the work
environment and the precautions to be taken.
1.6.3.3 Location of first aid and other emergency facilities.
(The Contractor shall maintain a complete first aid kit on site at all times).
1.6.3.4 A detailed description of what to do in case of
injury, fire, or identification of a safety hazard.

1.6.3.5 Required safety equipment and its location on site.
Safety equipment includes but is not limited to earplugs, goggles, face shields, safety harness/lanyards, protective clothing, and hard-hats. All personnel will wear safety equipment when required by the Contractor, Contracting Officer, or Government inspector/escort.
1.6.3.6 Review of daily cleanup procedures.
1.6.3.7 Location of company safety rules (posted or handout).
1.6.3.8 Identification of the Contractor employees
responsible for safety/accident prevention.
1.6.4 In addition to normal safety practices, the Contractor will comply with the following requirements:
1.6.4.1 The safety of Contractor personnel on-site is the
responsibility of the Contractor.
1.6.4.2 The Contractor and on-site superintendent shall
attend an Air Force safety briefing conducted at the pre-construction meeting and comply with all safety procedures.
1.6.4.3 All personnel shall comply with Air Force on-site
safety procedures and additional procedures as directed by the Contracting Officer or his designated representative when the Contractor's safety person is not immediately available.
1.6.4.4 Equipment shall be placed so as not to impede normal
traffic in and out of the work area, or to interfere with emergency exit from work area and off-site.
1.6.4.5 Emergency flashlights shall be provided by the
Contractor and shall be available in the crew's work area at all times.
1.6.4.6 All vehicles shall be in safe operating condition.
Vehicles and equipment not complying shall not be allowed on site.
1.6.5 A number of hazards inherent to the work environment must be recognized, including:
1.6.5.1 Electrical circuits and devices pose serious and
generally continuing hazards. The Contractor shall take every precaution to prevent personnel injury.
1.6.5.2 Mechanical devices (i.e., fans) can pose serious
hazards when operated. Appropriate precautions shall be taken.

1.6.6 First Aid and Medical Requirements:
1.6.6.1 The Contractor shall comply with Base accident
response requirements. These requirements are provided in a safety briefing by base personnel at the pre-construction conference. The Contractor shall keep these requirements on file at the working site for inspection by Air Force personnel.
1.6.6.2 The Contracting Officer or his designated
representative shall coordinate emergency medical, ambulance, or airlift requirements.
1.6.6.3 All accidents (employee injuries and vehicle, building, equipment or property damage, etc.), regardless of severity, shall be reported immediately to the Contracting Officer or his designated representative. The Contracting Officer will notify the proper authority per Air Force regulations.
1.6.6.4 Emergency Operations. The Contractor shall provide, within ten (10) working days after award, a list of key Contractor personnel and telephone numbers to the Contracting Officer to affect early notification of any emergency that arises (during non-working hours) due to an incident related to this contract. It is the responsibility of the Contractor to:
1.6.6.4.1 Notify the Government inspector/escort of
any emergency situation. The Government inspector/escort will follow local emergency procedures.
1.6.6.4.2 Ensure that all Contractor personnel are
evacuated from the site and accounted for.
1.6.6.4.3 Assist in administering first aid, as
required, and evacuate injured personnel.
1.6.6.4.4 Obtain emergency services as required.
1.6.6.4.5 Avoid movement of, and alterations to, any
possible evidence of the cause of an emergency, incident, or accident.
Removal of injured personnel or the need to prevent further damage takes precedence over this requirement.
1.6.7 SPECIAL SAFETY CONCERNS:
1.6.7.1 Fire Regulations. Compliance with local and Air
Force Fire Regulations is mandatory. Fire extinguishers rated and approved by the National Fire Protection Association and Base Fire Department of sufficient size, type, and quantity to cope with all known hazards will be available and provided by the Contractor.

1.7 OTHER CONTRACTOR REQUIREMENTS: In addition to those requirements outlined in this specification, the Contractor is responsible for the following:
1.7.1 The Contractor shall maintain, at each location, all Material Safety Data Sheets (SDSs) pertinent to hazardous material used in the project in compliance with OSHA's Hazardous Communications Standard 29 CFR 1910.1200.
SDSs will be available to all contractors and Government inspector/escort at all times during construction. SDSs data will be available on all hazardous material used in the contract, and all Contractor personnel will be made aware of the requirements.
1.7.2 The Contractor shall furnish and maintain, on site, the following:
1.7.2.1 Explosion proof flashlight and batteries (One (1) set per person).
1.7.2.2 Safety harness/lanyard, equipment lowering nets, and
hoist (as required).
1.7.2.3 Two (2) portable fire extinguishers rated at 2A 20 BC minimum.
1.7.2.4 One emergency first aid kit.
1.7.3 CONCEALED WORK: All items of work to be concealed shall be Government inspected prior to concealment.
1.7.4 CHAIN LINK SECURITY FENCE RECONSTRUCTION: If required to regrade the existing work area, the contractor shall remove existing posts and furnish and install longer posts and chain link fabric, animal barrier and barbed wire consistent with the existing installation. All costs will be incurred by the contractor.
1.8 AVAILABILITY OF UTILITY SERVICES: There are no utilities available on site. Contractor responsible for providing portable lavatory and potable water for Technical Representative and contractor personnel.
1.9 COORDINATION: The Contractor shall be responsible for coordinating his work so as to minimize interference. Extreme caution shall be exercised to prevent damage to the equipment. The Contractor, in a manner in accordance with Federal, State, and County rules and regulations, shall properly dispose of debris and salvage material off site.
1.9.1 Coordinate work of the various Sections of specifications to assure efficient and orderly sequence of installation of construction elements.

1.9.2 Verify characteristics of related operating responsibilities for installing, connecting to and placing in service, such equipment.
1.10 Organizational Structure: All key personnel (management and supervisors) specifically used for this project must have a minimum number of years identified as follows: Contract Manager (CM) 5 years of related experience; Quality Control Manager (QCM) 3 years; Site Safety and Health Officer (SSHO) 3 years, Project Superintendent (PS) 2 years. All key personnel need to be approved by the Government. Personnel approved with bid proposal do not require resubmittal. If changes are made Contractor needs to resubmit name changes of key personnel for approval with proper documentation of relevant work experience. Contractor key personnel must meet minimum years of related experience to be approved. Provide a work history with the following information to include but not limited to project title, scope of work, cost, duration, employer, and job title.
1.10.1 Personnel Qualifications
1.10.1.1 Site Safety and Health Officer (SSHO)
A Competent Person shall be provided for all of the hazards identified in the Contractor's Safety and Health Program in accordance with the accepted Accident Prevention Plan, and shall be on-site at all times when the work that presents the hazards associated with their professional expertise is being performed. Provide the credentials of the Competent Persons(s) to the Contracting Officer for acceptance in consultation with the Safety Office.
1.10.1.1.1 Contractor Quality Control (QC) Person:
The Contractor Quality Control Person can be the SSHO on this project.
1.10.1.1.2 Additional Site Safety and Health Officer
(SSHO) Requirements and Duties
The SSHO and Alternate SSHO must have the required training, experience, and qualifications in accordance with EM 385-1-1 Section 01.A.17, and all associated sub-paragraphs.
1.10.1.1.3 The Contractor Quality Control Personnel
The Contractor Quality Control (QC) person can be the SSHO on this project, although the QC has safety inspection responsibilities as part of the QC duties.
The Project Superintendent or other Contractor personnel may act on behalf of the SSHO and QC, provided that the individual meets the same competency level of the SSHOs and QCs.
1.10.2 Personnel Duties
1.10.2.1 Site Safety and Health Officer (SSHO)

The SSHO shall:
a. Conduct daily safety and health inspections and maintain a written log which includes area/operation inspected, date of inspection, identified hazards, recommended corrective actions, estimated and actual dates of corrections. Attach safety inspection logs to the Contractors' daily report.
b. Conduct mishap investigations and complete required reports. Maintain the OSHA Form 300 and Daily Production reports for prime and sub-contractors.
c. Maintain applicable safety reference material on the job site.
d. Attend the pre-construction conference, pre-work meetings including preparatory inspection meeting, and periodic in-progress meetings.
e. Maintain a safety and health deficiency tracking system that monitors outstanding deficiencies until resolution. Post a list of unresolved safety and health deficiencies on the safety bulletin board.
f. Ensure sub-contractor compliance with safety and health requirements.
g. Maintain a list of hazardous chemicals on site andtheir material safety data sheets.
Failure to perform the above duties will result in dismissal of the superintendent, QC Manager, and/or SSHO, and a project work stoppage. The project work stoppage will remain in effect pending approval of a suitable replacement.
1.10.3 QUALITY OF WORKMANSHIP: The various trades involved in performing the work in this project shall be competent and highly skilled in their particular trade. Only skilled craftsmen in the trades required for the job shall be performing the work. All work shall result in the highest standards of workmanship, safety and quality. The Contracting Officer may, in writing, require the Contractor to remove from the project any employee deemed incompetent, careless, or otherwise objectionable to personal safety, equipment, or the quality of workmanship. All electrical work shall be completed by a licensed journeyman electrician. One licensed apprentice is allowed for each licensed Journeyman or Master Electrician. See section 16010, paragraph 1.2.

1.11 AS-BUILT DRAWINGS: As-Built drawings shall be prepared and submitted to the Contracting Officer as indicated on the AF Form 66. As-built drawings reflect work performed by the Contractor that differs from the contract drawings. It is therefore the Contractor’s responsibility to maintain the drawings in the most current status.
1.11.1 The Contractor shall maintain a set of redlined full-size, as-built construction drawings marked-up to fully indicate as-built conditions. These drawings shall be maintained in a current condition at all times until completion of the work and shall be available for review by Government personnel at all times. The location as dimensioned from permanent features, general description, type of material, and approximate depth below finished grade of all new and existing exterior underground utilities encountered shall be indicated. All variations from the contract drawings for the required coordination between trades shall be indicated. These variations shall be shown in the same general detail utilized in the initial contract drawings. As-built construction drawings shall be furnished to the Contracting Officer for use during the final inspection.
1.12 SUBMITTALS: Submittals must be submitted by the Contractor within the number of days discussed at the pre-construction meeting. A list will be provided via an AF Form 66 according to Section 01300.
1.13 DAMAGE TO EQUIPMENT: Contractor shall notify the Government inspector/escort immediately if any damage occurs to equipment during construction operations. The Government inspector/escort on site will direct all emergency procedures and/or action required after damage to any equipment.
Damage to areas shall be repaired at the expense of the contractor by skilled craftsmen in the trade to the satisfaction of the Contracting Officer or his designated representative.
1.14 EXCAVATION PERMIT: A minimum of ten (10) working days prior to any excavation, an approved excavation permit shall be requested from base Missile Engineering by the Contractor. Base Civil Engineering personnel will provide to the Contractor all necessary record drawings to facilitate locating utility lines and underground structures. The Contractor shall be responsible for repair of underground items, at no cost to the government when damaged, only if those items are within ten (10) feet of where shown on the drawings or where indicated by markers.
1.15 EXCAVATION NEAR COMMUNICATION CABLES: Digging within ten (10) feet of communication cables shall be performed by hand until the cable is exposed.
A representative from the Base Communications Squadron must be present. The cable route must be marked by Air Force personnel prior to excavation in the area. The Contractor shall be held responsible for any damage to the cable by excavation procedures. Once the cable is exposed, mechanical excavation may be used if there is no chance of damage occurring to the cable.

1.16 NOTICE OF FINAL INSPECTION: The Contractor shall, after notifying the Government inspector/escort, schedule a date with the Contracting Officer for final inspection one (1) week prior to the Contractor's projected completion of the site. A final inspection shall not be held until all discrepancies found during any pre-final inspections have been corrected.
1.17 HAZARDOUS WASTE: Any hazardous waste/material used or generated by the Contractor shall become the property of the Contractor. The use, generation and disposal of all hazardous waste/material will be the responsibility of the Contractor and shall be handled in accordance with all Federal and State hazardous waste and toxic substances control regulations.
1.18 HAZARDOUS MATERIALS: Contractor shall submit prior to contract start Material Safety Data Sheets (SDSs) expected to be used during contract performance. Hazardous material shall be designed in the latest version of Federal Standard No. 313.
1.19 RECYCLING/REUSE OF EXCESS MATERIALS AND CONSTRUCTION AND DEMOLITION
(C&D) DEBRIS: The Contractor shall reuse/recycle excess materials and Construction and Demolition (C&D) debris to the maximum extent possible. C&D debris are those excess/residue materials resulting from construction or demolition activity that would normally be discarded to a landfill. C&D debris includes, but is not limited to soil, rock, vegetation, concrete, asphalt, and building materials such as windows, wood, metal, and roofing materials. The Contractor shall recycle C&D debris resulting from demolition, which shall become the property of the Contractor unless specified otherwise or as determined by the Contracting Officer.
1.19.1 Materials not to be returned to the Government and all Contractor-generated rubbish, if not recycled, shall be disposed of by the Contractor off site at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.
1.19.2 Reporting Tonnage of C&D Debris: Contractor shall track and report the tonnage of C&D Debris in two categories.
1.19.2.1 Tons of C&D that is or will be recycled or reused.
1.19.2.2 Tons of C&D that is disposed in a landfill.
1.19.3 The C&D recycled/disposed tonnage report shall consist of a written memo with the tonnage of each category(recycled and disposed tonnage) submitted to 5 CES/CEIE through the Contracting Offices. Submit C&D recycled and disposed tonnage report when the project is completed.
1.20 REFERENCE STANDARDS
1.20.1 For products specified by association or trade standards, comply with requirements of the standard.

1.20.2 The date of the standard is the latest in effect.
1.21 WINTER EXCLUSION
1.21.1 A winter exclusion period shall be applied to this project and shall be from 1 October through 30 April.

SUBMITTALS
1. GENERAL:
1.1 PROCEDURES:
1.1.1 The Contractor shall be required to submit items listed in the Submittal Schedule at the end of this section.
1.1.2 Transmit each item under AF 3000, Material Approval Submittal form. Identify contract number, project number, and Contractor. Identify section and paragraph reference for each item submitted with the AF 3000.
Submit three (3) copies unless otherwise required elsewhere in the specification.
1.1.3 Unless specifically stated otherwise elsewhere in this
specification, each submittal shall be approved by the Contracting Officer prior to incorporation of the submitted materials into the work.
1.1.4 Approvals of submittals that do not conform to the Contract shall not be construed as a change to the contract.
1.2 SUBMITTAL REGISTER: Submit submittal register to Government. Submit with QC plan and project schedule. Verify that all submittals required for project are listed on AF Form 66 and add missing submittals. Coordinate and complete the following fields on the submittal register to be submitted with the QC plan and the project schedule: Required Submission Date: Scheduled date for approving authority to receive submittals.
1.3 MANUFACTURER'S DATA AND SAMPLES: For the following types of submittals, when a specific product of a specific manufacturer is identified (by catalog or product number, pattern, or style) and the Contractor does not desire to propose an alternate product as an equal, where an equal is allowed, a detailed submittal will not be required. The Contractor shall submit on an AF Form 3000 a list of submittals for which the specified products will be used. Submit in accordance with procedures identified in 1.1 above.
1.3.1 Product Data: Submit complete manufacturer's literature that describes all salient characteristics identified as requirements in the specification. Literature that is not specific to the proposed product shall be marked to indicate clearly which item is being proposed for use in this contract.
1.3.2 Manufacturer's Certification: Submit a statement from the product manufacturer that proposed products meet the specified standards and other salient characteristics identified as requirements in the specification.
1.3.3 Installation Instructions: Submit manufacturer's printed instructions for delivery, storage, assembly, installation, start-up (if applicable) and adjustments. Information shall include temperature
01300-2 restrictions and any other environmental limitations as well as substrate preparation requirements if any exist.
1.3.4 Samples:
1.3.4.1 Submit full range of manufacturer's standard colors, textures and patterns for specified items for selection by the Contracting Officer.
1.3.4.2 Submit samples to illustrate performance and
functional characteristics of the product. Samples shall include integral parts, attachment devices and specified accessories. Provide full identification information on each sample.
1.4 SHOP DRAWINGS: Drawings shall illustrate how the specified materials are integrated into the work as a whole. Adjacent materials that affect the complete installation of the specified products shall be shown and identified.
Deviations from Contract drawings shall be clearly identified and reason for deviation clearly explained.
1.5 TEST DATA: Test results shall be dated and signed by the agency performing the test.
1.6 WARRANTY: Submit detailed warranty information that identifies specifically items covered as well as exclusions from the warranty and the warranty period. All copies shall be dated and signed by an authorized officer of the company. The officer's name and title shall be typed on the warranty adjacent to the signature.
1.7 OPERATION/MAINTENANCE INSTRUCTIONS: Submit manufacturer's published instructions.
1.8 MISCELLANEOUS SUBMITTALS: Submittals that are none of the above types shall meet the specific requirements identified in the referenced paragraph of the Specification Section identified in the schedule.
1.9 SUBMITTAL SCHEDULE: The following is a list of required submittals for this Contract.

DIVISION 1 - GENERAL REQUIREMENTS
SECTION 01431
ENVIRONMENTAL PROTECTION
1.1 The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants. Recycling of construction and demolition debris is required when economically advantageous.
1.2 IMPLEMENTATION: Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:
1.2.1 Detail their proposal for implementing the requirements for environmental pollution control specified herein. Submit in accordance with the submittal table.
1.3 SUBMITTALS: In accordance with Section 01300: Submittals, the Contractor shall submit the following.

2.2 PRECONSTRUCTION SURVEY: Prior to start of any on-site construction activities, the Contractor shall make a condition survey after which the Contractor shall record on a layout plan the condition of trees, shrubs and grassed areas immediately adjacent to the site of the work and adjacent to his assigned storage area and access route as applicable. Submit in accordance with the submittal table.
2.3 PERMITS AND FEES: No separate payment will be made for work covered under this section. The Contractor shall be responsible for payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor. All costs associated with this section shall be included in the contract price. The Contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations.
2.3.1 The Contractor shall be responsible for obtaining and complying with all environmental permits and commitments required by Federal, State, regional, and local environmental laws and regulations.
2.4 PROTECTION OF LAND AREAS: Except for work areas, storage areas, or access routes specifically assigned for the use of the Contractor under this
01431-3 contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition. The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.
2.5 PROTECTION OF TREES AND SHRUBS: Except for trees or shrubs marked on the plans to be removed, the Contractor shall not deface, injure or destroy trees or shrubs, nor remove or cut them without special authority. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorage.
2.5.1 Tree Protective Structures: Where, in the opinion of the Contracting Officer, trees may possibly be defaced, bruised, injured, or otherwise damaged by the Contractor's equipment or by his other operations, he may direct the Contractor to provide temporary protection of such trees by placing boards, planks, or poles around them.
2.5.2 Restoration of Damaged Trees: Any tree scarred or damaged by the Contractor's equipment or operations shall be restored as nearly as possible to its original condition at the Contractor's expense. All scars made on trees not designated on the plans to be removed by construction operations shall be coated as soon as possible with an approved tree wound dressing. Trees that are to remain, either within or outside established clearing limits, that are damaged by the Contractor so as to be beyond saving in the opinion of the Contracting Officer shall be immediately removed, if so directed, and replaced with a nursery-grown tree of the same species and size.
2.5.3 Herbicide: Herbicide use will be restricted to those areas directed to be sprayed by the Contracting Representative. Herbicide shall not be sprayed when wind speeds are greater than 10 mph or when there is likelihood of runoff due to rain. Herbicide shall contain a visible dye for tracking application area. Any application of herbicide at the Launch Facilities or Missile Alert Facilities must be applied by an applicator holding a ND Commercial Pesticide Applicators license. This license must include the category for Right-of-Way. Information on the Applicators license may be found at the NDSU Extension Service pesticide program website.
Contractor shall submit proof of certification, catalog data and SDS for any herbicide proposed prior to use on the site.
2.6 WATER RESOURCES AND STORM WATER DISCHARGE: The Contractor shall monitor construction activities to prevent pollution of surface and ground waters. Toxic or hazardous chemicals shall not be applied to soil or vegetation unless otherwise indicated. The Contractor shall monitor all water areas affected by construction activities.
2.6.1 NPDES Storm Water Program General Construction Permit
2.6.1.1 CONSTRUCTION ACTIVITY LESS THAN ONE ACRE:

2.6.1.1.1 For construction activity that disturbs less than
1 acre of land the Contractor shall implement Best Management Practices (BMPs) outlined in Section D, Erosion and Sediment Controls.
2.6.1.2 WETLANDS, EROSION AND SEDIMENT CONTROLS:
2.6.1.2.1 WETLANDS: The Contractor shall not enter, disturb, destroy, place fill into, or allow discharge of contaminants into any wetlands except as specifically authorized herein. The Contractor shall be responsible for the protection of wetlands on Minot AFB. Authorization to enter specific wetlands identified shall not relieve the Contractor from any obligation to protect other wetlands within, adjacent to, or in the vicinity of the construction site and associated boundaries. Maps showing locations of wetlands within Minot AFB can be obtained from 5 CES/CEIE.
2.6.1.2.2 The Contractor shall be responsible for providing
erosion and sediment control measures in accordance with Federal, State and local laws. This applies in all cases, even for construction activity that disturbs less than an acre of soil. The erosion and sediment controls selected and maintained by the Contractor shall be such that water quality standards are not violated as a result of the Contractor’s construction activities. The area of bare soil exposed at any one time by construction operations should be kept to a minimum. The Contractor shall construct or install temporary and permanent erosion and sediment control best management practices (BMPs). BMPs may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization, silt fences, construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. The Contractor’s best management practices shall also be in accordance with the Base National Pollutant Discharge Elimination System (NPDES) Storm Water Pollution Prevention Plan (SWPPP) which may be reviewed at the Minot AFB Environmental Management Office. Any temporary measures shall be removed after the area has been stabilized.
2.6.2 For discharge of ground water, the Contractor shall obtain a State permit specific for pumping and discharging ground water prior to surface discharging in accordance with the requirements of the State Storm Water Discharges From Construction Sites permit. Refer to the NDDH web site.
2.6.3 PROTECTION OF WATER RESOURCES: The Contractor shall control the disposal of fuels, oils, bitumen, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable federal, state, county and municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract.
Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.

2.6.3.1 DEWATERING OF GROUNDWATER: For temporary dewatering of groundwater encountered during construction, the Contractor shall land apply all water generated at the locations indicated on drawings in accordance with Paragraph: LAND APPLICATION.
2.6.3.1.1 LAND APPLICATION: Land application shall follow
state requirements; however, no permit will be necessary. "Land application" implies that the Contractor shall discharge water at a rate which allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, defined drainage areas, or discharge into the "waters of the State" shall occur.
