Evaluation Factors for Award

Miscellaneous text in this section has been modified to:

Evaluation Factors for Award

Addendum to FAR 52.212-2 - Evaluation-Commercial Items (Oct 2014)

(a) The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered.

The following factors shall be used to evaluate offers:

1. Technical

2. Price

3. Present/Past Performance

4. Small Business Participation

In the evaluation process, technical is evaluated on an acceptable/unacceptable basis and present/past performance is significantly more important than price.

(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the government to exercise the option(s). FAR 52.217-8, Option To Extend Services, is included in this solicitation and will be evaluated. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

Addendum to FAR 52.212-2

BASIS FOR CONTRACT AWARD. This is a competitive best value source selection in which competing offerors' present/past performance history will be evaluated on a basis significantly more important than price considerations. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. All technically acceptable offers will be considered equal. The tradeoff will occur only between the present/past performance factor and the price factor. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

A. Technical Acceptability. Initially, the government technical evaluation team shall evaluate all the technical proposals on an acceptable/unacceptable basis. If determined unacceptable in any one area, the overall technical rating shall be rated unacceptable. The proposals shall be evaluated against the following 3 subfactors:

Subfactor 1: Continuation of Essential Contractor Services Plan

Description: In accordance with DFARS 252.237-7024, "Notice of Continuation of Essential Contractor

Services," the offeror shall provide a Continuation of Essential Contract Services Plan which shall describe how it will continue to perform the essential contractor services of the PWS. The plan shall identify provisions made for the acquisition of essential personnel and resources, if necessary, for continuity of operations for up to 30 days or until normal operations can be resumed. In accordance with DFARS 252.237-7024, the contractor shall address in the plan at a minimum:

Measure of Merit: The requirement is met when the offeror's Continuation of Essential Contractor Services Plan addresses all the requirements of DFARS 252.237-7024, Notice of Continuation of Essential Contractor Services

Subfactor 2: Small Business Participation Plan

Description: If the offeror is other than a small business, the offeror shall submit a small business subcontracting plan in accordance with FAR 52-219-8, Utilization of Small Business Concerns and FAR 52.219-9, Alternate II, Small Business Subcontracting Plan. Small businesses are not required to submit a small business subcontracting plan.

DFARS 215.304(c) requires evaluation of small business participation of all offerors for source selection /award evaluation purposes. Small business subcontracting plan will be evaluated as a subfactor under the technical factor and assigned a rating of acceptable/unacceptable basis in accordance with the below requirements. The small business subcontracting plan is required from offerors at the time offers are due and is to specifically address:

(1) Names of subcontractors to be utilized and the products/services they are to provide.

(2) The extent of participation of each subcontractor in terms of the value of the total acquisition.

Measure of Merit: The requirement is met based on the extent that participation by SBs complies with the DOD, FY22 small business subcontracting goal of 32.25%.

DoD also has these goals for the following small business subcategories:

Small Disadvantaged Business (SDB): 3% Woman Owned Small Business (WOSB): 3% Service Disabled Veteran (SDV) Owned Small Business: 3% Historically Underutilized Business (HUB) Zone Small Business: 3%

A target rate of 32.25% of the total contract value shall be subcontracted to small business for this solicitation /resultant contract. Small business subcontracting plan shall be evaluated on an acceptable/unacceptable basis based upon this 32.25% target. The small business subcontracting plan shall also include positive percentage goals for each small business subcategory with an effort to reach the goals. If a small business subcategory does not meet the DoD goal, reasoning must be provided as to why one cannot be reached and what steps may be taken in the future to provide a positive goal.

Subfactor 3: Qualified Operator of Record and Alternate

Description: In accordance with N.J.A.C. 7:10A-1.1 and paragraph 4.2.1 of the PWS, the offeror must provide evidence of a qualified operator of record who possesses, at a minimum, valid (current) New Jersey State licenses S4 and C4. The contractor shall further provide an alternate licensed operator of record holding the same valid New Jersey State licenses to act in operator of record's absences.

Measure of Merit: The requirement is met when valid NJ State licenses S4 and C4 are submitted with the proposal for both the operator of record and his/her alternate.

B. Price Evaluation. Next, the government shall rank all technically acceptable offers by price, including any option prices if applicable. An offeror's proposed prices will be determined by multiplying the quantities identified in the pricing schedule by the proposed unit price for each Contract Line Item Number or Subcontract Line Item Number to confirm the extended amount for each. When applicable, the price evaluation adjustment for HUBZone small business concerns will be applied in accordance with FAR 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns, to arrive at an evaluated price. Offerors whose total evaluated price is unreasonable (in accordance with FAR 15.404 and FAR 31.201-3), unbalanced (in accordance with FAR 15.404-1), or unaffordable (not within any budgetary information included in the solicitation) may not be considered for award. For contract extensions in accordance with FAR 52.217-8, Option to Extend Services, the government will evaluate the price of any possible extension as described in FAR 52.217-9, Option to Extend the Term of the Contract, by dividing the total extended proposed price in the last option year by two. This amount will be added to the total price of the base and all options.

C. Performance Confidence Assessment. The contracting officer shall seek recent and relevant performance information on all offerors based on (1) the present/past efforts provided by the offeror and (2) data independently obtained from other government and commercial sources. Recency is defined as having performed, or currently performing, on contracts for Federal agencies and/or commercial customers within five years from the release date of this solicitation. Relevant present/past performance includes operating, maintaining and repairing and tertiary wastewater treatment facility similar or greater in scope, magnitude and complexity than the effort described in this solicitation. Aspects of relevancy include, but not limited to: system design; gallons of water per day; operator license type; 24/7 operations; and simultaneously operate, monitor, maintain and repair multiple facilities.

The purpose of the present/past performance evaluation is to allow the government to assess the offeror's probability of meeting the solicitation requirements based on the offeror's demonstrated present/past performance. The assessment process will result in an overall performance confidence assessment of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or Neutral Confidence as defined in DoD Source Selection Procedures, Table 5. Present/Past performance regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement will not be rated as highly as present/past performance information for the principal offeror.

Offerors with no recent/relevant performance history or if the offeror's performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned shall receive the rating "Neutral Confidence," meaning the rating is treated neither favorably nor unfavorably.

Table 5. Performance Confidence Assessments Rating Method

In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation. The government will use the following relevancy definitions as defined in DoD Source Selection Procedures, Table 4, Past Performance Relevancy Ratings, when assessing recent, relevant contracts.

Table 4. Past Performance Relevancy Ratings

D. If the lowest priced evaluated technically acceptable offer is judged to have a "Substantial Confidence" performance confidence assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

E. If the lowest priced technically acceptable offeror is not judged to have a "Substantial Confidence" performance confidence assessment, the next lowest priced technically acceptable offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have a "Substantial Confidence" performance assessment or until all offerors are evaluated. The source selection authority shall then make an integrated assessment best value award decision.

F. Offerors are cautioned to submit sufficient information and in the format specified in Addendum to 52.212-1, Instruction to Offerors. Offeror's may be asked to clarify certain aspects of their proposal (for example, the relevance of present/past performance information) or respond to adverse present/past performance information to which the offeror has not previously had an opportunity to respond. Adverse present/past performance is defined as present/past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without discussions nor the opportunity for proposal revision.

G. If, during the evaluation period, it is determined to be in the best interest of the government to hold discussions, offeror's responses to evaluation notices and the final proposal revision will be considered in making the source selection decision. If the offeror's proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the final proposal revision are subject to evaluation and may introduce risk that the offeror's proposal be determined unacceptable and ineligible for award.

H. The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.
