C-2 ORDERING PROCEDURES – ASPHALT PAVING AND CONCRETE
1. Ordering Procedures:
1.1 Task Order Request for Proposal (TORFP): As the need arises for performance under the terms of this contract, the CO or authorized representative will issue a TORFP providing Statement of Work, the proposed project requirements, and establish the date, time and location of the pre-proposal site visit. Pre- Proposal site visits are not mandatory, but highly recommended.
1.2 Task Order Proposals: In response to TORFPs, Contractors shall submit a Task Order Proposal that includes price proposals, consisting of completing the Government provided Price Schedule. In addition, as requested provide a Schedule of Values that follows Construction Specifications Institute format breakdown by the applicable
Division(s) that supports the Price Schedule. In general, this will portray how the Contractor divides the pricing for the major segments of work among the Divisions and its Sub- Contractors used on the particular TORFP. The purpose of this Schedule of Values is to allocate, to each major segment of work, its share of the total cost of construction.
These willbe lump sum prices, not by quantity or unit, including Contractor’s Overhead and Profit. These lump sum costs shall also include applicable delivery, taxes, insurance, equipment rentals, and similar costs. This Schedule of
Values is for the Government’s information only.
1.3 Site Visits, Questions and Proposal Due Dates: Each TORFP will include specifics concerning on site visit dates, questions due dates and proposal due dates.
1.4 ASPHALT PAVING AND CONCRETE WORK: Work under the Asphalt Paving and Concrete contract will be ordered by written TO issued on a DD Form 1155 (Order for Supplies or Services) to the Contractor by the CO.
The individual TOs will be placed in a sequential numbering system, which relate back to the Contractor’s basic
Asphalt Paving and Concrete contract. The Government will not be obligated to reimburse the Contractor for work performed, items delivered, or any costs incurred, nor shall the Contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by duly executed TOs.
1.5 TASK ORDER’s: TOs will be firm fixed price and clearly define the specific services to be performed or the performance desired. Each TO is subject to the terms and conditions of the Asphalt Paving and Concrete contract. In the event of a conflict between the TO and the Asphalt Paving and Concrete contract the contract shall take precedence.
1.6 COST PROPOSALS FOR TORFPS: TORFPS will include a bid schedule and a construction cost estimate breakdown on an AF Form 3052. The bid schedule line items to be used will be provided, to the Contractor, by the
Government. The construction cost estimate categories for the AF Form 3052 shall match the Construction
Specification Institute fifty (50) divisions as required.
1.7 COMPETITION: Fair Opportunity to compete for TOs shall be provided in accordance with FAR 16.505
Ordering. TORFPs shall be provided to all Asphalt Paving and Concrete Contractors. Any offers received shall be given fair consideration for award. Upon receipt of a project, Contractors shall be encouraged to participate in site visits and submit proposals. Failures by offerors to participate responsibly in site visits and submit proposals may result in the Government not exercising the option to extend the contract or exclusion of the Contractor from further competition.
1.8 PROPOSAL EVALUATION CRITERIA: Proposals received in response to a TORFP will be evaluated based on compliance with the TORFP requirements and the proposed price utilizing LPTA criteria. The TORFP will indicate the minimum requirements which must be met in order for a proposal to be considered technically acceptable. The
Government may issue Task Orders, in which evaluation factors will vary depending on the unique requirements of that specific Task Order. Any proposal which does not address all requirements set forth in the TORFP will be determined to be technically unacceptable. If required, the government reserves the right to enter into discussions
1.8 COMMENCEMENT OF WORK: No work under this contract shall commence until such a time as the CO issues a written TO and a Notice to Proceed (NTP) under the TO. The CO reserves the right to determine the issue date of any NTP.
1.9 TASK ORDER PERFORMANCE PERIOD: FAR 52.211-10, Commencement, Prosecution, and Completion of
Work shall be incorporated into each TO identifying the construction schedule. The Government reserves the right to negotiate a performance period or impose a performance period for each TO.
1.10 PERFORMANCE EVALUATIONS: At the conclusion of each ordering period, the COTR shall complete a
Contractor performance evaluation and input into Contractor Performance Assessment Reporting System (CPARS).
The evaluations will take into account all aspects of the Contractor’s performance on all issued TOs. Furthermore, performance evaluations may be completed at any time the Contractor’s performance is considered less than satisfactory. Contractors will be provided an opportunity to provide input into the evaluation. The performance evaluations may have an impact on the award of future TOs
1.11 SOLICITATIONS WHEN FUNDS ARE NOT CERTIFIED: Occasionally the Government will solicit offers for projects for which funds are not certified nor readily available. Submission of proposals for these acquisitions is at the sole discretion of the respective Asphalt Paving and Concrete awardees and their declination to participate in any or all such solicitations will not reflect negatively upon them. Contractors submitting a proposal/bid under this type of solicitation must provide an acceptance period as indicated in the solicitation that will allow award of the TO as late as the end of the fiscal year. If the project is awarded prior to expiration of the acceptance period, the Contractor will be issued a TO to perform the design work and accomplish the construction. If funding to award is not made available prior to the end of the fiscal year the solicitation will be cancelled and no award will be made.
