EVALUATION FACTORS FOR AWARD
(a) General This section describes the evaluation factors and significant subfactors that the Government will use to evaluate proposals and determine which offer represents the best value to the Government. The Government intends to award a contract to the responsible offeror whose proposal conforms to the solicitation and represents the best value, considering the evaluation factors described below. The relative importance of each factor is described below.
(b) Evaluation Factors The following factors will be used to evaluate proposals:
• Factor 1: Price
• Factor 2: Technical
(c) Factor 1: Price
• Importance: Price is the most important factor.
• Evaluation Approach: The Government will evaluate price to determine whether it is fair, reasonable, and realistic. The Government may use various price analysis techniques, including but not limited to, comparison to independent government estimates, comparison to other offers received, comparison to historical prices paid for similar items or services, and/or analysis of the offeror's proposed cost elements. Unreasonably high or unrealistically low prices may be indicative of a lack of understanding of the requirements and may be grounds for rejection of the proposal. The government may adjust prices for evaluation purposes to correct mathematical errors, or to reflect the government's best estimate of the likely cost of performance.
(d) Factor 2: Technical
• Importance: Technical is secondary in importance to Price.
• Subfactors: The following subfactors will be used to evaluate the Technical Factor. The subfactors are listed in descending order of importance within the Technical Factor itself (meaning Subfactor 1 is the most important of the Technical Subfactors).
o Subfactor 1: Understanding of Requirements o Subfactor 2: Proposed Approach o Subfactor 3: Key Personnel Qualifications
• Evaluation Approach: The Government will evaluate the offeror's technical proposal to determine the degree to which it demonstrates a clear understanding of the requirements, the feasibility and effectiveness of the proposed approach, and the offeror's ability to successfully perform the contract. The Government will assess the strengths, weaknesses, and risks associated with each offeror's technical proposal. Proposals will be evaluated against the requirements outlined in Section C, Statement of Work/Specifications.
(e) Trade-Off Process The Government will perform a trade-off analysis to determine the best value to the Government.
While price is the most important factor, the Government will consider the Technical factor in the evaluation and award decision. The Government may award to other than the lowest priced offeror if the perceived benefits of a higher-priced, technically superior proposal are determined to be worth the additional cost to the Government.
• Trade-off Methodology: The Government will first evaluate all proposals to determine if they are acceptable. Acceptable proposals will then be ranked based on price, from lowest to highest. The Government will then evaluate the technical proposals of the lowest priced offerors. If the lowest priced offeror’s technical proposal is deemed acceptable and represents an acceptable level of technical competence, an award will be made to that offeror.
• Consideration of Technical Merit at Higher Prices: If the lowest priced offeror's technical proposal is deemed less than acceptable, or if the Government believes that a higher-priced offeror offers significantly better technical capabilities that are worth the price premium, the Government will then evaluate the technical proposals of the next lowest priced offerors. The Government will continue this process until it identifies a proposal that represents the best value to the Government, considering the relative importance of price and technical factors. The determination of "best value" will involve a subjective assessment of the relative merits of competing proposals, weighing the benefits of technical superiority against the cost premium.
• Documentation: The rationale for any trade-off decision will be documented in the source selection documentation. This documentation will clearly articulate the benefits of the selected proposal and the reasons why those benefits are worth the additional cost, if any, compared to lower-priced proposals.
(f) Basis for Award Award will be made to the responsible offeror whose proposal represents the best value to the Government, price and other factors considered, in accordance with the trade-off process described above. The Government reserves the right to award to other than the lowest-priced offeror if it is determined that a higher-rated technical proposal offers benefits that are worth the additional cost.
9. The provision FAR 52.212-3 Offeror Representations and Certifications - Commercial Products and Commercial Services (May 2024) and Alternate I (Feb 2024), applies to this acquisition.
Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items (Feb 2024), Alternate I (Feb 2024), with their offer, or the offeror shall complete paragraph (b) of FAR 52.212-3, if the offeror has completed the annual representations and certifications electronically at http://www.sam.gov.
