About this file
This document is a Federal Acquisition Regulation (FAR) clause 52.212-2 with an addendum that establishes evaluation criteria for commercial products and services solicitations.
The evaluation methodology employs a best-value approach with two primary factors: Price and Technical Acceptability. Award will be made to the responsible offeror whose conforming offer provides the best value to the Government, with the Government reserving the right to select other than the lowest-priced quote for higher quality items. Technical submissions must be completed as a secondary document and evaluated against requirements specified in Attachment 1 – Statement of Need. Quotes receive a binary rating of either "Acceptable" (clearly meets minimum solicitation requirements) or "Unacceptable" (does not clearly meet minimum requirements). Offerors must provide clear, concise technical information with sufficient detail to substantiate stated claims, assuming the Government has no prior knowledge of the offeror's experience. The Government bases its evaluation solely on information presented in the offer. Vendors accepting the solicitation implicitly accept all technical requirements, terms, and conditions, and non-conforming quotes may be deemed unawardable without further evaluation. The provision applies Deviation 2026-O0038 and became effective in February 2026.

(Deviation 2026-O0038)
As prescribed in 12.205(a)(2), insert a provision substantially as follows:
Evaluation—Commercial Products and Commercial Services (Feb 2026)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
• Price
• Technical Acceptability
(End of provision)
ADDENDUM TO RFO 52.212-2:
Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price. By submission of its quote, the vendor accepts all solicitation requirements, including all technical requirements and terms and conditions. Failure to conform to solicitation requirements may result in a quote being determined not awardable without further evaluation. The evaluation criteria are detailed below:
Factor 1 – Price. The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to award to other than the low quote for a higher quality item.
Factor 2 – Technical. The purpose of the technical factor is to assess whether the vendor’s quoted item meets all of the provided information from the Statement of Need Attachment.
Each vendor’s quote will be evaluated against technical requirements and will be assigned a rating of “acceptable” or “unacceptable.” Technical submission must be completed using a secondary document. The Technical information shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims.
Proposals shall provide convincing rationale addressing how the technical portion of the offer meets solicitation requirements. Offerors shall assume the Government has no prior knowledge of the offeror’s experience. The Government will base its evaluation on the information presented in the offer.
Rating Description:
“Acceptable” - Quote clearly meets the minimum requirements of the solicitation.
“Unacceptable” - Quote does not clearly meet the minimum requirements of the solicitation.
The quote will be determined technically acceptable if it meets the requirements set out in Attachment 1 – Statement of Need.
