FAR 52.212-2 -- Evaluation -- Commercial Products and Commercial Services (NOV 2021)
Addendum to 52.212-2 – Evaluation – Commercial Products and Commercial Services (NOV 2021)
EVALUATION FACTORS FOR AWARD The Government will award a contract resulting from this solicitation based on the determination of price reasonableness. The price fair and reasonable evaluation approach will be used to compare the offeror's quote to prices found reasonable on previous purchases, similar items in a related industry, an independent Government estimate, and market research in accordance with FAR 13.106-3(a). The submitted quote will be verified to ensure that the proposed prices are proportionate to the performance objectives.
Not all offers will be evaluated for technical acceptability. The lowest price offeror will be evaluated, if the lowest price offer is technically acceptable, no other offers will be evaluated. If the lowest price offer is not technically acceptable, the next lowest price offer will be evaluated. This process will occur until an offer is found to be technically acceptable. Once an offer is found to be technically acceptable, the other higher priced offers will not be evaluated.
PRICE EVALUATION
1.Total Evaluated Price (TEP) will be calculated as follows:
a. TEP = Base Period (CLINs 0001- 0004) + Option Period 1 (CLINs 1001- 1004) + Option Period 2 (CLINs 2001- 2004) + Option Period 3 (CLINs 3001- 3004) + Option Period 4(CLINs 4001- 4004) + Option to Extend Services IAW FAR 52.217-8.
b. Quantities identified will be multiplied by the unit price to confirm the extended price and then the extended price for all CLINs will be added together for a total for that specific period.
c. Unit prices shall be used in the event that extended prices are calculated incorrectly.
d. It is important for the offeror to verify the extended pricing is accurate and to have complete unit prices and exact total amounts.
e. Prices shall be rounded off to two decimal points.
2.Total price will be calculated by totaling all CLINs inclusive of all option periods and the option to extend services IAW FAR 52.217-8. FAR 52.217-8 will be included in the price evaluation by adding 50% of the value of each CLIN in option period four to the total price. This amount is for evaluation purposes only and will not be included in the awarded contract value.
If the Government exercises FAR 52.217-8, the extension will not exceed six months total and CLINs will be added to the contract at the time FAR 52.217-8 is exercised at a monthly price equal to the preceding period of performance's monthly price in accordance with FAR 52.217-8.
3.Prices will be evaluated for completeness, fair and reasonableness, and unbalanced pricing.
a. Completeness: The Government will review pricing submissions for completeness and compliance with the solicitation.
b. Reasonableness: The Government may use various methods established in FAR 13.106-3(a) to determine that the proposed price is fair and reasonable. This evaluation will compare the proposed price with prices found reasonable on previous purchases, similar items in a related industry, an independent Government estimate, and market research to determine price reasonableness.
c. Unbalanced Pricing: The Government will analyze the offeror’s pricing to determine whether it is unbalanced on different CLINs for similar services and quantities. The offer may be rejected if the contracting officer determines that the prices are significantly unbalanced or if the unbalanced pricing poses an unacceptable risk to the Government.
d. If the Government cannot determine whether the proposed pricing to be fair and reasonable, other than certified cost and pricing data will be evaluated.
