1.0 INTRODUCTION

1.1 The purpose of this project is to repair by replacement portions of the existing Airfield Perimeter Fence, referred to as "Deer Fence" in the south area of the airfield at Laughlin Air Force Base (LAFB). The existing fence is comprised of wooden and metal posts with areas having metal hog wire, chain link fencing fabric and barbed wire. The total length of the fence is approximately 7,250 linear feet with one swale feature, three (3) existing gates for vehicle access and three (3) existing gates for pedestrian access. The intention of this fence is to prohibit deer, rabbits, hogs, and other animals from accessing the airfield pavements. In its current state, the fence does not reduce the airfield incursions by terrestrial wildlife.

1.2 Within the below documents, the following shall be consistent. When "the Government" is mentioned, it is a representation of, but is not limited to, the following: the Project Manager (PM), the inspector, the Contract Specialist (CS) and the Contracting Officer (CO). When "the Contractor" is mentioned, it is a representation of: the prime Contractor, all sub-Contractors, and all other parties working with/for the prime Contractor.

2.0 DESCRIPTION OF WORK

2.1 The work under this contract shall consist of furnishing all labor, materials, tools, equipment, transportation, and all other incidentals necessary to complete the work outlined within this SOW and drawings.

2.2 Proper airfield fencing reduces airfield incursions by terrestrial wildlife. The best procedure for keeping large mammals off the airfield is an adequate fence. An 8-foot chain link fence with one foot high 3-strand barbed outriggers and secured at the ground will keep most mammals off the airfield. A 4-foot skirt of chain link fence material, attached to the bottom of the fence and buried at a 45 degree angle on the outside of the fence will prevent animals from digging underneath, while reducing washouts. Rebar offers a cost-effective solution when patching gaps under a fence to prevent wildlife from entering the airfield. Heavy gravel may be used to armor fence bottoms. Repair fence breaches upon detection.

2.3 The work shall consist of, but is not limited to, demolition of fence as identified, removal of existing fence posts as identified in Attachment I, Drawings, provide a shop level design for the project, install new gates as identified, install speed bumps under gates identified, install cast on site reinforced cellular paving in areas indicated, and install the new fence no less than 9 feet 0 inches in total height as outlined in Attachment I, Drawings. Contractor shall provide submittals as outlined in Attachment F, Schedule of Material Submittals for Government approval. Contractor is also responsible for the preparation of grounds and installation of speed bumps under the existing gates as identified in this SOW and Attachment I, Drawings. The Contractor shall provide all other incidental work that is required for project completion.

2.4 During construction, openings in the fence cannot be left unattended. For all portions of the project the Contractor shall provide temporary fencing that will deter terrestrial wildlife until the new fence has been installed and approved by the CO.

2.5 The Contractor shall be responsible to contact LAFB United States Department of Agriculture (USDA) representative and Wing Safety to report terrestrial critters trespassing onto the airfield through sections of the fence under construction by the Contractor. USDA telephone number is (830) 238-2362 and the Wing Safety telephone number is (830) 298-5975.

2.6 All Government provided figures and drawings are considered approximations and the Contractor shall be required to verify all measurements before material is purchased.

2.7 The Contractor shall provide Concrete Mix Design Data, Concrete Mix Design Test Report, Concrete Compressive Strength Test Report, Concrete Slump Test Report, Concrete Water Test Report, Testing Laboratory Accreditation per concrete truck, and electrical license for electrician.

2.8 Utilities lie in the path of the fence line. Contractor shall be responsible for coordinating utility locations before commencing construction.

Existing utilities map will be provided upon request from Contractor to CO.

2.9 Contractor shall remove and dispose a total five stumps and one tree. Tree removal shall include removal of tree in its entirety. Contractor shall remove tree stump from ground or stump grind 24 inches below elevation of proposed on-site reinforced cellular paving.

2.10 Contractor shall not execute work within the training area while occupied by Fire and/or Security Forces training events. CO shall notify Contractor 24 hours in advance regarding training events.

2.11 This scope of work is not part of the mandatory Frangible Zone (MFZ). Requirements cited in UFC 3-260-01 Airfield and Heliport Planning and Design.

2.12 The Contractor shall leave soil disturbed in the south end of the fence area on site. Contractor shall be responsible for leveling soil on site and removal all rocks larger than 2".

2.13 The Contractor shall be disturbing more than 1 acre which requires them to file a Stormwater Construction General Permit and a Stormwater Pollution Prevention Plan (SWPPP). Contractor shall include the laydown yard in disturbed area calculation.

TRANSPORTATION OF SUPPLIES BY SEA-BASIC (FEB 2019)

(a) As used in this clause- Definitions.

"Components" means articles, materials, and supplies incorporated directly into end products at any level of manufacture, fabrication, or assembly by the Contractor or any subcontractor.

"Foreign-flag vessel" means any vessel that is not a U.S.-flag vessel.

"Ocean transportation" means any transportation aboard a ship, vessel, boat, barge, or ferry through international waters.

"Subcontractor" means a supplier, materialman, distributor, or vendor at any level below the prime contractor whose contractual obligation to perform results from, or is conditioned upon, award of the prime contract and who is performing any part of the work or other requirement of the prime contract.

"Supplies" means all property, except land and interests in land, that is clearly identifiable for eventual use by or owned by the DoD at the time of transportation by sea.

(i) An item is clearly identifiable for eventual use by the DoD if, for example, the contract documentation contains a reference to a DoD contract number or a military destination.

(ii) "Supplies" includes (but is not limited to) public works; buildings and facilities; ships; floating equipment and vessels of every character, type, and description, with parts, subassemblies, accessories, and equipment; machine tools; material; equipment; stores of all kinds; end items; construction materials; and components of the foregoing.

"U.S.-flag vessel" means a vessel of the United States or belonging to the United States, including any vessel registered or having national status under the laws of the United States.

(b)(1) The Contractor shall use U.S.-flag vessels when transporting any supplies by sea under this contract.

(2) A subcontractor transporting supplies by sea under this contract shall use U.S.-flag vessels if-

(i) This contract is a construction contract; or

(ii) The supplies being transported are-

(A) Noncommercial items; or

(B) Commercial items that-

(1) The Contractor is reselling or distributing to the Government without adding value (generally, the Contractor does not add value to items that it subcontracts for f.o.b. destination shipment);

(2) Are shipped in direct support of U.S. military contingency operations, exercises, or forces deployed in humanitarian or peacekeeping operations; or

(3) Are commissary or exchange cargoes transported outside of the Defense Transportation System in accordance with 10 U.S.

C. 2643.

The Contracting Officer will process requests submitted after such date(s) as expeditiously as possible, but the Contracting Officer's failure to grant approvals to meet the shipper's sailing date will not of itself constitute a compensable delay under this or any other clause of this contract. Requests shall contain at a minimum-

(1) Type, weight, and cube of cargo;

(2) Required shipping date;

(3) Special handling and discharge requirements;

(4) Loading and discharge points;

(1) No ocean transportation was used in the performance of this contract;

(2) Ocean transportation was used and only U.S.-flag vessels were used for all ocean shipments under the contract;

(3) Ocean transportation was used, and the Contractor had the written consent of the Contracting Officer for all foreign-flag ocean transportation; or

(4) Ocean transportation was used and some or all of the shipments were made on foreign-flag vessels without the written consent of the Contracting Officer. The Contractor shall describe these shipments in the following format:

ITEM DESCRIPTION CONTRACT LINE ITEMS QUANTITY

TOTAL ____ ____ ____

(g) If this contract exceeds the simplified acquisition threshold and the final invoice does not include the required representation, the Government will reject and return it to the Contractor as an improper invoice for the purposes of the Prompt Payment clause of this contract. In the event there has been unauthorized use of foreign-flag vessels in the performance of this contract, the Contracting Officer is entitled to equitably adjust the contract, based on the unauthorized use.

(h) If the Contractor indicated in response to the solicitation provision, Representation of Extent of Transportation by Sea, that it did not anticipate transporting by sea any supplies; however, after the award of this contract, the Contractor learns that supplies will be transported by sea, the Contractor shall-

(1) Notify the Contracting Officer of that fact; and

(2) Comply with all the terms and conditions of this clause.

(i) In the award of subcontracts, for the types of supplies described in paragraph (b)(2) of this clause, including subcontracts for commercial items, the Contractor shall flow down the requirements of this clause as follows:

(1) The Contractor shall insert the substance of this clause, including this paragraph (i), in subcontracts that exceed the simplified acquisition threshold in part 2 of the Federal Acquisition Regulation.

(2) The Contractor shall insert the substance of paragraphs (a) through (e) of this clause, and this paragraph (i), in subcontracts that are at or below the simplified acquisition threshold in part 2 of the Federal Acquisition Regulation.
