(a) Bare Cost Total in the current year’s R.S. Means Facilities Construction Cost Data book, and secondary (electrical, plumbing, and mechanical) pricing books published by R.S. Means, Inc and the current year’s CMS ProEst Estimating software (electronic format) shall be referred to as the Unit Price Book (UPB). Note that only R.S. Means Facilities Construction Cost Data will be provided in the CMS ProEst Estimating software. Additionally, the Bare Costs listed in the various R.S Means Data books listed above will not be localized.
(b) In order to be considered for award, the offeror must submit coefficients for all contract line items identified in the Schedule B, The coefficient is the price multiplier that the Contractor offers. The Government uses this multiplier to determine the price of work for each task on individual Task Orders. Bare Cost (material, equipment, and labor without any markups for subcontractor, sales tax, overhead, or profit), multiplied by the coefficient to arrive at the actual price for a unit of work. The coefficient shall be represented as net, decrease from, or an increase to, the prices listed in the UPB. An offer of net would be represented as 1.00. An example of a decrease from the prices in the UPB would be 0.98. An example of an increase from the prices in the UPB would be 1.06.
(c) PRICING COEFFICIENTS: The purpose of applying the coefficients to direct prepriced costs from the UPB is to compensate the contractor for his burden costs and profit for performance. The Offeror’s coefficient must be sufficient to cover all costs including but not limited to all costs listed in R.S. Means costs data books listed in paragraph (a), above, general & administrative expense; overhead; profit; project direct costs; bond premiums; licenses; certification; protection or moving of Government property; mobilization and demobilization expense; engineering/technical design support services; daily cleanup; payroll taxes (FICA, state and Federal unemployment taxes, employee training taxes, etc.); gross receipts tax; general conditions (superintendent salaries, builder’s risk insurance, etc.); site and home office overhead; wage determination differential; special clothing or equipment for workers; all insurance for all employees; portable toilets; flag persons; safety equipment; additional supervision; paperwork/reports associated with the contract; consultant fees; on and off site storage; and all contingencies, as well as costs associated with compliance with environmental, labor and tax laws and all other contract requirements, as no allowances will be made after contract award. The coefficients will not be localized and are not subject to economic price adjustments. The coefficients will remain unchanged under the terms and conditions of the contract. The categories of pricing coefficients in this contract are based on work hours, location of the work and bare cost dollar value. If a task order includes work that has more than one applicable pricing coefficient category, then the coefficient will be determined based on the preponderance of the work and applied to the total direct costs.
(d) Hours of Work shall be defined as follows:
(1) Standard Working Hours (also referred to as Normal Duty Hours). The Contractor shall normally perform tasks during the standard working period of 7:30 a.m. to 4:30 p.m., Monday through Friday, excluding federal holidays and Family Days (see Scetion H, paragraph entitled “NORMAL WORK HOURS”). The Contractor may elect, at his option and at no additional cost to the Government, to work hours other than standard working hours provided that (a) the request is submitted in writing at least three (3) full work days in advance of the desired date, and (b) the Contracting Officer approves the request. Non-standard hours worked at the convenience of the Contractor and with the approval of the Contracting Officer will be at a standard hours coefficient.
(2) Non-Standard Working Hours. Non-standard working hours are defined as the period from 4:30 p.m. to 7:30 a.m., Monday through Friday, as well as weekends and federal holidays. Items of work to be accomplished during non-standard hours shall be clearly identified in contractor technical/cost proposals, including justification for the request. Non-standard hours, worked without the express approval of the Contracting Officer, will be at the coefficient for standard hours. Non-Standard work hours requested by the Government will be stated on the Request for Proposal. Task Orders subject to an accelerated construction schedule may also have the non-standard working hours coefficient applied to the Task Order (TO) items.
(e) Work Areas shall be defined as follows:
(1) Secured Area. USAF Controlled access areas are the higher-level security areas. Presence within these controlled access areas is by escort; and the movement of authorized personnel in and out of these areas is limited. Contractor personnel are permitted access to these areas on a need basis only.
(2) Non-Secured Area. The lowest level of security exists in general access areas. These areas are all of Goodfellow AFB outside of the USAF Controlled areas.
(f) Clauses and provisions in this document will be numbered in sequence, but will not necessarily appear in consecutive order.
(g) Sections K, L and M will be deemed incorporated in the resultant award, by reference.

(a) Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers. (See 28.305(c) for treatment of contracts subject to the Defense Base Act.)

ESTIMATION OF PROJECTS IN ADVANCE OF FUNDING
(a) The contractor may be required to estimate and negotiate projects in advance of funding. These projects will not have funding available and there is no guarantee that funds will become available for award of the project.
(b) The contractor may be given a list of projects that the base reasonably expects funding for. The list may be revised for both additions and deletions based on the Governments’ requirements. These projects will be estimated and negotiations completed. The Government shall incur no obligation until such time as funding becomes available and a task order is executed for the project. The negotiated total quantities shall remain binding until funding becomes available. Projects that are funded and awarded after the exercise of an option will be re-priced (not renegotiated) utilizing the current UPB. No separate compensation will be due to the contractor for projects that are negotiated and funding is not provided.
(c) Agreed upon total prices that contain non-priced items shall be verified with the contractor prior to execution of the task order. In the event the non-priced items have undergone a substantial change in the market (i.e., 10% difference), the items shall be re-negotiated and agreement reached prior to executing a task order. (End of Clause)
NON-PREPRICED WORK
(a) Items of work not found in the UPB or those items listed in the UPB that have no bare cost total but within its scope and general intent may be negotiated by the Contracting Officer or his/her designated representative. Added items of work shall be incorporated into and made a part of the task order and shall be performed at the negotiated unit price. Items pre-priced by a company, i.e., Dumpster Charges, shall be at the pre-priced cost.
(b) If the Contractor’s cost proposal includes any Non-Prepriced Item (NPI) the Contractor must submit three (3) independent written price quotes on subcontractor letterhead to the CO at the time his/her cost proposal is submitted. The price quotes may be FAX copies, and shall include the following:
(1) A “material or item” description and unit price quote, both on supplier’s letterhead with signature of supplier’s company representative.
(2) An “installation” price quote on the subcontractor’s letterhead indicating the labor classification, hourly rate, and number of hours anticipated for each workman.
(c) The items shall be performed at the negotiated price multiplied by the applicable coefficient listed in Schedule B. (End of Clause)
ORDERING PROCEDURES
(a) As the need exists for performance under the terms of this contract, the Contracting Officer or his/her authorized representative will issue a Request for Proposal (RFP) notifying the contractor of an existing requirement. The RFP will include a scope of work consisting of a Statement of Work (SOW) in such detail that contractor will be able to lay out the work. The SOW may also include sketches or drawings depending on the complexity of the particular project.
(b) Upon receipt of the RFP, the contractor shall respond to the needs of the Government by establishing contact with the Contract Administrator (CA) to coordinate the time and date of the site visit. A site visit shall be scheduled at the earliest possible time, but in no case more than two (2) work days from the date of notification. Typically, a site visit should be requested within 24 hours of notification.
(c) Upon establishing the scope of the individual requirement, the contractor shall then prepare his/her proposal for accomplishment of the task.
(d) The contractor will normally be required to submit proposals in two phases. The Government may, at its option, proceed directly to Phase II without requiring a Phase I proposal. Should the government wish to proceed directly to Phase II, the contractor will be notified in the RFP.
(1) Phase I of the contractor’s proposal for each task order must include a detailed list of proposed line items only (no quantities or unit prices) and the statement of work, to be used in accomplishing project requirements and three (3) complete sets of drawings which clearly locate and define the limits of each element of the proposed scope of work. Such documentation and drawings should clearly indicate that all work will comply with the requirements of the government’s concept design, applicable building codes, and governing authorities, and that adequate planning and design practices have been followed in accomplishing the requirements of the SOW. The contractor shall provide drawings in enough detail to enable the formulation of a thorough and accurate detailed cost estimate. For example, as a minimum the electrical drawings shall indicate outlet locations, wire sizes, panel locations and load requirements, transformer sizes and locations, schedules, and actual routing of circuits. Examples of required drawings may include topographical surveys, foundation and site plans, floor plans, elevation drawings, reflected ceiling plans, roof plans, sections and details structural framing plans, schedules for doors, windows, hardware, equipment and finishes, etc. All submittal drawings must be on an approved size sheet, and must bear a standard government furnished title block indicating the sheet number, project name, project number (JCGU XX-XXXX), drawing description, scale, SABER contractor's letterhead, three (3) blanks for revision dates.
(2) All drawings shall be reviewed for completeness by the Contractor’s Project Manager (CPM) prior to submission of the proposal. The CPM’s signature of the proposal transmittal serves as certification that the CPM has reviewed subject drawings and that they meet the requirements contained herein.
(3) The drawings will be reviewed by the government for accuracy. However, the contractor is considered the designer and any design errors or omissions are the responsibility of the contractor.
(4) The Phase I proposal indicating the contractor’s proposed methods/design for accomplishing the work shall be due to the government within 7 calendar days of the site visit. At the contractor’s written request, the CO may extend the allotted time for complex projects. The contractor is responsible for developing the design, drawings, and final statement of work for each task order, regardless of the degree of concept design supplied by the government. Concept or record drawings provided by the government shall not be re-submitted by the contractor as project drawings. In those instances where a Phase I submittal is rejected due to non-compliance; the Contractor shall have 3 calendar days to resubmit.
(5) After the contractor submits his/her Phase I proposal, and it is accepted, he/she should immediately begin developing his/her estimate (Phase II) for the project.
(e) The contractor’s Phase II proposal shall be due to the CA within 5 calendar days after completion of Phase I negotiations. With the contractor's written request, the CO may extend the allotted time for complex projects.
(1) A proposed performance period for construction shall be required as part of the Phase II proposal. The proposed performance period should include consideration for long lead time items and subcontractor schedules.
(2) The government will evaluate the contractor's proposal based upon the comparison of line items from the contractor and government's estimates. If there are significant differences, the contractor's estimate may be returned to the contractor with a short suspense (no more than 2 work days) to revise, correct, and resubmit.
(3) Negotiations will be scheduled by the CO or designated representative after the government's evaluation of the contractor's proposal. The contractor must be able to meet the established schedule for negotiations.
(4) Once the firm-fixed-price and performance time have been negotiated, the contractor shall submit his/her final proposal with drawings and the SOW within 2 work days.
(f) Task orders will then be issued by the CO using Standard Form 1155. Each Task Order will include the following information:
Date of the Task Order
Contract number and Task order number
Scope of work
Task order price, delivery or performance data
Accounting and appropriation data
· Any other pertinent data (End of Clause)
PROJECT COST CALCULATIONS
The following format will be used when preparing the priced proposal and the final clean copy, which includes final negotiated prices:
