Sole Source Justification and Determination and Findings (D&F)

This is a Sole Source Justification and Determination and Findings memorandum for a commercial acquisition. The 502d Contracting Squadron at Joint Base San Antonio is procuring three Mamava Inc. Lactation Pods (Model TSL-V30-008) at a total cost of $26,700.00. Mamava Inc. is classified as a small business under NAICS code 337127 with HUBZone status and CAGE code 74YA4. The procurement is being conducted under the authority of FAR 19.105-3 based on the final acquisition threshold. The acquisition includes procurement, delivery, and turnkey installation of the pods with integrated proprietary smart-lock systems, internal electrical outlets, seating, lighting, ventilation fans, and compatibility with the Mamava mobile application network.

The justification for sole source procurement stems from a formal inspection by 67 CW/SE that identified critical privacy and security deficiencies in existing lactation spaces that violated mandatory statutory privacy standards. The Government determined that Mamava is the only commercial manufacturer capable of providing the required combination of a fully enclosed, solid-wall design with acoustic and visual privacy, combined with a proprietary, integrated smart-access mobile application network that enables authorized nursing personnel to locate, reserve, and unlock the pod digitally while maintaining an access trail. Market research conducted between July 24 and August 10, 2026 confirmed that alternative manufacturers producing modular privacy booths or office phone booths lack either the specialized sanitizable interior features, turnkey physical enclosure, or secure digital access control network essential to address the safety findings. The acquisition directly aligns with federal mandates under the Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP Act). The Contracting Officer will ensure the final price is fair and reasonable through comparison with published commercial price lists and historical DoD/Federal entity pricing prior to award.

MEMORANDUM FOR SOLE SOURCE 10 August 2026 FROM:

502 CONS/PKBC

SUBJECT: Sole Source Justification Determination and Findings Mamava Inc. Lactation Pod

Reason: 502d Contracting Squadron is purchasing three Lactation Pods under a sole source to Mamava Inc. due to urgent compliance under the Pump Act.

1. Action Being Approved This document constitutes a Sole Source Justification and Determination and Findings

(D&F) to support a Sole Source commercial acquisition. The requiring activity intends to procure three Lactation Pods through Mamava Inc., CAGE code: 74YA4, a small business under NAICS code 337127 and HUBZone to resolve critical facility, security, and privacy deficiencies identified during a formal inspection. The Government completed a Small Business Search through search.certifications.sba.gov. The procurement will be conducted under the authority of IAW RFO 19.105-3 as applicable based on the final acquisition threshold.

2. Supplies/Services Required to Meet Agency Needs The requiring activity has a requirement for the procurement, delivery, and turnkey installation of:

• Item Description: Mamava Lactation Pod (Model: TSL-V30-008)

• Key Accessories: Integrated proprietary smart-lock system, internal electrical outlets, seating, lighting, ventilation fans, and compatibility with the Mamava mobile application network.

• Actual Cost: $26,700.00

3. Unique Qualification or Nature of The Acquisition Requires the Use of RFO 19.105-3 The acquisition of the Mamava Inc's lactation suite is strictly required due to a specific combination of essential characteristics necessary to correct critical privacy and security failures identified during the recent 67 CW/SE inspection.

The inspection revealed that existing lactation spaces within the wing's facilities failed to meet mandatory statutory privacy standards, creating unacceptable vulnerabilities for nursing personnel. To rectify these safety, privacy, and security findings, the following combination of physical and digital security characteristics is established as the minimum requirement:

1. Fully Enclosed, Solid-Wall Design: The suite must feature a robust, physical, fully enclosed structure with solid walls. This ensures acoustic and visual privacy in a high-traffic, operational military environment, preventing unauthorized viewing or noise transmission.

2. Proprietary, Integrated Smart-Access Mobile Application: The suite must integrate with a secure, networked digital access system control interface. This proprietary mobile application must allow authorized nursing personnel to locate, reserve, and unlock the pod digitally, preventing unauthorized entry by non-nursing personnel and maintaining a digital access trail.

Market research through Small Business Search indicates that the Mamava is currently the only commercial manufacturer providing this level of integrated technology and proven, self-contained design. Other commercial solutions rely on third-party retrofitted locks, manual keypads (which are easily compromised in a military environment), or semi-private screen barriers that do not correct the physical security failures identified in the 67 CW/SE inspection. The Mamava turnkey suite is uniquely engineered to guarantee the absolute privacy, safety, and operational security of our nursing personnel.

4. Contracting Officer Cost Determination Fair and Reasonable Before award, the Contracting Officer will ensure that the final price is fair and reasonable.

This determination will be based on a comparison of published commercial price lists, historical pricing of similar units purchased by other DoD/Federal entities.

5. Market Research Conducted and the Results Market research was conducted between 24 July 2026 and 10 August 2026. While other manufacturers produce modular privacy booths or standard office phone booths, none offer a specialized lactation suite that combines a fully enclosed, solid-wall, sanitary design with a proprietary, integrated smart-access mobile application network. Alternative options evaluated lacked either the specialized sanitize-able interior features, the turnkey physical enclosure, or the secure, proprietary digital access control network essential to address the 67 CW/SE safety and privacy findings. Consequently, Mamava is the only source capable of fulfilling the minimum security and technical requirements of this acquisition.

6. Other Supporting Facts to Use Other Than Full and Open Competition This acquisition directly aligns with federal mandates under the Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP Act), which mandates that employers provide a private, secure space shielded from view and free from intrusion for nursing employees.

Failing to procure a solution that meets the 67 CW/SE safety standards immediately would prolong the unit's non-compliance with statutory requirements.
