Evaluation Factors for Award
52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) (Feb 2026)
Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Price Reasonableness. 502 CONS/PKBC, using one or more of the techniques defined in RFO 15.404-1, will determine if the quote is fair and reasonable. The offeror must provide all documents listed and comply with all quote instructions to be considered "responsive" to this RFQ.
Technical Factor. The technical quote should be written so that the evaluator can make a thorough evaluation as to whether the quote meets the technical requirements of this solicitation. The technical quote shall be specific, detailed, and complete as to clearly and fully demonstrate that the quoter has a thorough understanding and ability to perform the technical requirements in SOW. Statements such as "the Quoter understands", are considered inadequate. The technical quote may include photographs, brochures, previous work on similar requirements, etc., in order to fully explain the quoter's approach. The technical quote shall NOT contain any reference to price.
Best Value Determination. For this procurement, best value determination will be made based on the Lowest Priced, Technically Acceptable (LPTA) Approach. Offerors are advised that their initial submission shall represent their best effort. Only Technically Acceptable quotes, either initially or as a result of interchanges, are eligible for award. The Government will rank proposals by price and evaluate the technical acceptability of the three (3) lowest-priced offers on an Acceptable/Unacceptable basis. If the initial three (3) lowest submissions fail to meet the specified technical criteria, the Government will continue assessing subsequent offers in order of price. The evaluation process terminates once the lowest priced quote is determined to be technically acceptable, although the Government reserves the right to evaluate additional quotes to establish adequate price competition. Contingent upon a determination of contractor responsibility IAW RFO 9.104, award will be made to the lowest-priced, technically acceptable offeror whose quote conforms to the solicitation requirements and the Salient Characteristics, without further evaluation of other offers.
Technical Evaluation Ratings: below. The technical evaluation team will evaluate the factors identified below. For a quote to be rated as "Acceptable", all technical factors must be rated "Acceptable". If any technical factor is rated "Unacceptable", the overall proposal will be rated as "Unacceptable". The failure of an Offeror to meet any or all technical criteria will result in a technically unacceptable rating and render the quote ineligible for award. The technical factors will receive one of the ratings listed below:
Technically Acceptable: The offer clearly meets the minimum requirements of the solicitation.
Technically Unacceptable: Offer does not meet the minimum requirements of the solicitation.
Initially, the three (3) lowest-priced proposals will be evaluated against the following technical factors. The Government will continue evaluating subsequent offers as necessary.
Technical Factors:
Does the quote meet the characteristics described in the SOW, as well as meeting the combined synopsis solicitation?
Did the offeror provide a technical approach to ensure the technical data meets the needs of this solicitation?
Did the quote include past performance per the instructions in RFO 52.212-1 of this solicitation?
Did the quote provide the brand name specified in this solicitation?
Is the offeror registered in SAM.gov under the assigned NAICS code as a small business & has at this moment no negative reports in their CPARS?
(b) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
