(END OF ADDENDUM TO 52.212-1)
Evaluation Factors for Award ADDENDUM TO 52.212-2 EVALUATION--COMMERCIAL ITEMS (Oct 2014)
1. Basis for Contract Award. The Government intends to award one Firm Fixed Price contract for this competitive Small Business Set-Aside service acquisition. Award will be made to the technically acceptable offeror with lowest evaluated price and acceptable past performance who is deemed responsible in accordance with FAR 9.104 and whose quote conforms to the solicitation requirements. The solicitation requirements include all stated terms, conditions, representations, certifications, and all other information required by this solicitation. Unless specifically identified in your quote, by submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in a quote being determined ineligible for award. It is the Government's intent to evaluate quotes and award a contract IAW FAR 13.106. FAR Part 15 based evaluations will NOT be used for this acquisition. The initial quote should contain your best terms; however; the Government reserves the right to conduct exchanges if determined necessary by the Contracting Officer to resolve issues such as technical or price, or deal with contract documentation including any other matter in the evaluation process. The contracting officer reserves the right to award a contract without the opportunity to revise quotes.
1.0 Evaluation Process. The Government may consider, throughout the evaluation, the "correction potential" of any quote. The judgment of such "correctional potential" is within the sole discretion of the Government. If any aspect of an offeror's quote does not meet the Government's requirements and is not considered correctable, the offer may be ineligible for award. The Government may determine one or a few offerors have the highest potential to provide the best value to the Government. Offers will be evaluated based on initial assessment of total overall evaluated prices, followed by a full evaluation of Technical Acceptability, then Price Reasonableness of the technically acceptable offer with the lowest evaluated price. Only quotes evaluated as technically acceptable are eligible to receive an award.
A. PRICE QUOTES. The Government will evaluate quotes based on an initial assessment of offeror's total evaluated prices, followed by a full evaluation of Technical Acceptability and Price Reasonableness as follows:
Rank by Total Evaluated Price, as submitted. The Government will rank all quotes by the initially proposed total evaluated price, from lowest to highest, including all ordering periods. An offeror's proposed price will be determined by multiplying the quantities by the proposed unit price for each CLIN. The extended amount for each CLIN will be totaled to obtain the total for each performance period. The total for the basic performance period will then be added to the total for each ordering period to obtain the Total Evaluated Price. The Total Evaluated Price consists of the base and all ordering periods. The contract will include five (5) 1-year ordering periods with the potential to extend the contract an additional 6 months beyond the awarded contract performance period IAW FAR 52.217-8 (Option to Extend Services Clause). In the event the Government requires continued performance, the Government's evaluation of prices proposed will be considered fair and reasonable as applied to an extension of services. To account for the possibility that the Government may utilize the "Option to Extend Services" provision at FAR 52.217-8, (for a period not to exceed six (6) months), the Government will use the offered prices for all CLINs of the final option period, prorate them to a six-month value, then, add the prorated amount to the sum of all CLINs (base period plus all option periods).
The resulting amount will be the Total Evaluated Price (TEP). Should an extension of services be required, rates will be adjusted only as result of revisions to applicable prevailing Department of Labor wage rates.
B. TECHNICAL EVALUATION. If the Government receives three (3) or fewer quotes all quotes will be evaluated for Technical Acceptability. If the Government receives four (4) or more quotes the Government will only select the three (3) lowest priced quotes and then evaluate them for Technical Acceptability. The Government reserves the right to evaluate additional quotes for technical acceptability if in the Government's best interest. If additional quotes are evaluated for technical acceptability they will be selected in the order of total evaluated price.
1. Acceptability Ratings. The evaluation factors listed below will be evaluated and receive one of the following ratings:
(i) Acceptable - The quote clearly meets the minimum requirements of the solicitation.
(ii) Unacceptable - The quote does not clearly meet the minimum requirements of the solicitation.
2. Evaluation of Factor. Only technically acceptable quotes, are eligible for award. The Government will evaluate the quotes, selected in paragraph B., for technical acceptability on an Acceptable/Unacceptable basis.
For the technical quote to be rated as "Acceptable", all technical factor(s) must be rated acceptable. If any technical factor is rated "Unacceptable", the overall quote will be rated as "Unacceptable". The technical quote will be evaluated for the following technical factor:
3. Technical Factor - Technical Management Approach:
The offeror shall submit a management plan that illustrates the corporate philosophy and management approach to demonstrate evidence of sound organization, appropriate manning and qualifications proposed, and performance management processes to successfully accomplish tasks delineated in the PWS. The plan should provide evidence of knowledge and capability delivering laundry services as defined in the solicitation.
At a minimum, the plan should:
a. Demonstrate a business approach to plan, control, and direct the labor force to meet the requirements of the PWS; describing plans for tracking and controlling work, supervising and monitoring performance, maintaining, and enhancing the quality of services.
b. Provide mitigating strategies and processes designed to prevent and proactively identify and forecast potential risks that could have an adverse impact to schedule or performance.
c. If applicable, the offeror shall describe any proposed subcontracting and or cooperative business arrangements, their operational and technical benefits to the Government, and the effectiveness of the proposed approach for managing these arrangements to ensure meeting the requirements of the PWS. If applicable, address how the work efforts of subcontractor will be managed for quality and timeliness.
Standard. The standard has been met when the offeror adequately demonstrates a sound, comprehensive, realistic, effective, and efficient technical management approach to provide and manage the appropriate workforce to achieve consistent, efficient, and uninterrupted operations in accordance with the requirements of the PWS.
C. PAST PERFORMANCE.
Past performance evaluation will examine an offeror's recent, relevant past performance record to assess the vendor's past performance ability to perform as proposed.
A maximum of five (5) previous contracts within the last three (3) years of the solicitation release date will be considered. The past performance evaluation will be accomplished by focusing on the requirements, which directly relate to the Technical factor.
A relevancy determination of the offeror's past performance, including joint ventures, subcontractors and/or teaming partners, will be made. In determining relevancy for contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. The Government is not bound by the offeror's opinion of relevancy.
1. The following relevancy definitions apply:
Past Performance Relevancy Ratings:
Rating: Relevant Definition: Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Rating: Not Relevant Definition: Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
The Government evaluation team will conduct an in-depth review and evaluation of all performance data obtained to determine how closely the work performed under those efforts relates to the proposed effort. The team will, as deemed necessary, confirm past performance data identified by offerors in their proposals and obtain additional past and present performance data, if available from other sources. Other Government sources may include the Past Performance Information Retrieval System (PPIRS), the Contractor Performance and Reporting System (CPARS), the Federal Awardee Performance and Integrity Information System (FAPIIS), the Electronic Subcontract Reporting System (eSRS), or other databases; interviews with program managers, contracting officers, and/or fee determining officials.
The past performance evaluation will consider the number and severity of problems, the effectiveness of any corrective actions taken, and the offeror's overall performance record.
Past Performance will be rated on an "ACCEPTABLE" or "UNACCEPTABLE" basis as follows: (*SEE NOTE
BELOW)
Rating: ACCEPTABLE Definition: Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.
Rating: UNACCEPTABLE Definition: Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
* NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered "acceptable."
Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.
Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. The Government reserves the right to reassess an offeror's performance based on the offeror's responses to or clarifications to certain aspects of their proposal and make our own determination on the performance assessment.
(End of provision)
Addendum to FAR 52.212-4 Paragraph (c) of Clause 52.212-4 is tailored as follows:
(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.
