Evaluation Factors for Award
Additional Regulation or Supplemental Clauses Incorporated by Full Text
The following Clauses modifications were made:
52.212-2 Evaluation-Commercial Products and Commercial Services. Nov 2021 hereby reads as follows:
Evaluation-Commercial Products and Commercial Services (Nov 2021)
(a) An award will be made in accordance with this solicitation. The Government intends to make one award for this requirement. However, the Government reserves the right to not make an award resulting from this solicitation.
This acquisition will utilize the lowest price technically acceptable evaluation process. An award will be made to the responsible offeror submitting a compliant quote and offers the lowest priced technically acceptable quote.
By submission of its quote the offeror agrees to comply with all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements
The evaluation process shall proceed as follows:
The following factors will be used to evaluate proposals.
Compliance Technical Price
Each quote must be deemed "compliant" to move on to the technical and price factor evaluation. If a quote is determined "non-complaint" the quote will not be further evaluated.
Compliance. Quotes will be evaluated for compliance. Quotes submitted must be complete and include all required documents specified in the solicitation instructions to be rated as complaint. Quotes that fail to provide all the required documents and or are incomplete will be rated as "non-complaint".
Technical. The Government will evaluate the technical submissions of the quotes found compliant for technical acceptability. The technical submission must meet the requirements of the solicitation to be rated "Acceptable". The technical submission will be rated as "unacceptable" when it does not meet the requirements of the solicitation.
Price. The Government will evaluate the price of the lowest price offeror deemed technically acceptable to determine if the proposed prices are fair and reasonable IAW FAR 15.404. The Contracting Officer (CO) has determined there is a reasonable expectation for adequate price competition and no additional pricing information should be used. However, if in the CO's opinion, additional information is needed to support a determination of a fair and reasonable price; offerors may be required to submit information to the extent necessary for the CO to determine the reasonableness of the price. In conducting the reasonableness analysis, the Government may use one or more analysis techniques described in FAR 15.404.
An award will be made to the responsible offeror whose offer has the lowest price technically acceptable offer.
(c) A written notice of award or acceptance of an offer, e-mailed, or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
