SUMMARY OF CHANGES

The purpose of this amendment is to remove Service Contract Act (SCA) applicable clauses, Block 14 (Description of Amendment/Modification):

FAR 52.222-41 and FAR 52.222-42. As a result, Wage Determination 2015-5147 Rev 20 has been removed as no longer applicable.

Also, under ADDENDUM TO FAR 52.212-1 INSTRUCTION TO OFFERORS--COMMERCIAL ITEMS, a suspense date for questions to the solicitation has been added. Questions are due 10 FEB NLT 12:00 PM CST.

Initial date of offers due, 20 FEB 2023, has not changed.

The Contractor shall comply with the provisions of this paragraph (d) if this contract was (d) Comptroller General Examination of Record awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right (1) to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, (2) audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and (3) regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow (1) down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

ADDENDUM TO FAR 52.212-1 INSTRUCTION TO OFFERORS--COMMERCIAL ITEMS.

The following paragraphs of this provision are tailored as follows:

(b) Submission of Offers:

A. To assure timely and equitable evaluation of offers, Offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including terms and conditions, and representations and certifications.

Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

Contractors shall submit questions pertaining to the solicitation package to the Contract Specialist NLT 10 FEB 2023, 12:

00 PM CST.

B. Specific Instructions:

Quotes submitted in response to this solicitation shall consist of Compliance, Technical, and Price.

See below for further details.

COMPLIANCE with solicitation, Offeror shall:

(a) Acknowledge any amendments

(b) As Applicable, complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned its entirety if Representations and Certifications are not complete/up-to-date onsam.gov.

(c) Provide all documents in technical section

TECHNICAL, Offeror shall:

(a) Provide all certifications and all documents that confirm ability to meet minimum requirements per the PWS as attachments to their quote.

(b) Confirmation will be made, using vendor provided certifications and documents, that vendor meets all requirements contained in the PWS.

(c) Price

The Offeror shall submit their quote with pricing for all contract line item numbers identified in the solicitation price schedule by providing pricing for CLIN 0001 and 1001.
