Collective Bargaining Agreement between contractor: Criterion Corporation, and union: Industrial, Technical and Professional Employees Union, OPEIU Local 4873, AF, effective 10/1/2016 through 9/30/2019 and amended on 8/10/2018.
In accordance with Section 2(a) and 4(c) of the Service Contract Act, as amended, employees employed by the contractor(s) in performing services covered by the Collective Bargaining Agreement(s) are to be paid wage rates and fringe benefits set forth in the current collective bargaining agreement and modified extension agreement(s).

SUPPLEMENTAL AGREEMENT
AGREEMENT made this / day of August, 2018 by and between Industrial, Technical and Professional Employees Union, OPEIU Local 4873, AFL-CIO, hereinafter referred to as the 'Union", and Criterion Corporation hereinafter referred to as the "Company".
WHEREAS, the parties have entered into a Collective Bargaining Agreement effective October 1. 2016 covering wages, hours and working conditions of non supervisory food service employees employed by the Company at Keesler Air Force Base, Biloxi, MS, under Government Contract Number FA3010-13-C-0013 (and any and all successor contract numbers)
WHEREAS, said Agreement provides that the parties shall meet on or about September 1st for the purpose of negotiating changes in wages and fringe benefits.
NOW, THEREFORE, it is hereby agreed as follows:

ON-CALL ALLOWANCE

When afterhours support for operational missions is required and notification is received from the FO/D, OSFICC, or designated government representative per paragraph 1.3.2. On-Call Procedures For After Duty Hours, Employees placed in "on-cal!"
status, and not otherwise scheduled for work during those hours that day, shall receive fifty dollars ($50.00) per day if not called in to work. If the employee is required to report to work while on-call, that employee will not receive the "on-call" pay for that day but shall, instead, be paid for the actual hours worked, but not less than four (4) hours; and H&W contributions will be paid according to the provisions of the collective bargaining agreement for each such hour. Article XVI for overtime shall apply.

HEALTH AND WELFARE
CURRENT:
The Company shall contribute to the ITPEU Health & Welfare Fund the sum of four dollars and forty-one cents ($4.41) per hour for all straight time hours worked plus all hours paid for vacation, holidays and sick leave, for each and every employee covered by this Agreement.
In executing this Agreement, the Company agrees to be bound by the terms and conditions of the Agreement and Declaration of Trust establishing the ITPEU Health and Welfare Plan and any amendments duly adopted thereto.
The Company further agrees to be bound by all resolutions and other actions taken by the Board of Trustees of the ITPEU Health & Welfare Fund.

The Company shall contribute to the ITPEU Health & Welfare Fund the sum of four dollars and forty-eight cents ($4.48) per hour for all straight time hours worked plus all hours paid for vacation, holidays and sick leave, for each and every employee covered by this Agreement.
In executing this Agreement, the Company agrees to be bound by the terms and conditions of the Agreement and Declaration of Trust establishing the ITPEU Health and Welfare Plan and any amendments duly adopted thereto.
The Company further agrees to be bound by all resolutions and other actions taken by the Board of Trustees of the ITPEU Health & Welfare Fund.

Two (2) weeks paid vacation after one (1) year of service with a contractor or successor.
Three (3) weeks paid vacation after ten (10) years of service with a contractor or successor.
Four (4) weeks paid vacation after fifteen (15) years of service with a contractor or successor.
Length of service includes the whole span of continuous service with the present (successor) contractor, wherever employed, and with predecessor contractors in the performance of similar work at the same Federal facility.

SICKJPERSONAL LEAVE
CURRENT & EFFECTIVE 01 OCTOBER 2018
Regular employees having worked continuously for at least six (6) months but not more than five (5) years for a contractor or successor contractor, shall be entitled to eight (8) days of paid sick/personal leave per year. Employees who terminate their employment prior to their next anniversary date shall forfeit their sick/personal leave, and be subject to a payroll deduction for any such leave that has been advanced, on a pro rats basis according to that portion of the work year they have worked since their last anniversary date.
Regular employees with five (5) or more years of continuous service with a contractor or successor contractor shall receive one (1) day of paid sick/personal leave per month, not to exceed twelve (12) days of paid sick/personal leave per year.
Sick/personal leave benefits shall not be accumulated from year to year.
Employees returning from an approved sick/personal leave may be required to furnish the Company with a signed licensed physician's statement attesting to the employee's physical condition and duty status.
It shall be a requirement of an employee taking sick/personal leave that they each notify the Company at least two (2) hours prior to their regularly scheduled work period, advising of the necessity for them to take sick/personal leave in order that the Company may obtain a temporary replacement.
Employees who call in sick for three (3) or more consecutive days or are injured outside the work place and require medical attention will be required to furnish the Company evidence of illness or injury through the written statement and a fit for duty release of a licensed physician.
Part-time employees will receive prorated holiday pay based on number of hours paid in the previous regular pay period.
It is understood and recognized by the Company and the Union that it may not always be possible for an employee who becomes ill or injured to comply fully with this section of the Agreement and it is agreed by the parties hereto that consideration will always be granted by the Company in each instance, based upon the merits of each individual case.
In the event of a government shutdown or base closure of any type (e.g., inclement weather) employees may utilize personal leave.
BEREAVEMENT LEAVE
CURRENT & EFFECTIVE 01 OCTOBER 2018
In instances of the death of a member of the immediate family of a regular employee occurring after the completion of the employee's probationary period, the Company will grant a paid leave, not to exceed four (4) days, to enable such employee to attend the funeral and otherwise assist in arrangements pertaining to the burial of such member of the family. A day's pay will consist of the employee's regular base rate for the hours scheduled for the day(s) during which the bereavement leave occurs and shall be applicable only to days within his regular work week. The term "immediate family", as used herein, is defined as consisting of the following members only:
MOTHER, FATHER, SPOUSE OR CHILDREN
No employee otherwise entitled to bereavement leave under this Article shall receive such benefits unless he gives reasonable notice to the Company prior to taking time off for bereavement purposes and provides appropriate documentation of his bereavement upon request of the Company.
PENSION
CURRENT & EFFECTIVE 01 OCTOBER 2018
The Company shall contribute to the ITPEU Pension Fund the sum of one dollar and ten cents ($1.10) per hour for all straight time hours worked plus all hours paid for vacation, holiday and sick/personal leave, for each and every employee covered by this Agreement.
In executing this Agreement, the Company agrees to be bound by the term and conditions of the Agreement and Declaration of Trust establishing the ITPEU Pension Plan and any amendments duly adopted thereto.
The Company further agrees to be bound by all resolutions and other actions taken by the Board of Trustees of the ITPEU Pension Fund.
