SECTION I
1.0 DESCRIPTION OF SERVICES
1.1 General. This is a non-personnel services contract to provide leasing and maintenance of new washers and dryers at various facilities on Eglin AFB as provided in Appendix 3, Washer and Dryer Location/Workload Estimates. The Government shall not exercise any supervision or control over the contract personnel performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the Government.
1.1.1 Overview Description of Services/Introduction. The contractor shall provide all management, personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other resources and non-personal services necessary to perform leasing and maintenance of washers and dryers as defined in this Performance Work Statement (PWS) except for those items specified as Government furnished property and services. The contractor shall perform to the standards in this contract. This includes the planning, coordination, and surveillance of the activities necessary to ensure disciplined work performance and timely resources application to accomplish all tasking under the contract. The contractor shall be responsible for maintaining communication with the Contracting Officer (CO) and the Authorized Government Representative (AGR), and to immediately notify both the CO and the AGR of any problems that would prevent timely performance of this contract. The contractor shall be responsible for and required to implement, and maintain management control systems necessary to plan, organize, direct, and control all activities under this contract.
1.1.2 Washers. New washing machines shall be a standard model from a major washer manufacturer, they must be commercial type units, and have as a minimum the following features:
1. 14 lb. Minimum capacity
2. Front loading Commercial Heavy Duty
3. Water temperature control
4. Permanent press cycle
5. Manually operated timer
6. Washer shall be equipped with a stainless steel tub, door with see thru glass and heavy duty hinge and variable speed induction, minimum ¾ hp 120V motor. Each shall have a white finish that matches the dryers.
7. Energy Star qualified.
8. Color: White
1.1.3 Dryers. Dryers shall be a standard model from a major manufacturer and must be commercial type units. New electrical power cords and dryer vent hoses shall be provided at no additional cost to the Government. They shall be electric as required and shall conform to the following specifications and sizes:
1. 14 lb. Minimum capacity
2. Permanent press cycle
3. Regular fabric cycle
4. Automatically stops when door is open
5. Manually operated timer
6. The electric dryers shall be equipped with a durable galvanized steel cylinder and have a minimum 1/3 hp motor and be 120/240/60/1-30 amp with a minimum input of 4,400 watts and a maximum input of 5600 watts at 220 volts. Each shall have a white finish that matches the washers.
7. Electrical plug must be 3 prong type.

1.2 Background. The contractor shall furnish all labor, tools, equipment, and transportation necessary to furnish, install, lease, and maintain new washers and dryers in designated facilities on Eglin AFB, FL for the locations and quantities provided at Appendix 3, Washer and Dryer Location/Workload Estimates.
Washers and dryers are to remain the property of the contractor. Washer and dryer future requirements as identified in Appendix 3, Future Requirement Floor Plans, during the life of the contract shall be new and fit the dimensions outlined in Appendix 3, and must be white. All washers and dryers shall operate without the use of coins or tokens and shall not have any coin or token slots.
1.3 Objectives. All machines installed under this contract and anticipated future requirements shall be new (not previously used) and free of dents, scratches, and rust. All washers and dryers shall be of the same manufacturer with manually operated timers that can be controlled by the user.
1.4 Scope. The contractor shall deliver and install the washers and dryers to each building, and shall utilize the existing outlets. The contractor shall connect the washers to the hot and cold water supply, the drain, and the electrical outlets. The contractor shall connect the dryers to the vent holes and electrical outlets. The washers and dryers shall be leveled and operated through one complete cycle.
1.5 Inherently Governmental Function. The contractor shall not perform Inherently Governmental functions as defined in FAR Subpart 7.5 in relationship to this PWS.
1.6 Period of Performance. A base period including a fifteen (15) day transition period (as needed) of 12 months, plus four 12-month option periods.
1.7 Place of Performance The contractor shall perform the services in the Performance Work Statement at Eglin Air Force Base, FL IAW Appendix 3, Washer and Dryer Location/Workload Estimates.
1.8. Specific Tasks. The contractor shall be responsible for the delivery, installation, connections/hook up, cleaning, maintenance, repair, removal and relocation of contractor furnished washers and dryers.
Washer/dryer locations and types are listed in Appendix 3, Washer and Dryer Location/Workload Estimates. Contractor shall schedule and clean permanent dryer exhaust ducts. All services shall be performed in accordance with manufacturer’s recommended commercial practices and this PWS.
1.8.1 Basic Services. The contractor shall provide services for the lease and maintenance of washers and dryers in accordance with this PWS and Appendix 3, Washer and Dryer Location/Workload Estimates.
1.8.2 Future Requirements/ Increased Quantity Option CLINs (X003/X004). The Government anticipates a surge in the future for stackable washers and dryers. All references to ‘future requirement’ in this PWS are referring to the anticipated surge ((X003/X004). Details are provided in Appendix 3, Washer and Dryer Location/Workload Estimates.
1.9 Historical Data. The tasks described above have been performed in the past by Commercial and Coin Laundry Equipment Company full-time equivalent employees.
1.10 Minimum Qualifications. The contractor shall be responsible to ensure that all Federal, State, County licensing and certification requirements are met and kept current. Employees must have a valid driver’s license and/or Commercial Driver’s License (CDL) as required for the type and class of vehicles used in the performance of this contract. The contractor shall provide documentation of employee licensing and certification upon request.
1.11 Machine Maintenance. The contractor shall provide all maintenance and repairs, including repair parts, to the laundry equipment. Maintenance and repair service shall be provided within 3 duty days from the initial request. The contractor shall notify by email, phone, or in-person the AGR when work is completed.
1.11.1 Notification. Upon telephone notification by the AGR contractor shall:
1.11.2 Move and Reinstall. Within 3 business days of such notice, furnish all labor, tools, equipment, and transportation necessary to move and reinstall existing washers and dryers in new locations. Moves are infrequent and based upon Air Force needs and can be negotiated as applicable.
1.11.3 Remove Equipment. Within 3 business days of such notice, remove any equipment no longer required.
1.11.4 Install Equipment. Within 3 business days of such notice, provide and install any additional required equipment.
1.11.5 Data. The Government has unlimited rights to all deliverables of this contract.
1.11.6 Inspection. Deliverables will be inspected by the Government within 3 workdays of receipt.
Progress meetings may be held as required.
1.12 Vandalism. Any acts of vandalism or machine break-ins discovered by the contractor, dormitory occupants, or shall be reported immediately to Security Forces. Pictures of the damage and copy of the report will be given to the AGR.
1.13 Listings, Signs and Decals. By the effective date of rental service, the contractor shall furnish to the contracting officer a complete listing of all equipment initially installed for performance of this contract, to include the following information: Building Number, Contractor Assigned Machine Number, Manufacturer Name and Model Number, Serial Number and Date installed. The listing will be updated per each change. Also the contractor shall provide at each machine a contractor assigned number and the necessary signs or decals to provide the operator with the proper operating instructions. The contractor shall attach to each machine a decal indicating telephone numbers and instructions for contacting the proper personnel in case machine malfunctions or to report vandalism. If the washer/dryer has operating instructions preprinted on the lid this will meet the requirement. If the manufacturer appliance operating instructions become unreadable or torn off, the contractor shall place a new sign or decal. Each washer/dryer shall be labeled with a numeric or alpha/numeric combination, which uniquely identifies each appliance. The label will be legible at all times and shall be replaced if necessary at no additional cost to the government. Additionally, partially torn labels shall be replaced at no additional cost to the government. The label shall be affixed on the front of each appliance and shall have at a minimum the following information:

1.14 Placement of Service Calls. The Contracting Officer or AGR shall contact the contractor as required to report washers/dryers that require service. Calls to the contractor shall be toll-free. Service calls shall not be accepted from anyone other than the Contracting Officer or AGR. Service calls will be answered and repairs accomplished within 3 business days after notification. In the event a machine must be removed from Government premises for repair, a replacement machine of equal quality shall be installed within 1 duty day of the date the original service call is made. The contractor shall be required to keep a record of all service calls. Close coordination of these records shall be made with the AGR. Contractor repair personnel shall contact the AGR upon arrival on Eglin AFB and after completion of all repairs by telephone. After repairs are complete the contractor shall notify the by email, phone, or in person with the following information:

3. Contractor-assigned machine number (unit number)
4. Serial number
5. Model number
6. Complaint
7. Action taken
1.15. Special Work Conditions.
1.15.1. Schedule. All work shall be done on an occupied building basis. The contractor shall arrange a work schedule with the AGR for appliance installation and shall give a 24 hour notice before starting any installation.
1.15.2. Clean-up. After completion of work at each location, the contractor shall remove all packing boxes, paper, and excess materials. The floor and area shall be cleaned to original conditions. The cardboard and papers are recyclable materials, and recycling is required by 40 CFR Part 246 and Eglin AFB policy. You may take these materials to the Eglin Recycling Center, building 612, or arrange recycling off base. The Base Recycling Center is opened Monday through Friday 0730 to 1500. Call 850-882-7744 with any questions or problems you may have.
1.16 Standards of Performance.
1.16.1 Appearance. After maintenance or installation, machines will be cleaned to present a professional appearance.
1.16.2 Duty Hours. The contractor shall provide at his expense, facilities for receiving trouble calls via a toll free or local telephone number, 8 hours a day, 5 days a week during normal duty hours (Mon.-Fri., 07:30 AM to 4:30 PM).
1.16.3 Malfunctions. The contractor shall replace at his expense, any machine that malfunctions three times during any 10-day period. All replacement machines shall be new. Contractor is also allowed to use repaired machines from the same batch of originally installed equipment.
1.16.4 Damaged Equipment. The contractor shall provide only new equipment without damages.
Damaged equipment poses a hazard to personnel and property.
1.16.5 Damage to Government Property. The contractor shall repair at his expense, any damage to Government property resulting from the movement of washers and dryers by its personnel, into or out of any building.
1.16.6 Dryer Schedule. Dryer vents shall be cleaned and rendered free from lint and dust from the dryer connection through the outside of the facility at least once (1) every six (6) months. This is required to eliminate a fire hazard. A maintenance schedule shall be provided to the AGR at least 15 days before any maintenance is performed.

1.16.7 Service/Work Order Documentation: As a courtesy to the contractor, the AGR may notify the contractor via telephone initially but will submit a service/work order via email each workday (Mon – Fri) excluding holidays when a service/work order is needed. The service/work order will have the customer's name, date call received, telephone number, appliance number(s), a brief reported description of problem and repair by date, (Figure 2). The contractor shall complete the required maintenance and annotate the response date and a short summary of repair performed or reason the equipment was not made operational and send via email to the AGR, within two (2) hours of investigation by the contractor. If a washer/dryer cannot be repaired within 72 hours, unless an extension is approved by the CO, the contractor shall replace the washer/dryer with a new washer/dryer within five (5) days.
The 72 hour period shall be calculated as: Work order issued date plus 48 hours = 72 hours.

1.17 Contractor Phase-Out and Phase-In Transition.
1.17.1 Contractor Phase-Out and Phase-In: The AGR and the Contracting Officer (CO) will coordinate the phase-out and phase-in. To minimize any decreases in productivity and to prevent possible negative impacts on additional services, the contractor shall have personnel on board, during the phase-out/phase-in periods. The phase-out of old washers/dryers and phase-in of new washers/dryers shall be performed during the 15-day period after contract award. The contractor shall submit a phase-in schedule to the CO for review and acceptance. The schedule shall be submitted within five duty days prior to the start of the phase-in. The phase-in schedule shall be typewritten and shall include the building number and date the washers/dryers will be installed. Installation of all washers/dryers shall be performed in accordance with the phase-in schedule and shall be completed no later than 15 calendar days after start of phase-in. The contractor shall provide a daily report of the number of washers/dryers installed by building number to the AGR. The contractor shall ensure washers/dryers are fully operational before proceeding to another building. No building will be without washer and dryer services for any period longer than 24 hours. The Government is not obligated to provide storage areas for washer and dryer machines.
1.17.2 (Option) Future requirements. The Government anticipates the possibility of a future surge in this requirement. Building elevators are available for contractor use in buildings 831, 835, 875, 877, & 879; which are multi-level facilities. The Government will prorate the monthly payment for each washer/dryer according to the number of days the washer/dryer is available for use during the transition.
The prorated cost shall be calculated as the following:
Washer/Dryer unit cost divided by 30 days = Daily unit cost X days of operation = Prorated Cost (Daily unit cost shall be rounded to nearest cost. Example: $.4066 = $.41)
SECTION II
2.0 Service Summary (SS)
2.1 General
The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. Unless indicated elsewhere these performance objectives will be measured monthly. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.
2.2 Performance Evaluation
Performance of a service shall be evaluated to determine whether or not it meets the performance requirements of this contract Re-performance of unacceptable services at no additional cost is the preferred course of action when appropriate. In the case of issued Corrective Action Reports (CARs), the Contracting Officer shall take appropriate measures according to the “Contract Terms and Conditions” clause; FAR 52.212-4.

SECTION III
3.0 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3.1. Government Furnished Services. The Government will provide:
Emergency Medical Services. Eglin AFB will provide emergency medical services for contractor personnel in performance of services under this contract base IAW Air Force Instruction (AFI) 41-115 Chapter 1. The contractor shall reimburse the Government for treatment provided at the current reimbursement rate for non-authorized user IAW AFH 41-114, paragraph 42. The contractor shall provide to the 96 Medical Group, the name of a physician and/or hospital to which injured personnel can be transferred for further treatment and care after receiving initial emergency treatment on base. All mishaps will be promptly reported to the base safety office through the Housing Manager.
Security Police and Fire Protection. Phone number for Security Forces Squadron, 882-2502; Fire Protection, 911.
Utilities. The Government will provide all electricity, water and sewage at no additional cost to the contractor. All utilities in the facility will be available for the contractor’s use in performance of tasks outlined in this PWS. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish requirements under this PWS.
3.2 Government Furnished Equipment. The Government will provide no equipment in support of this
PWS.
SECTION IV
4.0 GENERAL INFORMATION
4.1. Hours of Operation. The contractor shall perform the services required under this contract during the following hours: 0800 – 1600hrs, Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the Government facility is closed for the above reasons. On occasion, an employee will be required to work on weekends and Federal Holidays. The Government will notify the contractor within 24 hours of such occurrence. The contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the workforce are essential.
4.1.1 Recognized Holidays. [Contractor is not required to perform services on holidays.]

*If the holiday falls on a Saturday, it will be observed on the preceding Friday. If the holiday falls on Sunday, it will be observed on the following Monday. If a holiday falls within the 72 hour window, servicing shall continue/begin on the day following the holiday.
Work Schedules, Leave, and Absences. Monthly schedules will be provided for the upcoming work month to the AGR. Any changes in the schedule shall be coordinated between the contract manager and
AGR.
4.2. Contract Personnel
4.2.1 Contract Manager:
The contractor shall provide a contract manager and alternate(s) who are knowledgeable of leasing and maintaining washer and dryers. The contractor shall submit the name, business address, and a telephone number of the contract manager to the CO and AGR within two days of contract start date. The list shall be kept current throughout the life of the contract. The contract manager or alternate(s) shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate(s) shall be available within 8 hours to meet on the installation or via telephone conference with Government personnel designated by the CO to discuss problem areas.
The contract manager and alternate(s) shall be able to read, write, and speak English. The contract manager shall be able to effectively communicate with contractor employees.
4.2.1.1 Personnel Roster. The contractor may be required to provide a personnel roster consisting of names and other pertinent personnel data to the requiring activity for the purposes of 100% accountability real-world and exercise situations. The personnel roster shall be updated as individuals are removed and added. If required, the Government will request the contractor to provide the personnel roster. The contractor shall provide the roster within 2 calendar days of this request.
4.2.1.2 Contractor Manpower Reporting Application (eCMRA)
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via the secure data collection site (i.e. Contract Manpower Reporting Application). The contractor shall register in eCMRA within 30 days of contract award. The contractor is required to completely fill in all required data fields using the following web address http://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30.
While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the above eCMRA help desk.
Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.
Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for Government personnel and contractors are available at the CMRA link at http://www.ecmra.mil.
4.2.2. Contractor Employees:
4.2.2.1 English Language. Employees who deal directly with customers will be required to effectively communicate with the customers in English. This requirement is strictly for the purpose of efficiently performing the contract tasks.
4.2.3. Use of Government Employees.
The contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest. In addition, the contractor shall not employ any person who is an employee of the Department of the Defense if such employment would be contrary to the policies contained in AFI 64-106, Chapter 1, Industrial Labor Relations Activities.
4.2.3.1 Employment of Spouses/Dependents. The contractor shall not employ any person who is a spouse or dependent child of a Department of Defense employee (either military or civilian) when such employee would be placed in a conflict of interest or appearance of a conflict of interest by virtue of such employment.
4.2.3.2 Off-duty Military Personnel. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment. Military Reservists and National Guard member4s may be subject to reorder to active duty.
The abrupt absence of these personnel could adversely affect the contractor's ability to perform.
However, their absence at any time shall not constitute an excuse for nonperformance under this contract.
4.2.3.3 Identification of Contractor Employees. All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contractor personnel will not be required to obtain and wear badges in the performance of this service.

4.2.3.4 Privately Owned Vehicles. Each contractor employee driving a privately owned vehicle on the installation must carry minimum liability insurance as required by the State. Contractor employees shall adhere to all posted speed limits and shall not use hand-held cellular telephones while driving on the installation for phone calls or texting. Use of seatbelts is mandatory. Any contractor employee cited for driving under the influence will have their driving privileges immediately revoked for a period to be determined.
4.2.3.5 Retainability. Personnel provided under this contract/task order are critical to the mission and shall be considered “key personnel”. The contractor is expected to minimize employee turnover with respect to personnel performing under the PWS. The contractor must notify the CO within 24 hours of any change of personnel performing under this contract/task order. Any replacement personnel proposed must meet all minimum qualifications outlined in this PWS and shall be filled within two (2) weeks. The Government may request to review the candidate’s résumé for replacement personnel prior to the time the personnel change is expected to occur. The contractor is responsible for providing personnel with the appropriate security clearances and expertise in the related field described in the PWS.
4.3 Base Closures:
Work scheduled but not accomplished because of base closured due to weather, exercises, or contingency operations, will be accomplished as soon as possible after reopening the base.
4.3.1 Continuation of Essential DoD Contractor Services During Crisis.
In Accordance With DoDI 1100.22, (12 Apr 2010) Continuation of Essential DoD Contractor Services During Crises, DFARS 237.76, and the Air Force implementation thereof, unless otherwise directed by an AGR or Contracting Officer, it is determined that the lease and maintenance of washers and dryers services as identified in this PWS are not essential for performance during a crisis.
4.3.2 Performance of Services During Crisis Declared by the National Command Authority. IAW DFARS
237.76 and aforementioned Air Force implementation, unless otherwise directed by an authorized Government representative, it is determined that services as identified in this PWS are NOT essential for performance during a crisis.
4.4 Quality Control (QC)/Quality Assurance (QA)
The contractor shall develop and maintain a “Quality Control Plan” (QCP) to ensure all services are performed IAW Federal, State, and local requirements and standards and commonly accepted commercial practices and standards. The contractor shall develop and implement procedures to identify and prevent defective services from reoccurring. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Section 2, Service Summary. Contractor records shall be kept and made available to the Government (within 3 business days, if requested) throughout the contract performance period.
4.4.1 Government Quality Assurance.
According to FAR Part 46.4, the Government will evaluate the contractor's performance under this contract. The Government will evaluate the contractor’s performance IAW the Government’s Quality Assurance Surveillance Plan (QASP). The AGR will evaluate the contractor’s performance through surveillance methods available to the Government and defined elsewhere in this document. When an observation indicates defective performance, the AGR will require the contract’s project manager or contractor representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgment that he or she has been made aware of the defective performance. Government surveillance of tasks not listed in the PWS or by methods other than those listed in the PWS may occur during the performance period of this contract. Such surveillance will be done according to standard inspection procedures or other contract provisions. Any action taken by the CO as a result of surveillance will be according to the terms of this contract. The Government may inspect each task as completed and increase the number of quality assurance inspections if deemed appropriate because of repeated failures discovered during surveillance inspections or because of repeated customer complaints.
4.4.2.3 Periodic Quarterly Progress Meetings. The CO, Functional Commander, COR, other Government personnel as appropriate, and the contractor shall periodically meet to discuss the contractor’s performance.
The following issues shall be discussed; opportunities to improve the contract, any modifications required of the contract, unsatisfactory inspections and valid customer complaints against each performance objective observed and steps taken by the contractor to prevent occurrences in the future. The contractor shall provide a summation of unsatisfactory inspections and customer complaints and provide insight into any identified trends.
The minutes of these meetings will be reduced to writing, signed by the CO and any other signatures as deemed appropriate, distributed to the functional area and the contractor. Should the contractor not concur with the minutes, the contractor will provide a written notification to the contracting office identifying areas of non-concurrence for resolution.
4.4.2.4 Contract Discrepancies. The Government AGR or CO will periodically evaluate the contractor’s performance using the methods of surveillance listed in Section 2 – Service Summary of the PWS.
Government personnel will record all surveillance observations. When an observation indicates defective performance, the AGR will require the contract manager or representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgment that he or she has been made aware of the defective performance. If the contractor challenges the validity of any observation, and the AGR and contract manager cannot come to an agreement, the complaint in question shall be forwarded to the Contracting Officer for resolution.
The preferred method of dealing with any valid observation is re-performance, if possible, and at no additional cost to the Government. Repeat observations or an incident that violates safety or environmental regulations shall require the AGR to instigate a Corrective Action Report (CAR) through the Contracting Officer. The contractor shall be given three (3) business days to respond to the CAR with either an explanation on why it disagrees with the CAR or with its concurrence with the CAR, any disciplinary action taken, and a mitigation plan to avoid repeat occurrences.
4.5. Conservation of Utilities. The contractor shall instruct employees in utilities conservation practices.
The contractor shall be responsible for operating under conditions that preclude the waste of utilities.
4.6. Contractor Furnished Property and Services. Except for those items or services specifically stated to be Government-furnished in Section III and any appendixes, the contractor shall furnish everything required to perform this contract in accordance with all of its terms.
4.7 Environmental Protection. The contractor shall comply with all applicable Federal, state and local laws, regulations and standards that are or may become applicable to contractor’s activities in performance of this PWS.
Permits. The contractor shall be solely responsible for obtaining at its cost and expense any environmental permits required for its operations under the Contract, independent of any existing permits held by the Government. Any and all environmental permits required for any of the contractor’s operations or activities would be subject to prior concurrence of Government. The contractor acknowledges that the Government will not consent to being named a secondary discharger or co-permittee for any operations or activities of the contractor under the Contract. In the event the Government is named as a secondary discharger or co-permittee for any activity or operation of the
Contract, the Government shall have the right to take reasonable actions necessary to prevent, suspend, or terminate such activity or operation, including terminating this Contract, without liability or penalty.
Right to Inspect. The Government’s rights under this Contract specifically include the right for Government officials to inspect upon reasonable notice the work site for compliance with environmental, safety and occupational health laws and regulations, whether or not Government is responsible for enforcing them. Such inspections are without prejudice to the right of duly constituted enforcement officials to make such inspections. The Government normally will give the contractor twenty-four (24) hours prior notice of its intention to inspect, unless it determines the entry is required for safety, environmental, operations or security purposes.
Non-compliance. If the contractor is found to not be in compliance with any of these regulations, there may be cause for the facility to shut down until contractor, when within the contractor’s control or the Government’s, has remedied the problem. Any sanitary deficiencies shall require immediate correction.
Spill Response. The contractor is responsible to report and promptly clean up all spills in a manner consistent with current environmental regulations. In the event that it is necessary to utilize Government material, equipment, or personnel to clean up a contractor caused spill, the contractor shall be required to reimburse the Government for all associated costs.
Audit. This contract may be subject to audit by any and all cognizant Government agencies. The contractor shall make available all records, which it maintains with respect to this contract, to such agencies.
Failure to Insist On Compliance. The failure of Government to insist, in any one or more instances, upon performance of any of the terms, covenants or conditions of this contract shall not be construed as a waiver or relinquishment of Government's right to the future performance of any such terms, covenants or conditions and the contractor's obligations in respect to such future performance shall continue in full force and effect.
4.8. MISCELLANEOUS PARAGRAPHS:
4.8.1 Freedom of Information Act (FOIA). All official Government records affected by this contract are subject to the provisions of the FOIA (5 U.S.C. 552/DoD 5400.7-R/AF Supplement). Any request received by the contractor for access/release of information from these records to the public (including Government/contractor employees acting as private citizens), whether oral or in writing, shall be immediately brought to the attention of the CO for forwarding to the Base FOIA Manager to ensure proper processing and compliance with the Act.
4.8.2 For Official Use Only (FOUO). The contractor shall comply with DoD 5400-7-R, Chapter 4, DoD Freedom of Information Act (FOIA) Program requirements. This regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding FOUO material.
4.8.3 Notification of Debarment/Suspension Status. The contractor shall provide immediate notice to the Contracting Officer in the event of being suspended, debarred or declared ineligible by any other Federal Department or agency, or upon receipt of a notice of proposed debarment from another DOD Agency, during the performance of this contract.
4.8.4 Official Correspondence. The Government singularly identifies each project with a contract number at time of award. The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.
4.8.5 Past Performance Information (PPI) / Contractor Performance Assessment Report (CPARS). The Government will formally assess and report on the contractor’s performance annually. CPARS assesses a contractor’s performance, both positive and negative, and provides a record on a given contract during a specified period of time. The contractor will be provided a copy of their annual assessment at the end of each performance period. The contractor shall have 60 days to review and submit comments for the evaluation activity’s consideration before the assessment is made final. Past Performance assessment reports will be protected by all parties and treated by Government personnel as “For Official Use Only/Source Selection Information in accordance with FAR 2.101 and 3.104”.
4.8.6 Post Award Conference. The contractor agrees to attend any post award conference convened by the Contracting Officer IAW FAR Part 42.5. These meetings shall be at no additional cost to the Government.
4.8.7 Privacy Act. Work on this contract may require that personnel have access to information protected by the Privacy Act. Contractor personnel shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency rules and regulations when handling such information.
4.8.8 Records. All records created and received by the contractor in the performance of this contract shall be maintained and readily accessible. Records shall remain the property of the Government.
4.8.9 Safety Concerns. The contractor is solely responsible for compliance with OSHA standards for the protection of their employees. The contract manager shall ensure specific safety requirements in AFOSH standards and Air Force technical orders are complied with by contractor personnel when non-compliance would clearly present the potential to harm or damage Government resources. (See AFI 91-301, paragraph 9 and AFI 21-101 paragraph 2.16.) The Air Force is not responsible for ensuring that contractors comply with “personal” safety requirements that do not present the potential to damage Government resources.
4.8.10 Insurance. The contractor shall obtain the necessary insurance as required by FAR part 28.3. The minimum amounts of insurance will be maintained IAW FAR 28.307-2.
Fire Prevention. The contractor shall take all necessary precautions to prevent fires in the units and contractor-furnished and Government-furnished facilities while performing any work under this contract.
In the event fires do occur, the contractor shall immediately notify the Base Fire Department at 911. The contractor shall then notify the requiring activity and the CO. The contractor shall brief and document its employees monthly in fire safety issues and procedures in reporting fires.
Hazardous Materials.
(1) Prior to use, the contractor shall provide the Base Hazardous Material Pharmacy, through the Contracting Officer, a list of all hazardous materials the contractor brings onto Government property and shall submit and AF Form 3952 along with a Material Safety Data Sheet (MSDS) for each Hazardous Chemical listed in OSHA Hazard Communication Standard 29 CFR 1910.1200. The purpose of the inventory is to provide information for Emergency Planning and Community Right-to-Know Act (EPCRA) reporting.
(2) Any products that meet the criteria of “Hazardous Waste” must be bar coded and tracked until permanently removed from Government property. Criteria for identifying hazardous waste are contained in Subpart C of 40 CFR Part 261. NOTE: Products containing chlorofluorocarbons (CFC’s) or ozone depleting substances shall not be allowed or approved for use.
(3) The contractor shall ensure that all contractor employees complete the local Air Force Hazardous Communication, HAZMart, and hazardous waste training. The contractor shall appoint a primary and alternate HAZMART and Hazardous Waste monitor. Monitors are responsible for training all contractor personnel regarding hazardous material containers maintained on base and complete MSDSs immediately upon receipt of new chemicals, products, or materials.
Inclement Weather. If the base closes due to inclement weather, the contractor will be released, by the installation commander, with the general population of the base at no decrement to contract price. The contractor will follow the local procedures for reporting in inclement weather as advertised on local television and radio stations.
Section 508 Compliance. The contractor shall support the Government in its compliance with Section 508 throughout the development and implementation of the work to be performed. Section 508 of the Rehabilitation Act of 1973, as amended (29 U.S.C. 794d) requires that when Federal agencies develop, procure, maintain, or use electronic information technology, Federal employees with disabilities have access to and use of information and data that is comparable to the access and use by Federal employees who do not have disabilities, unless an undue burden would be imposed on the agency. Section 508 also requires that individuals with disabilities, who are members of the public seeking information or services from a Federal agency, have access to and use of information and data that is comparable to that provided to the public who are not individuals with disabilities, unless an undue burden would be imposed on the agency.
SECTION V
APPENDIX 1, Definitions, Abbreviations, and Acronyms
DEFINITIONS
Authorized Government Representative (AGR). Individual who monitors a contractor on a daily basis and who is involved in every aspect of a contract to ensure the contractor is in compliance with that contract.
Contract Administrator (CA). The individual within the contracting office who performs the day-to-day administration of the contract. The contract administrator may also be the contracting officer.
Corrective Action Report (CAR). Used to document unacceptable performance by the contractor.
Contract Manager. Individual hired by contractor to support and manage contract, deliverables, deadlines, and contract terms and conditions.
Contracting Officer (CO). The duly appointed Government agent authorized to award or administer contracts. The contracting officer is the only person authorized to contractually obligate the Government.
Defect. Any non-conformance with requirements specified in the contract.
Defective Service. A service output that does not meet the standard of performance specified in the contract for that service.
Fair Wear and Tear. The deterioration of items attributed to normal usage.
Government Furnished Property (GFP). Facilities, equipment, tools, supplies, parts, or any other items furnished for the concessionaire's use by the Government.
Major discrepancy. A major finding is defined as a condition that would endanger personnel, jeopardize equipment or system reliability, affect safety of flight, or warrant discontinuing the process or equipment operation.
Minor discrepancy. A minor finding is defined as an unsatisfactory condition that requires repair or correction, but does not endanger personnel, affect safety of flight, jeopardize equipment reliability, or warrant discontinuing a process or equipment operation.
Major Washer/Dryer Manufacturer. Any manufacturer that produces commercial grade washers and commercial grade dryer machines.
Performance Assessment. A process that measures success towards achieving defined performance objectives or goals defined within the performance thresholds in the services summary or the process of assessing progress towards achieving the objectives/goals developed in a performance plan or partnering agreement.
Performance Indicator. A measurable characteristic of an output of a work process. Generally synonymous with attribute.
Performance Management. The use of performance measurement information to effect positive change in organizational culture, systems, and processes, by helping to set agreed upon performance goals, allocating and prioritizing resources, informing managers to either confirm or change current policy or program directions to meet those goals, and sharing results of performance in pursuing those goals.
Performance Objective. The outcome associated with successful contract performance in a specific area. This is a critical success factor in achieving the organization’s mission, vision and strategy which, if not achieved, would likely result in a significant decrease in customer satisfaction or risk mission failure.
Obtaining multi-services/sub-services performed at a certain measurable standard and consistently ensures success in achieving the objectives critical to the mission.
Performance Threshold. The minimum performance level of a performance objective required by the Government.
Personnel. Employees of the contractor, or any subcontractor(s), affiliates, joint venture partners, or team members, and consultants engaged by any of those entities.
Quality Assurance (QA). Those actions taken by the Government to assure services meet the requirements of the Performance Work Statement (PWS).
Quality Assurance Program Coordinator (CORC). The individual designated by the contracting squadron commander to manage the installation QA program.
Quality Control (QC). Those actions taken by a Concessionaire to control the performance of services so that they meet the requirements of the SOW.
Services Summary (SS). A summary of the performance objective and performance threshold required by the Government in concessionaire performance. Also known as a Performance Requirements Summary or Services Delivery Summary or Performance Requirements Document.
Standard.
