About this file
This is an Express Form NDAA Certification template for compliance with Section 889 of the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019. The document addresses prohibitions on covered telecommunications equipment and services that vendors must certify against when bidding on federal contracts. The certification requires vendors to represent whether they will provide or currently use covered telecommunications equipment or services, specifically those manufactured by Huawei Technologies, ZTE Corporation, Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company, or their subsidiaries and affiliates. The prohibition became effective on August 13, 2020, and applies to not only finished products but also telecommunications components incorporated into services and equipment, such as mobile devices, routers, and cameras.
The form directs vendors to conduct reasonable inquiries and complete two Federal Acquisition Regulation (FAR) representations: FAR 52.204-26 for micro-purchases and FAR 52.204-24 for larger procurement actions. Vendors must mark whether they do or do not provide covered equipment or services and whether they do or use equipment that contains covered telecommunications components. If vendors respond affirmatively to either question, they must provide additional disclosure information as attachments. The completed certification must be signed by an authorized representative and returned to the contracting officer. This template is available in both English and Spanish to support vendor compliance across the Department of State US Consulate Monterrey's Marine Cook Services solicitation (19MX5626Q0006).
