About this file
This is an Exhibit N form from the Texas Department of Agriculture regarding confidential or proprietary information disclosures under the Texas Public Information Act (PIA). The document establishes the procedures that respondents must follow when submitting proposals containing sensitive information. Respondents are required to select one of three checkbox options indicating whether their proposal contains confidential or proprietary information, whether they have submitted a separate Public Information Act copy of their proposal, or whether their submission contains no confidential or proprietary information. The form emphasizes that blanket assertions of confidentiality may result in adverse rulings from the Office of the Texas Attorney General, requiring respondents to specifically identify and clearly mark any information claimed as confidential or proprietary in their original proposals.
The exhibit must be completed and submitted as part of the response package, with an authorized company representative signing and dating the form. Respondents who claim confidential or proprietary information in their submissions must reference Section II, Paragraph 5.2, subsections A(1) and A(2) of the solicitation for guidance on properly submitting a separate public version of their proposal. This form was revised on March 7, 2024, and serves as a mandatory compliance document for the solicitation process.
