Exhibit K: Data Security Requirements Summary

This is a Data Security Requirements exhibit from the Texas Department of Agriculture (TDA) establishing mandatory cybersecurity standards for contractors handling sensitive personal information and agency data. The exhibit outlines comprehensive technical and operational requirements that contractors must implement and maintain throughout the contract term and any renewal periods. Key requirements include compliance with NIST SP 800-53 standards or full TX-RAMP certification, quarterly vulnerability scanning and incident reporting to TDA's IT department, immediate breach notification with resolution timelines of 24 hours for reporting and 72 hours for resolution, and Payment Card Industry Data Security Standard compliance for payment processing.

Additional mandatory security controls include encryption of all personally identifiable information (PII) using AES 128-bit encryption at minimum, implementation of password standards requiring 10-character minimum complexity with multi-factor authentication options, and TLS 1.2 certificate authentication for HTTPS connections. Contractors must provide quarterly security reports by the first business day of each quarter, maintain TX-RAMP compliant hardware infrastructure and OWASP-compliant web applications, conduct background checks for all personnel with PII access, and submit annual SOC 2 Type 2 reports or bridge letters by September 1st. Contractors must also maintain disaster recovery plans and provide network diagrams upon request. All communications regarding security incidents must be directed to TDA's Information Security Officer Wesley Williams and Chief Information Officer Chris Bunton. The contractor represents and warrants compliance with Texas Government Code Section 2054.0593 regarding the state's cloud computing risk and authorization management program throughout contract performance.
