About this file
This document is the Standard Operating Guidelines (SOG) for Contractors participating in the Los Angeles County Metro Freeway Service Patrol (FSP) Program, a joint initiative between the Los Angeles County Metropolitan Transportation Authority (LACMTA), California Highway Patrol (CHP), and California Department of Transportation (Caltrans). The FSP Program requires tow service companies to provide continuous patrol service during morning and evening commute hours on designated portions of Los Angeles County's most congested freeways, with additional limited service during off-peak midday hours, weekends, and construction areas. Contractors employ and supervise FSP drivers who provide on-the-spot assistance to motorists at no charge, including jump starts, tire repairs, fuel provision, radiator refills, and vehicle towing to designated drop locations when repairs cannot be completed within ten minutes. The guidelines establish comprehensive contractor management expectations, including the designation of a qualified Manager and Assistant Manager as key personnel, daily pre-operation vehicle inspections, monthly safety meetings compliant with California State Safety Law SB-198, and mandatory attendance at quarterly Contractor Meetings. Contractors must maintain five backup vehicles and ensure all FSP vehicles display required program decals, possess valid Motor Carrier Property Permits, current vehicle registration, and proof of insurance at all times.
The SOG establishes detailed performance requirements and penalty structures to enforce compliance, with monetary assessments ranging from $50 to $1,000 or more depending on violation severity, assessed across three classes plus special circumstances requiring FSP Management Review. Contractors are responsible for driver certification through the CHP's background screening and two-day Initial Driver Training program, ensuring drivers possess current FSP Identification Cards, California DMV licenses, valid Tow Truck Driver Certificates (DL-64), Federal Medical Examination Reports, and updated log books. The document prohibits substance abuse with zero tolerance for illegal drugs, alcohol, and marijuana both on and off duty, mandates strict uniform and appearance standards, and establishes comprehensive criminal disqualification criteria including permanent disqualifications for violent crimes and sexual offenses. Contractors must submit weekly Motorist Assist Forms documenting all assists, manage tip collection procedures, comply with vehicle maintenance and repair timelines (30 days for repair or 90 days for replacement), and participate in redeployment of resources to other contracts when authorized by LACMTA with a $500 administrative fee. Additional requirements include annual facility inspections, strict electronic device usage policies during FSP service, equipment tampering prohibitions, and immediate reporting of all violations to FSP Management under threat of contract termination.

CHAPTER 1 – OVERVIEW OF THE METRO FSP PROGRAM
1. Why a Freeway Service Patrol Program?
The purpose of the Metro FSP Program in Los Angeles County is to provide congestion relief on the freeways, improve safety and air quality, and reduce fuel consumption by rapidly clearing incidents.
Prompt clearing of the roadway reduces the occurrence of additional accidents and slowing caused by curious onlookers and motorists trying to avoid the original incident. The keys to maintaining maximum capacity on the roadways are opening closed or blocked lanes and expediting the removal of disabled vehicles from the freeway.
2. Scope of the Program
The Metro Freeway Service Patrol is a joint program of the Los Angeles County Metropolitan
Transportation Authority, the California Highway Patrol, and the California Department of
Transportation.
Towing companies enter contractual agreements with LACMTA to provide continuous patrol service during morning and evening commute hours on designated portions of Los Angeles County’s most congested freeways and highways. Additional limited service is provided during off-peak midday hours, weekends and in specific construction areas.
Contractors employ drivers to provide on-the-spot help to motorists, free of charge, and with no tip. A
Driver may: jump start cars, repair or replace a flat tire, provide a gallon of gas, refill radiators, or provide other quick fixes to mobilize the disabled vehicle.
If a FSP Driver is unable to get a vehicle running within 10 minutes, the Driver should tow the vehicle to a designated drop location where additional assistance can be requested.
FSP Drivers may be called upon to provide assistance in removing vehicles involved in collisions, removing debris from roadways, or assisting with other incidents as directed by the CHP.

4. Performance Requirements, Penalties and Monetary assessments
LACMTA requires that the Contractor meet its full contractual obligation to perform its duties pursuant to the contractual requirements. Failure to meet contractual requirements constitute a default under the contract and is subject to the various remedies provided in the contract, up to and including termination of the contract.
Any failure on the part of the Contractor to meet the contractual requirements shall degrade the value of the service provided to the public. The failure to meet contractual requirements, therefore, causes damages to the FSP program, its participants (LACMTA, CHP and Caltrans), and to the public.
Because of the public service nature of the mission of FSP program, to keep traffic and commerce flowing on the freeway system, the damages arising from the Contractor’s failure to meet the contractual requirements are impractical or extremely difficult to ascertain on an individual basis.
The contract has established a series of remedies to attempt to address a range of defaults. The most egregious defaults could result in disqualification from participation in the FSP program and/or termination of the contract. Other defaults will result in required additional training, suspension from the FSP program, and/or monetary assessment, or other remedies as determined by FSP
Management and/or any combination of remedies. The remedies are to encourage compliance with performance requirements of the contract. The Contractor and Driver SOGs attempt to identify all program rules and requirements; however, there will be instances that cannot be anticipated.
LACMTA retains the right to assess the appropriate remedy to address the default, including the imposition of penalties & monetary assessments in the form of time based and static monetary assessments, which are detailed in the text of this document in Chapter 8 -Violations and Penalties.
Contractor SOG February 2025 Page 7
Contractors are responsible for maintaining updated Contractor and Driver SOGs with information provided by the FSP Management. The Contractor and Driver SOGs provide program-wide guidelines;
however, there may be variations due to the nature or the differences in service provided by FSP service. Revisions are issued as necessary by the FSP Management through LACMTA. Revisions supersede all previous or existing Guidelines/Procedures and Policies.
If a truck and driver are determined to be in non-compliance with the contract by not passing pre-operation inspection prior to the beginning of the shift, a fully equipped back-up truck or driver shall be deployed after notifying CHP Dispatch with the appropriate changes in vehicles. If there are not sufficient vehicles to meet service requirements, the Contractor shall immediately notify CHP David
Unit of the service deficiency.
The back-up truck must also pass a daily pre-operation inspection by the Contractor and the Driver prior to beginning the FSP shift.
The Contractor or their designee shall notify Dispatch immediately when a truck and/or a Driver are not available at the beginning of a shift.
The Contractor or its designee shall perform the following tasks or will be considered in violation of the contract. Penalties for not performing the following are defined in Chapter 8 of this Contractor

5. Annual Inspection
FSP Management will conduct an unannounced inspection at the Contractor’s facility each year.
The annual inspection will include but not be limited to: a comprehensive inspection of all FSP vehicles including equipment and supplies, a facility inspection, and FSP program documentation.
The intent of the inspection is to ensure that the vehicles are in good working order, the Contractor is properly maintaining the vehicles, the vehicles are properly equipped and ready for service at all times, and the Contractor is maintaining required program documentation. Any deficiencies discovered during the inspection will be assessed in the form of monetary assessments and penalties on the monthly invoice and any other administrative action that needs to be taken. Additional inspections may occur if annual inspections have discrepancies.
6. Cursory Inspections
FSP Field Supervision (CHP David Units) conduct cursory inspections on a regular basis. The cursory inspection will determine if the driver and vehicle can provide the required service. Any deficiencies discovered during the “Pre-Operational Inspection Form” will be assessed in the form of monetary assessments and penalties on the monthly invoice and any other administrative action that needs to be taken.
7. Required Safety Meetings
The Contractor shall hold monthly scheduled safety meetings with FSP Drivers in accordance with
California State Safety Law SB-198. These meetings shall be used to disseminate information regarding the FSP Program and to provide a forum where Drivers may express their concerns.

A “Motorist Assist” Form must be correctly completed, by the Driver, for each assist completed during
FSP hours of operation. Drivers do make errors in completing the Motorist Assist form and a certain number are received each week. LACMTA will return the error cards to the Contractor to be filled out correctly. It will be the responsibility of the Contractor to pick-up the error cards, correct them and deliver the corrected cards to LACMTA within one week. If the corrected cards are not received within one week, LACMTA will assess a monetary assessment for each weekly batch of error cards that are late and an additional monetary assessment per week thereafter.
If a beat error cards on a regular basis, the Contractor and all the Drivers from that beat shall attend a mandatory re-training class on the proper method to complete a Motorist Assist form. The class will be conducted by LACMTA staff at the LACMTA building located at One Gateway Plaza, in Los Angeles.
LACMTA will notify the Contractor, and the training must be completed within two weeks from the date of the LACMTA letter; if not, the Contractor will be subject to a monetary assessment and the
Drivers will be disqualified from participating in the FSP Program until training has been completed.
When motorist assist data is required immediately for evaluation of Caltrans construction projects, the Contractor must submit the assist data to LACMTA as specified by LACMTA.
Submission of Motorist Assist Forms
The package must be delivered or postmarked no later than the first Wednesday following the last working day of the previous week. Late or absent forms shall result in a monetary assessment against the Contractor.
NOTE TO THE CONTRACTOR: Completed Motorist Assist Forms shall be submitted to LACMTA on a “weekly basis”. A “weekly basis” is defined as all forms from Monday through Sunday in one group/package. DO NOT mix weeks or mix beats. Self-addressed postage paid envelopes will be provided by LACMTA to submit completed Scantron forms. In the event envelopes are
Contractor SOG February 2025 Page 10 not available, the Scantrons should be mailed to:
LACMTA
Metro Freeway Service Patrol One Gateway Plaza Mail Stop 99-11-1 Los Angeles, CA 90012
Falsifying Motorist Assist Forms
A Driver shall never falsify a Motorist Assist form. Falsifying a motorist assist form will result in
Disqualification from participating in the FSP program. It is strongly urged that a Contractor review the Driver’s Motorist Assist forms prior to sending them to LACMTA in order to check for accuracy and to maintain Driver efficiency and professionalism in the field.
11.Attend Contractor Meetings
Contractor Meetings are held each quarter and attendance at these meetings is mandatory by either the Contractor or the designated Manager with decision making authority. Failure to attend the
Contractor Meetings will result in a monetary assessment.
12. Tip Procedure
Should a Contractor encounter a situation where a Driver is given a tip, the Contractor shall use the following procedure:
a. The Contractor shall maintain control of the tips, (money/items received) until the next scheduled Contractors’ meeting. The Contractor is required to turn in tips and Tip Logs at

Contractor SOG February 2025 Page 11
13. Redeployment
Redeployment is the LACMTA authorized and coordinated use of backup/available drivers and vehicles from one contract to provide support on another contract, Caltrans construction or special projects.
A contractor assigned to provide redeployment support on another Contractor/Beat is required to follow all FSP operational rules, policies and procedures for that beat (including staging at the proper staging area). FSP Big Rig and FSP ExpressLanes vehicles cannot be used for regular FSP service and vice versa.
Contractors may be asked to use their resources as a back-up vehicle to avoid service deficiencies in another region. In this situation, the vehicle from the other contract acts as the backup vehicle from the deficient contract and hourly rate adjustments are permitted. Specific information regarding redeployment of vehicles from one region to another will be defined in the contract or in the
Contractor SOG.
Contractor Request for Redeployment
Contractors may request short-term redeployment support (30 days or less) from another contractor if they are not able to fulfill contractual obligations due to unforeseen vehicle and/or Driver issues.
However, if the request for redeployment is not accommodated, the Contractor is responsible for any service deficiency and will be held liable based on the contract.
The following conditions must be met in order for LACMTA to authorize and assign redeployment support:
1. The requesting Contractor must complete a Contractor Redeployment Work Order Form” which must be received and acknowledged by LACMTA at least two business days prior to the requested start of redeployment. For example, requests for redeployment starting on a
Monday must be received by close of business on the preceding Wednesday just as requests for redeployment starting on a Tuesday must be received by the close of business on the preceding Thursday.
2. The requesting Contractor shall be assessed on their monthly invoice a $500 administrative fee for processing and managing the redeployment.
3. Another Contractor must agree to perform the requested redeployment.
4. The requesting Contractor shall be assessed (on their monthly invoice) the additional cost to redeploy a contractor with a higher hourly rate (defined in the contract).
5. The redeployment period shall be for a minimum of 5 weekdays or 2 weekend days and 3
Contractor SOG February 2025 Page 12 weekdays (if weekend days are requested) (Excluding Holidays). No exceptions.
Under successful completion of these five conditions, the requesting Contractor will be exempt from providing the service as detailed on the redeployment form, and the Contractor shall not be paid for any redeployed service. Redeployment Selection Criteria
Contractors will be offered redeployment if the following criteria are met:
1. Contractor is “In Good Standing” with FSP Management
2. Contracts are separated by type of service required - Light duty vs. Big Rig. Contractors will only be offered redeployment in their contracted type of service.
3. Contracts with lowest hourly rate will be offered redeployment regardless of the distance to the redeployment location. Contractors should consider distance to the redeployment and
Log Book requirements before accepting redeployment
4. Willing to perform redeployment
5. There are sufficient contingency funds in the contract to cover the cost of the redeployment
6. Contractor has adequate resources to meet their contractual obligations as well as perform the requested redeployment
7. Only tow trucks can be used from the contract being offered the redeployment.
Redeployment Work Order
Once the redeployment is accepted by the Contractor, LACMTA will generate and email a
Redeployment Work Order Form to the Contractor. When construction redeployment is offered, Caltrans will approve, sign and email the form to the Contractor. The Contractor is required to sign the form and email it to LACMTA. Once the form is signed by both the Contractor and LACMTA, (only in the case of construction support will Caltrans signature be required), the redeployment agreement is complete, and the Contractor will be responsible for providing the agreed upon service and subject to administrative action in the form of monetary assessments and other penalties for any service deficiencies. This form then serves as a binding agreement between the LACMTA and the Contractor accepting the redeployment that the redeployed service will be provided, and that LACMTA will reimburse the Contractor for the service. LACMTA also reserves the right to cancel a redeployment work order at any time.
Under no circumstances shall a Contractor requesting the redeployment cease to provide coverage without LACMTA authorization; further, under no circumstances shall a Contractor accepting the redeployment offer, begin to provide this added work without having received a fully completed and signed Redeployment Word Order authorizing said redeployment. A copy of
Contractor SOG February 2025 Page 13 the Redeployment Work Order Form is attached.
14. Driver/Employee Uniform Requirements
The contractor shall be responsible for Employee/Drivers meeting FSP uniform, grooming and personal appearance standards.
For public identification purposes, the Driver shall wear an FSP authorized uniform. Failure to meet uniform standards may result in the Driver being taken out of service and the Contractor assessed or other penalty imposed. Continued violations of the uniform requirements may result in a decision by the FSP Management to no longer utilize the particular Driver for the FSP program.
The uniform shall meet the following criteria as described below:

FSP Holiday Service
Holidays
Holidays and service levels are designated at the beginning of each calendar year by FSP Management and are subject to change
2. FSP Dedicated Vehicle Policy
All primary FSP vehicles shall be dedicated to the FSP program, display the required FSP Program decals, and cannot be used by the Contractor for any other purpose during the term of the contract. The Contractor shall not change, or substitute vehicles identified for use in this Contract. The Contractor shall use the same primary and back-up vehicles for the duration of the Contract. FSP vehicles must return to Contractor facilities when not providing FSP service. Backup trucks are exempt from the dedicated vehicle requirement.
Dedicated Vehicles at Approved Facility When Not in Service All FSP dedicated trucks are required to be at the approved Contractor facility when not providing FSP service. Drivers are not authorized to take vehicles to their residence, on errands, non-FSP related tows, or any non-FSP related activities and will result in a monetary assessment.
Contractors are allowed to take their dedicated FSP vehicles to dealers or other maintenance facilities as required to keep their vehicles properly maintained. Contractors shall advise CHP dispatch if the vehicle(s) will be at a non-approved FSP facility overnight and/or longer. FSP vehicles must have the “Not in Service” magnet on the FSP vehicle whenever the vehicle(s) are undergoing authorized non-FSP related activities.
Backup Vehicles Contracts are required to have backup trucks. The number of backup trucks will be identified in the contract. Backup trucks shall match the vehicle specification guidelines required of all primary contracted vehicles. Backup trucks are exempt from the dedicated vehicle requirement and those without FSP Program decals may be used by the Contractors for service other than for FSP. If the Contractor chooses to apply FSP Program decals to their backup vehicle, that vehicle will be considered a dedicated
Contractor SOG February 2025 Page 17 vehicle and subject to the dedicated vehicle guidelines.
Whenever a backup truck is used for FSP service (for an authorized redeployment, Caltrans construction support or regular FSP service), that backup truck must operate as a dedicated vehicle with the appropriate temporary magnet design requirements and must follow the dedicated vehicle requirement for storage when not providing FSP service.
3. Vehicle Refueling
• No refueling of vehicles during the AM or PM shifts.
• A vehicle working consecutive shifts on the same day may only refuel during the midday shift.
• Refueling is allowed during the Weekend shift. Refueling shall occur adjacent to the assigned beat.
4. Radio Communications Equipment Repair
Each FSP vehicle, including required back-up truck, shall be equipped with a FSP radio and Automatic
Vehicle Locator (AVL) to enable the Driver to communicate with CHP Dispatch. The FSP Program shall furnish and install this equipment. The Contractor is required to ensure that the equipment is operational, and that the Driver is proficient in the use of all equipment.
In the event the FSP communications requires repair, the following procedure will be followed:
1. The FSP Driver shall immediately notify the CHP Dispatch to advise them of the equipment problem.
2. CHP Dispatch will document all pending repair appointment in the Repair Authorization
Log.
3. CHP Dispatch will contact LACMTA Radio Repair Shop each business day to advise them of equipment in need of repair. LACMTA personnel will then contact the Contractor’s
Manager to schedule an appointment. Appointments are based on priority and availability.
4. The Contractor will be responsible for all costs associated with transporting the vehicle to and from the Radio Shop. If the vehicle requiring communication equipment repair is a primary vehicle and the appointment is during a shift that the vehicle was scheduled to work, the Contractor’s Manager shall assign an alternate FSP vehicle to operate in its place to ensure that the required number of authorized vehicles are operating on the beat at all times.

5. Equipment Tampering
Tampering with FSP communication/tracking equipment so that it does not function properly/disconnected or is moved (without FSP Management authorization) from its original installed location is strictly prohibited. This includes but is not limited to: breaking evidence tape/orange connection sealer on equipment connections, cutting wires or cable, moving mounted equipment (speakers, microphones, etc.), rerouting any wiring, and disconnecting any connectors, etc.
If tampering of FSP communication equipment is suspected during the shift, the truck and driver will be sent to the Radio Shop for an inspection. If tampering is found, the Contractor will be retroactively docked from the time the vehicle left the beat until such time that the backup truck is deployed, or the shift ends. In order to avoid a possible retroactive dock, the contractor may immediately replace the truck taken out of service with a backup truck in order to continue to provide service. By doing so, the contract assumes responsibility for the transportation and labor costs associated with sending the vehicle in question to the Radio Shop regardless of the outcome.
Tampering Repairs
All repairs to the FSP communications equipment will be the sole responsibility of the LACMTA
FSP Radio Shop. If the tampering is found outside of Radio Shop hours, the vehicle will be taken out of service and remain out of service until the repair and documentation by the radio Shop is completed. The transportation and labor cost associated with Radio Shop visits for tampering will be the responsibility of the Contractor.
Tampering Penalties
The Contractor will be assessed a monetary assessment per incident on their monthly invoice. If it is determined that the Driver tampered with the equipment, the Driver will be disqualified from the FSP Program.
Contractor Discovering Tampering
A Contractor that discovers tampering of FSP equipment during the pre-trip inspection can avoid the tampering assessment by sending the vehicle to the LACMTA Radio Shop instead of placing the vehicle into FSP service. Any transportation and manpower costs will be the responsibility of the Contractor.
The Contractor will be responsible for the cost of the repairs. Under no circumstances should the Contractor repair the damage. Any repairs conducted outside of the LACMTA Radio Shop will
Contractor SOG February 2025 Page 19 be considered tampering and subject to a monetary assessment.
6. Maintenance and Appearance of Vehicles
All tow vehicles and equipment acquired and employed under the terms the Contract shall be maintained by the Contractor in good repair and appearance and in satisfactory condition, acceptable to FSP Management.
FSP Management reserves the right to take vehicles out-of-service for any reason and without notice for any violation described in the contract. Further, FSP Management may require the contractor to clean and/or repair/repaint specific vehicles or portions of the vehicle in order to meet the program requirement of white in color. Vehicles that fall within this category may have collision damage, excessive scratches and abrasions on the chassis and bed or the paint is faded, dull or dirty in appearance. Once FSP Management has identified a vehicle that requires repainting or cleaning and notified the contractor, the Contractor will have 30 days to paint the vehicle and 14 days to clean the vehicle. If the Contractor has not completed the required activity within the time allotted, the vehicle will be taken out of service and the Contractor will be assessed $100 per day retroactive from the date of the notification.
The Contractor agrees to perform preventive/scheduled maintenance at the intervals specified by the manufacturer for all the contracted vehicles. The work performed will be documented and detailed (reports and/or logs). Maintenance documents shall be made available immediately upon request by LACMTA.
It is expected that all preventive/scheduled maintenance will be performed at such times as to avoid the need to place the backup truck into service. It is not the intent of this requirement to preclude necessary maintenance during normal hours; it is only to ensure that the primary vehicles will be available for service.
7. Vehicle Repair and Replacement Policy
Vehicle Repair
In the event a primary tow or service vehicle is taken out of service and can be repaired, the
Contractor is required to have the vehicle back in service within 30 days. If the vehicle is not in service by day 31, LACMTA will assess the contractor $100 per day for each day the vehicle remains out of service retroactive to the first day out of service. Therefore, LACMTA will assess
$3,100 on day 31 if the vehicle is not in service and will continue to assess damages of $100 each
Contractor SOG February 2025 Page 20 day until the vehicle is returned to service.
A vehicle that is out of service for 30 days and is taken out of service again within a short period of time will be subject to CHP inspection to ensure that the vehicle was properly repaired the first time and that the new repair is in fact a new problem.
The Contractor may determine that the vehicle cannot be repaired at which point the vehicle must be replaced as detailed in the guidelines below. A Contractor that commits to replacing the vehicle but is somehow able to repair the vehicle and place it back into service after 30 days will be subject to the assessment as stated above.
Vehicles taken out of service for extended periods may be subject to CHP inspection prior to being allowed back into service.
Vehicle Replacement
In the event a tow or service vehicle can no longer be used for FSP service due to an accident, mechanical breakdown, etc., the Contractor is required to replace the vehicle, if the date the vehicle went out-of-service is more than 180 calendar days (6 months) from the Contract termination date. The Contractor will have 90 days from the date the vehicle became out-of--service to have the replacement vehicle FSP certified by CHP and available for service regardless of insurance settlement. The vehicle must meet FSP requirements and may be of comparable mileage and model year to the vehicle it is replacing. If a replacement vehicle is not certified and available for service within 90-days, the Contractor will be subject to monetary assessment of $100 per day* retroactively from the day the vehicle went out of service until a replacement vehicle is certified for FSP service by CHP or the contract ends. This is in addition to any other penalties assessed for other trucks that are out-of-service and impacting FSP service. If the out-of-service date is less than or equal to 180 days prior to the Contract termination date, the
Contractor has the option of whether or not to replace the vehicle. The Contractor may request from LACMTA to use the backup tow truck or service vehicle from another FSP contractor to substitute for the out-of-service vehicle. However, vehicles from expired contracts cannot be grandfathered into current active contracts.
* $100 is the estimated daily all-inclusive cost (liquidated damage) of a tow vehicle.
8. Dock Information for Mechanical Breakdown
Contractor SOG February 2025 Page 21
If an FSP vehicle is no longer able to operate as required during the shift, the Contractor must notify dispatch immediately. A FSP truck going out of service during the shift for mechanical reasons, including regeneration of engine clean air act, the Contractor shall be docked in 15-minute increments until the truck returns to service, a backup truck is deployed or the shift ends.
9. Electronic Device Usage
Unauthorized Personal Communication/Electronic Device Usage Policy shall be defined as:
• Discovery of any personal portable electronic device in the cab area of the FSP vehicle during FSP service (not including authorized breaks) without FSP Management authorization is prohibited.
Authorized Personal Communication/Electronic Device Usage shall be defined as:
• A FSP driver may use his/her personal electronic device during an authorized break when the vehicle is off of the freeway, is parked and in an approved location but shall return the device to the authorized storage location before restarting the shift.
• A FSP Management may authorize Drivers to use their cell phones under specific circumstances (personal emergencies) or request Drivers to contact them via cell phone. For those requests, CHP Dispatch may authorize Drivers to use their cell phone when the vehicle is off of the freeway, is parked and in a safe or approved location but shall return the device to the authorized storage location before moving the vehicle.
• During a special redeployment assignment where FSP communications equipment or shop radios are found not to be operational; Contractors/Drivers will be informed prior to starting the assignment whether or not they are authorized to use their personal electronic device, such as a cell phone, to communicate with dispatch or the contractor; but only when the FSP vehicle off of the freeway and is parked in a safe or approved location.
• A Driver may use his/her personal cell phone In the event the FSP radio and the shop radio are not operational and it is necessary for the Driver to communicate with CHP Dispatch or their employer’s dispatcher, the Driver can use their cell phone when the vehicle is off of the freeway, is parked and in a safe or approved location but shall return the device to the authorized storage location before moving the vehicle. If this occurs during an assist on the freeway, the driver may use a cell phone to communicate with CHP Dispatch or the Shop dispatcher.
• In the event the FSP radio is non-operational, and the Driver needs to communicate with CHP Dispatch, the Driver shall contact their employer’s dispatcher via Shop radio and have the Shop dispatcher contact CHP Dispatch and relay any messages between the driver and the CHP Dispatcher. In this case, the CHP Dispatcher may authorize the use of the cell phone to contact them directly when the vehicle is off of the freeway, is parked and in a safe or
Contractor SOG February 2025 Page 22 approved location but shall return the device to the authorized storage location before moving the vehicle.
Personal Electronic Devices are defined as:
• Wireless and/or other similarly portable electronic handheld equipment, including but not limited to, cell phones, pagers, smart phones, portable internet devices, MP3 players, iPods, iPhones, iPads, Bluetooth enable devices, Electronic-Cigarettes (or similar electronic smokeless device), personal digital assistants (PDAs), headphones/ear buds of any type, video game players, laptop computers, DVD players, audio players, GPS/Navigation devices, stereo devices or any electronic device that is not permanently attached to the FSP vehicle and which may create a…
