About this file

This is an Evaluation Criteria document for the Los Angeles County Metropolitan Transportation Authority (LACMTA) related to a towing services contract solicitation. The solicitation permits proposers to submit proposals for one or more groups, with LACMTA conducting a single vehicle inspection and facility inspection per proposer at the business address listed in the proposal. The evaluation process consists of two sequential factors: technical acceptability and lowest price among technically acceptable proposals. Technical requirements include demonstrating continuous, uninterrupted ownership or lease of a minimum of three light or medium-duty tow or flatbed trucks for the three years preceding the proposal due date, maintaining valid General/Garage Liability, On-Hook Tow, and Workers' Compensation insurance for the past three years, holding continuous Motor Carrier of Property Permits from the California Department of Motor Vehicles for the past three years, maintaining current business licensing for three years, and operating a facility located in Los Angeles County or within 15 miles of the county line. Proposers must submit a complete fleet inventory list and undergo unscheduled Level I Safety Inspections of both vehicles and facilities during site visits.

Award shall be made to the proposer offering the lowest fully-burdened hourly rate that meets all technical requirements, with the rate inclusive of materials, labor, equipment, fuel, insurance, travel time, overhead, and profit. The solicitation is subject to LACMTA's Local Small Business Enterprise (LSBE) Preference Policy effective January 1, 2023, which provides a 5% price reduction for evaluation purposes to LSBE-certified prime contractors or proposers subcontracting at least 30% of contract value to eligible LSBE firms. All proposers must complete the LSBE Preference Section in Form 2 - Affidavit and meet SBE/DVBE goals to be eligible for the preference. LACMTA reserves all rights regarding proposal evaluation and award determination, including the discretion to select which groups are awarded to each firm when multiple groups are eligible for award.

Proposers may submit proposals for one or more Groups. However, regardless of the number of Groups proposed on, LACMTA will conduct only one (1) vehicle inspection and facility inspection per Proposer as part of the evaluation process. The site visit will be to the business address listed in the Proposal Letter, Exhibit 5

LACMTA reserves all of its rights, including, but not limited to, those identified in the Instructions to Proposers, LACMTA RIGHTS, and shall be the sole judge of the merits of the respective

Proposals received. LACMTA reserves the right to determine the technical acceptability of all

Proposals and to make an award in the manner determined to be in its best interest including the right to select the Groups awarded to each firm where there may be multiple Groups eligible for award.

The evaluation will consist of two factors as follows:

Factor 1 - Technical Acceptable Evaluation Under the ‘technical factor,’ each proposer’s submitted responses will be evaluated on an ‘acceptable/unacceptable’ basis. This determination will be based on the offeror demonstrating in its proposal a technical solution that minimally meets the technical requirements specified in the Solicitation’s Statement of Work.

Factor 2 - Lowest Price Proposal Evaluation Lowest Price-Technically Acceptable solicitation, award of a Contract hereunder shall be considered to the Proposer whose Proposal is deemed by LACMTA as satisfying all technical requirements of the Solicitation, including those listed in Factor 1, and offers the best price of those satisfying all such requirements.

AVRS and/or other third-party documents are not acceptable. Vehicles that are inoperable will not be considered as one of the three (3) vehicles. Proposers may use the registration from multiple vehicles to document ownership/lease of three vehicles for three consecutive years.

2. INSURANCE REQUIREMENTS - Acceptable/Unacceptable

Exhibit 3 2 of 3
