About this file

This document is a Consent Decree filed in the United States District Court for the District of Arizona between the State of Arizona, represented by the Director of the Arizona Department of Environmental Quality, and the City of Phoenix regarding the 19th Avenue Landfill. The decree establishes the legal framework governing landfill operations and environmental compliance requirements at the 19th Avenue facility. The City of Phoenix is seeking a contractor to provide comprehensive Operations, Maintenance, and Monitoring services for the Landfill Gas Collection Control System across six landfill sites, including five closed facilities and the active landfill, with a contract term of six years commencing July 1, 2026, with potential two-year extensions available. The RFP (27-SWDD-006) was released September 17, 2025, with a deadline for questions on October 22, 2025, and proposals due November 19, 2025, at 11:00 am. Mandatory site visits are scheduled for October 2025 at all six facilities: SR85, 27th Avenue, 19th Avenue, Del Rio, Skunk Creek, and Deer Valley landfills.

Pricing will be firm and fixed for the first three years, with potential annual inflation adjustments limited to 3% or the Consumer Price Index, whichever is less. The evaluation process allocates a maximum of 1,000 points across four criteria: Qualifications and Experience (400 points), Transition Start-Up and Close-Out Plans (300 points), Price (200 points), and Reporting (100 points). Contractors must meet Disadvantaged Business Enterprise (DBE) and Small Business participation requirements, demonstrating good faith efforts to promote DBE engagement and tracking monthly participation through the City's Certification and Compliance System. Required insurance includes commercial general liability, automobile liability, workers' compensation, and professional liability, with the City of Phoenix named as an additional insured. The procurement requires compliance with federal regulations including Title VI of the Civil Rights Act and Airport Improvement Program grant assurances, along with heat safety plans for outdoor workers and comprehensive reporting obligations. While specific contract values are not stated, the comprehensive six-year scope suggests a substantial procurement opportunity.

Drinking Water Act Maximum Contaminant Levels ("MCLs") and the

Arizona Aquifer Water Quality Standards as groundwater cleanup standards, and Arizona Surface water Quality standards as surface water cleanup standards, and shall be consistent with the requirements of CERCLA, the NCP, the Arizona Environmental

Quality Act and any criteria contained in the Arizona Groundwater
