About this file

This document is a Department of Veterans Affairs (VA) Provision Addendum to GSA Template 3516 for solicitation provisions related to real property lease procurements.

The addendum contains two key provisions. The first provision establishes an alternative protest procedure for real property lease procurements, supplementing GSAR 52.233-2. Under this procedure, interested parties may file protests regarding lease solicitations either with the Lease Contracting Officer or alternatively by mail or electronically with the VA's Executive Director of the Office of Construction and Facilities Management (003C) at 425 I Street, NW, Washington, DC 20420 or CFMORP@va.gov. However, protests will not be considered if the interested party already has a protest on the same or similar issues pending with the Lease Contracting Officer. The second provision addresses ownership requirements for real property lease procurements, effective December 2024. This provision specifies that any written agreement to acquire an interest in offered property cannot be assigned to other persons or entities. If the offeror does not currently hold fee title to the property, the resulting lease must include a requirement that the lessor obtain full fee title within 30 to 60 days after lease execution. These provisions are part of VA's standard solicitation requirements for real property lease opportunities.
