About this file
This is an Exhibit C document outlining federal fund requirements and compliance obligations for a contract funded by the U.S. Environmental Protection Agency (EPA) under the Great Lakes Restoration Initiative program (ALN 66.469, Federal Award ID GL-00E05052). The document establishes the framework governing the Minnesota Department of Natural Resources' contract for the full design of the Hartley Pond/Tischer Creek Project in Duluth, Minnesota. The contractor bears full financial responsibility for compliance with all federal requirements imposed on these funds. The document restricts the use of state and federal funds as match or reimbursement for other grants or programs without prior written authorization from the State's Authorized Representative, requiring a written request submitted at least 10 business days before applying for additional funding, and mandates written approval from both the State's Authorized Representative and current landowner if new grants will create encumbrances on the project land.
The contract is subject to extensive federal compliance requirements including whistleblower protections under 41 U.S.C. 4712, procurement of recovered materials meeting EPA guidelines for purchases exceeding $10,000, and non-discrimination requirements under Title VI of the Civil Rights Act, Title IX of the Education Amendments, Section 504 of the Rehabilitation Act, the Age Discrimination Act, the Americans with Disabilities Act, and applicable state non-discrimination laws. Additional federal mandates include debarment and suspension certifications, the Copeland Anti-Kickback Act prohibitions, restrictions on procurement of covered telecommunications equipment from specified Chinese manufacturers and entities connected to foreign governments, compliance with the Clean Air Act and Federal Water Pollution Control Act, Byrd Anti-Lobbying Amendment certifications, domestic preference for U.S.-produced goods, Hotel-Motel Fire Safety Act compliance for conference spaces, EPA acknowledgment statements in all public materials, and adherence to 2 CFR Parts 200 and 1500 Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards.
