About this file

This document is the Bidder Instructions (Exhibit C) for a Request for Proposal (RFP) issued by the Washington State Department of Corrections (DOC) for a contract to perform routine maintenance and complete a United States Coast Guard (USCG) dry-dock inspection and internal structural exam on a 120-foot USCG inspected passenger carrying vessel known as McNeil Island Barge #1. The work must commence prior to the USCG biannual out-of-water inspection due on September 30, 2024. The document outlines the requirements for submitting a fixed-fee bid, including that no fee increases are permitted during the project term, payment will be a single lump sum within 30 days of final DOC acceptance, and bidders must consider their overall accountability and responsibility commitments. Bidders must complete the provided Bid Form (Exhibit D) and Rate Proposal Form (Exhibit E), and any cost information provided outside of these forms will be disregarded.

The Bid must reflect all costs and fees, including administrative processing, overhead, and any other direct or indirect costs incurred by the bidder. Expenses related to day-to-day performance of the work, such as travel, lodging, meals, and materials, will not be reimbursed. Bidders should not assume that DOC will accept pricing based on their standard business terms or practices or any significantly reduced level of commitments or obligations.

EXHIBIT C

BIDDER INSTRUCTIONS FOR

COMPLETING THE BID FORM

General Bidders must provide a fixed fee price for each relevant item identified on the Bid Form (Exhibit D). Certain items, as indicated on the Bid Form, are required and must receive a Bid or an explicit statement of “$0.” For those required items, a blank bid will be deemed as non-responsive. Bidders should not submit a fixed fee based on a fixed time period, as DOC will only accept pricing proposals based on a fixed fee for fixed scope basis. Fixed fee for fixed time bids and/or any other time-qualified proposal will be considered non-responsive.

The Bid must reflect the costs and fees to be paid by DOC to Bidder. All fees associated with the work must be incorporated into the Bid. Any portion of the work offered by the Bidder or any Subcontractor(s) that does not have a corresponding separate price will have no separate additional fee to DOC.

The Bid must include all administrative processing, overhead, and any other direct or indirect costs incurred by Bidder in the performance of the services. Bids are to be expressed exclusive of taxes. The provision of goods and services will be subject to taxes under Washington State law. DOC will pay the appropriate taxes due on goods and services, but not for any other taxes, such as the business occupation taxes, compensatory taxes or other taxes.

Expenses related to day-to-day performance of the work, including, but not limited to, travel, lodging, meals, materials, and incidentals, will not be reimbursed to the Bidder.

Provide any assumptions for the Bid on page 2 of the Bid Form (Exhibit D). Bidder's assumptions should not contradict the instructions set forth herein.

Bidders should not assume that DOC will accept pricing based on a Bidder's standard business terms or practices or any significantly reduced level of commitments or obligations Bidder believes it may negotiate Bid Considerations Cost Proposals should take into consideration the following items:

1.No fee increases are permitted during the project term.
2.Payment Schedule. Payment will be made as a single lump sum payment within 30 days of final DOC acceptance.
3.Bidder’s overall accountability and responsibility commitments (e.g., consequences for a delayed or failed project, security breaches, etc.).

Bid Submission By submitting a Bid, Bidder agrees that:

· Any cost information provided by Bidder in any documents other than the Bid Form (Exhibit D) or Rate Proposal Form (Exhibit E) will be disregarded and will not be used by DOC in its evaluation of the costs proposed by Bidder. Only the pricing provided by Bidder within the DOC-provided forms will be considered Bidder's official Bid. Any cost information provided to DOC outside of the process described in this RFP will be discarded.

· The Bid Forms must be completed by Bidder in their present structure. Unless otherwise instructed by DOC, Bidder cannot change or alter in any way the structure of the Cost Proposal Form.

DOC reserves the right to request that each Bidder provide additional information regarding its Bid and to request additional information from one or more Bidders who have responded to this RFP.
