About this file
This is an Addendum to an Exclusive Right of Sale Listing Agreement for the Volusia County Neighborhood Stabilization Program (NSP), establishing supplemental terms for real estate brokerage services in Volusia County, Florida. The addendum specifies that the County intends to contract with at least two licensed real estate brokerage firms to list, market, manage, and sell county land, buildings, commercial property, and residential property. Services are performed under written Exclusive Right of Sale Listing Agreements published by the Florida Association of Realtors, with the NSP Listing Agreement Addendum applied when applicable. The contract authorizes brokers to advertise and list properties through the Multiple Listing Service (MLS) and other marketing channels as directed by the County.
The addendum establishes that for NSP-assisted properties, sellers will only entertain purchase offers from eligible persons pre-qualified for NSP-assisted home purchases through approved NSP Affordable Housing Partners. Brokers are required to include this NSP-qualified offers language in all advertisements and MLS listings for applicable properties and must work from a list of approved NSP partners provided by the seller. The addendum includes standard legal provisions reserving the County's regulatory and permitting authority and retaining all rights, benefits, and immunities of sovereign immunity in accordance with Florida Statute Section 768.28, with liability caps limited to amounts established by the Florida Legislature.
