Summary: Exhibit A – Schedule of Items-Services and Prices/Costs

This is a pricing and fee schedule template for a federal architect-engineer services contract. The contract structure consists of a base year plus four one-year option periods, with option years exercisable at the Government's sole discretion. Each awardee is guaranteed a minimum of $10,000 per contract period, and no more than four contracts are anticipated to be awarded. Contractor payment is based on task orders issued by the Contracting Officer on a unit price basis using loaded hourly rates (inclusive of overhead and profit). Task order proposals must be submitted using GSA Forms 2630 and 2631 (Architect-Engineer Cost Estimate forms), with component categories including Pre-Design/Site Visit, Design Development, Construction Documents, Bid/Negotiation Services, and Construction Administration.

The fee schedule template requires offerors to provide loaded hourly rates for 18 job classifications (Principal Architect, Project Architect, various engineers, CAD Technician, Specification Writer, Estimator, Surveyor, Construction Inspector, Interior Designer, and Clerical Word Processor) across the base year and four option years, plus a six-month extension percentage. Offerors must also specify overhead and profit percentages. All hourly rates must be presented as loaded amounts, with overhead applying only to direct labor and profit applying to total costs. The contract is subject to the statutory fee limitation under 41 U.S.C. 254(b), capping architect-engineer fees at six percent of estimated construction costs for designs, plans, drawings, and specifications, with specific exclusions listed for services outside this limitation. Additionally, FAR 36.201-1(b) prohibits awarding construction contracts to the designing firm without agency head approval.

EXHIBIT-A

SCHEDULE OF ITEMS-SERVICES AND PRICES/

COSTS

A. ITEMS AND PRICES

1. Services are required to be provided in accordance with Section C, Statement of Work.

2. Each contract award will consist of a base year and four one year option periods. Option years, if exercised, will be exercised unilaterally at the sole discretion of the Government.

The Government is not obligated to exercise option years.

3. The guaranteed minimum amount per awardee for each contract period (base year and each option year) awarded shall be $10,000.

4. The Government may award more than one contract. However, no more than four contract awards are anticipated.

5. Contractor payment is based upon achieving the tasks defined in Section C, Statement of Work, and subsequent task orders unsupervised by Government personnel.

6. The Contractor shall execute task orders and modifications as issued only by the Contracting Officer.

7. Services are required to be performed on a unit price basis according to the rate of remuneration which is based on an hourly rate as defined herein. The hourly rates shall be “loaded” amounts.(i.e., inclusive of overhead and profit).

8. All task order price/fee proposals shall be provided to the Government using form GSA 2630, Architect-Engineer Cost Estimate, and form GSA 2631, Architect-Engineer Cost Estimate Summary, or similarly formatted spreadsheet. These forms/spreadsheets are required for individual task order quotes/proposals only. They are not required for the offer/proposal submitted in response to this solicitation. All hourly labor rates shall be indicated as “loaded” hourly rates (i.e., inclusive of overhead and profit).

Note: Any additional charges for special equipment, printing of drawings or specifications, travel, etc., shall be allowed only if approved in advance by the Government (Contracting Officer only).

9. The referenced forms (GSA 2630 and 2631) may be obtained from the U.S. General Services Administration at www.gsa.gov. The Contracting Officer may require slight revisions to these forms in the areas of the headings to best represent the various components of design work. For example: (1) Pre-Design/Site Visit; (2) Design Development; (3) Construction Documents; (4) Bid/Negotiation Services; and (5) Construction Administration.

The statutory fee limitation explained in item #10 below pertains to the areas of Design Development and Construction Documents as proposed on the GSA forms.

Careful evaluation must be made in these two areas of task order price proposals to ensure that when added together, Design Development and Construction Documents, do not exceed the statutory fee limitation.

Overhead pertains only to part A of the form GSA 2630. No overhead is allowed for Parts B (Consultants) or C (Other Direct Costs) of the form. Profit pertains to Parts A, B, and C of the form (i.e., Total Cost to Architect-Engineer).

10. The statutory fee limitation on the cost of architect-engineer services is based on 41 U.S.C. 254(b), which states in part that for architect-engineer services for public works or utilities, the contract price or the estimated cost and fee shall not be in excess of six percent of the estimated cost of construction of the public work or utility, excluding fees.

This limitation applies to the production and delivery of designs, plans, drawings, and specifications. This procedure is promulgated in FAR 15.404-9(c)(4)(ii).

The following are examples of services that, for the purpose of this directive only, are not considered an integral part of the production and delivery of designs, drawings and specifications, and therefore may be excluded from the A/E fee when determining compliance with the statutory fee limitation: 1) site analysis, field investigations, topographic and other surveys and reports; 2) subsurface explorations and borings, soils and materials testing, and resultant reports; 3) feasibility and conceptual studies; 4) master planning and budget studies and reports; 5) preparation and verification of as-built drawings;

6) preparation and presentation of models, renderings, or photographs; 7) the services of consultants where such services are not specifically applied to the preparation of plans, drawings, specifications, and foreign consultant fees where their use is required by local laws; 8) design services for special building systems for which no equivalent system function is normally encountered for private or public facilities with like functions and purpose; 9) value engineering analysis and reports; 10) market studies for the purpose of determining project costs of construction materials, equipment and services at the project site, preparation of bills of quantities, and any construction cost estimating services in excess of those normally required such as life-cycle costing of alternatives before system choice; 11) reproduction and printing costs of plans, drawings, and specifications submitted for reviews and bidding; 12) interior furniture and furnishings services; 13) construction phase services, except where design services are required as a result of construction change orders resulting from design errors and omissions adjudged to be the responsibility of the design A/E; 14) travel and per diem allowance in connection with excluded services; 15) all other services that are not integrally a part of the production and delivery of designs, plans, drawings and specifications.

11. Pursuant to Federal Acquisition Regulation (FAR) 36.201-1(b), no contract for the construction of a project shall be awarded to the firm that designed the project or its subsidiaries or affiliates, except with the approval of the head of the agency.

B. FEE SCHEDULE – SERVICE COSTS

Complete the table below for hourly labor rates, overhead, and profit to be applied to all task orders arising under the contract. Pursuant to FAR 17.202(a), the Government’s evaluation shall be inclusive of options. Offerors may offer varying prices for options. Present all rates as loaded hourly rates and also type the overhead and profit percentages utilized in calculating the loaded rates in the spaces provided.

Refer to the Statement of Work for descriptions of PL-4, PL-3, PL-2, PL-1, TL-3, TL-2, TL-1, and

CL.

The column in the table labeled “6 Month Extension %” relates to contract clause 52.217-8 Option to Extend Services (Nov 1999). Under this clause, the Government may unilaterally extend the services of any performance period (base or any option year) for an additional amount of time, not to exceed a total of six months. This clause may be exercised either at the end of Option Year 4 or at the end of any other performance period (Base, Option Year 1, Option Year 2, or Option Year 3) in the case where the Government does not intend to exercise the next option year. If this clause is exercised, the percentage entered in the “6 Month Extension %” column shall represent the amount by which the hourly rates shall be increased relative to the hourly rates that are in effect immediately preceding the exercise of the clause (Base or any Option Year).

Only one fee schedule will be accepted regardless of the use of subcontractors/ consultants. In other words, only one rate should be entered in each cell of the table.
