About this file

Exhibit 4 is a detailed document from the Colorado Department of Corrections (CDOC) outlining the Prison Rape Elimination Act (PREA) compliance requirements for contractors. The document specifies comprehensive obligations for contractors working with CDOC facilities, including mandatory training, communication protocols, incident reporting, and response procedures related to sexual misconduct, assault, and harassment prevention. Contractors must designate a PREA Manager, ensure all staff and volunteers complete required PREA training, provide orientation materials to offenders, and follow strict reporting and investigation guidelines for any sexual abuse incidents.

The document emphasizes zero tolerance for sexual misconduct and outlines specific requirements such as sending offenders suspected of sexual assault to hospitals with Sexual Assault Nurse Examiner (SANE) programs, providing mental health counseling to victims, and conducting mandatory U.S. Department of Justice PREA audits every three years. Failure to comply with PREA standards can result in liquidated damages. The contractor must separately report each incident to the Office of the Inspector General (OIG), submit monthly summary reports, and provide comprehensive demographic information about incidents. The document also stipulates that contractors must ensure effective separation of alleged perpetrators and victims and make accommodations for offenders with limited English proficiency, disabilities, or reading challenges.
