About this file
This document is a sample agreement between the California Department of Social Services (CDSS) and a Contractor for IFB 24-3038, which is for conducting physical accessibility reviews of County Welfare Department (CWD) facilities in compliance with federal mandates. The Contractor shall be responsible for assessing the accessibility of up to 75 facilities across no more than 31 counties per year, as determined by annual CalFresh caseloads. The agreement has an initial term, with the potential for renewal.
The Contractor must have staff with California-licensed Certified Access Specialist (CASp) certification to perform the facility inspections and reporting. The Contractor will be responsible for drafting detailed facility compliance reports, monitoring corrective action plan development and implementation, and providing technical assistance to counties on physical accessibility issues. CDSS will provide the Contractor with a list of eligible facilities, assist with county and facility selections, and review and approve deliverables. The agreement is funded with $600,000 in ongoing state funding, with the Contractor responsible for covering all travel and other expenses as part of the per-county pricing.

EXHIBIT A
(Standard Agreement)
Scope of Work
A. Introduction and Background
The United States Department of Agriculture Supplemental Nutrition Assistance Program (SNAP) rules require the California Department of Social Services (CDSS) to conduct routine reviews of County Welfare Departments (CWDs) to ensure that programs are administered in compliance with civil rights requirements. The frequency of these compliance reviews is dictated by CalFresh caseloads.
(Compliance review and audit will be used interchangeably in this Scope of Work.)
There are 58 counties in California, divided into a total of 60 CWDs. (CWDs and counties will be used interchangeably in this Scope of Work.) CDSS must conduct compliance reviews of no more than 31 counties per year to meet these requirements which demand that large counties are reviewed annually, medium size counties are reviewed biennially, and small counties are reviewed every three years.
The size of the county is determined by CalFresh caseloads annually, usually in September or October. Currently CDSS staff decide which CWDs will be audited in the coming calendar year.
Each compliance review of a CWD involves a multi-step, time- and labor-intensive process including in-depth reviews of the CWD’s Annual Civil Rights Compliance Plan, civil rights related policies and procedures, program case records, handbooks, forms, job aids, and staff training.
As part of the required compliance reviews, CDSS must conduct an in-depth assessment of CWD facilities to determine physical accessibility for individuals with disabilities. Only facilities which are public facing and house specific CWD programs are required to be reviewed by CDSS. Conducting an effective and appropriate facility assessment requires a particularly high degree of technical knowledge, including familiarity with the extensive and detailed requirements of the Americans with Disabilities Act (ADA) Standards and the California Building Code.
Reviewing, approving, and monitoring Facility Corrective Action Plans (FCAP) require the same level of expertise and technical knowledge as conducting facility assessments. FCAP monitoring is time intensive and can be done most efficiently through automated or semi-automated submission processes. FCAP creation and monitoring can take months and even years and are a critical piece of bringing CWDs into compliance with governing laws and regulations.
IFB 24-3038 Page 2 of 10
While CDSS staff conducts all other aspects of the compliance review remotely, the physical accessibility aspect of the civil rights compliance reviews must be done on site. California is a large and geographically diverse state with remote desert, mountainous and coastal regions along with small and large urban centers, each with impactful seasonal realities. Contractor is expected to travel to multiple facilities within each CWD as needed to meet the annual schedule and to inspect multiple aspects of each facility in the performance of the Scope of Work included in this solicitation.
In 2023, California’s legislature allocated $600,000 in ongoing funding for Contractor-conducted physical accessibility facility reviews as an effective solution to the challenge of conducting the required number of facility assessments given the geographical issues, time-intensive nature of the work, and the level of expertise required. Lodging, food, transportation, and other expenses shall be covered by the Contractor as part of per-CWD pricing and shall not be in addition to the $600,000 budgeted amount. The Contractor shall be experienced in providing physical accessibility assessments of public facilities and have systems in place to make corrective action implementation efficient.
B. Purpose
The purpose of this Agreement is to facilitate reviews of CWDs’ physical accessibility in compliance with federal mandates and in alignment with CDSS’ mission to serve, aid, and protect needy and vulnerable children and adults. Strengthening CDSS’ civil rights oversight of CWDs – particularly ensuring the accessibility of critical county welfare facilities for people with disabilities – supports the vision of a healthy California for all where older and disabled Californians can live with purpose and dignity, and where they are supported and valued.
C. Contractor Responsibilities
Each year Contractor shall conduct facilities assessments for one (1) to four (4) facilities in each of no more than 31 counties for a total of 75 facilities statewide.
Contractor shall:
1. Have on staff, or in combination with subcontractor(s), at least one (1) California-licensed Certified Access Specialist (CASp), a professional inspector licensed by the California Division of State Architect, throughout the Agreement. The CASp staff member(s) shall assist in performing inspection and reporting services.
IFB 24-3038 Page 3 of 10
2. Identify which counties shall be assessed each year according to the required frequency determined by CalFresh caseload. See Sections D.2. - D.5. for caseload-based schedule. As of fiscal year (FY) 2022/23, 31 counties annually are required, but this number is subject to change. Some counties may change size category based on annual caseload differentials. CalFresh publishes caseload data every fall, usually in late September. If CalFresh has not provided caseload data by October 15th of any given year, Contractor shall rely on the previous year’s size identifications for the coming calendar year.
3. Consult with CDSS for final approval of counties each year. If the required number of counties drops based on CalFresh caseload, Contractor shall still be required to assess 75 facilities.
4. Consult with CDSS staff on decisions about Small and Medium county selection.
County selection shall be based on a continual rotation by size, per Section C.2, unless CDSS provides additional input by October 15th preceding the scheduled year. The annual selections shall be made according to the following criteria:
a. Length of time since any physical accessibility compliance review was conducted for the CWD.
b. Complaints which have been raised against CalFresh, CalWORKs (California Work Opportunity and Responsibility to Kids), In Home Supportive Services (IHSS), Child Welfare Services, the CWD’s fraud or special investigations unit, Cash Assistance Program for Immigrants (CAPI), Refugee Cash Assistance (RCA), and/or Trafficking and Crime Victims Assistance Program (TCVAP) in relation to physical accessibility.
c. Geographical diversity including rural and urban locations, northern and southern locations, and locations with varying climate and geographic features (mountainous/ desert/ coastal, etc.)
d. Feedback from community organizations and advocates garnered by Contractor and/or CDSS.
5. Research and identify 75 facilities each year, to be divided among the selected counties, based on a rotation of facilities and in collaboration with CDSS, per the site selection criteria provided in this Section C.5 below. CDSS shall approve the final list of facilities to be audited for physical accessibility. Contractor may conduct research to estimate the size and building features of facilities. CDSS is providing a list of all facilities and their addresses with this solicitation. Facilities may change and Contractor shall research and collect updated information before selecting facilities. Site selection shall be made according to the following criteria:
IFB 24-3038 Page 4 of 10
a. Only facilities which have public facing contact related to CalFresh, CalWORKs, IHSS, Child Welfare Services, the CWD’s fraud or special investigations unit, CAPI, RCA, or TCVAP.
b. Size of the facility as determined by Section D below, which includes specific directions on annual minimums by facility size per CWD (See Sections D.1. - D.5. below).
c. Diversity of facility size, such that annual site selection shall include at least one large facility and one small facility per county unless facility size is not relevant in the County. (For example, because the site is not public facing, or the CWD does not have one of the sizes or subject to rotation requirements in Sections C.5.e. and C.5.f. below.)
d. Geographical diversity including rural and urban locations.
e. A rotation of facilities between years so as to avoid repeating facilities before all facilities for a CWD have been reviewed.
f. Two (2) facilities per small county unless only one (1) is available; two (2) to three (3) facilities per medium county; and three (3) to four (4) facilities per large county, for a total of 75 facilities per year.
6. Identify an approximate workplan for each calendar year of the selected CWDs in consultation with CDSS staff, who shall approve the final workplan. The final workplan shall consider anticipated weather concerns, fire season, CWD preferences, timing of other civil rights audits being conducted that year, and other relevant issues. Workplans may be created to extend beyond a calendar year.
7. Notify each county of which facilities shall be reviewed three (3) months prior to Contractor going on site and after receiving approval from CDSS.
8. Participate in one (1) to four (4) CDSS-organized orientation video meetings, as required by CDSS, with the CWDs who are scheduled for a general audit during an upcoming calendar year (usually between December and February but may occur at different points through the year).
9. Conduct a kickoff/ introductory meeting with each selected CWD to explain what the facilities assessment process shall entail and answer CWD questions.
10. Travel as needed to meet the annual facility assessment schedule.
IFB 24-3038 Page 5 of 10
