About this file
This is a Specification document prepared by the Minneapolis Department of Public Works, Division of Water Treatment & Distribution Services, for Bid Event 4368 for the procurement of fluosilicic acid. The City of Minneapolis is soliciting bids for approximately 275 tons of liquid fluosilicic acid product (approximately 23% by weight as H2SiF6) to be used for fluoridating the water supply over a twelve-month period. The material must conform to the latest revision of AWWA Standard B703 and possess certification by an accredited organization in accordance with ANSI/National Sanitation Foundation (NSF) Standard 60. Deliveries will be accepted Monday through Friday after 7 a.m., with off-loading to be completed by 3:00 p.m., at two designated locations: the Fridley Filtration Plant at 4500 Marshall Street NE and the Columbia Heights Membrane Plant at 4500 Reservoir Boulevard NE, both in Minneapolis.
Bids will be based on dollars per ton of 23% H2SiF6 solution delivered by tank truck (approximately 4,000-gallon capacity) on an F.O.B. basis. Payment will be calculated on a tonnage basis adjusted according to the Certificate of Analysis submitted with each load; if the delivered product assay falls outside the range of 22% to 25% H2SiF6 by weight, the tonnage will be adjusted proportionally for payment purposes. Strict security protocols are required for all deliveries, including advance notification with driver CDL numbers, seal numbers, vehicle identification, and bill of lading information; all drivers and passengers must stop at a designated staging area for pre-screening with government-issued photo identification, and delivery vehicles are subject to search. The City reserves the right to request price adjustments, with increases not to exceed 10% and only one increase permitted during the contract period, provided documented evidence of extenuating supply chain circumstances is submitted to the Minneapolis Procurement Office no sooner than 60 days from the contract start date. Invoices must reference the City Purchase Order number and be submitted electronically when possible, with payment made within 30 days of receipt and final inspection acceptance.

SPECIFICATIONS FOR FLUOSILICIC ACID
Minneapolis Division of Water Treatment & Distribution Services Minneapolis, Minnesota
1. GENERAL
Bids are requested for approximately 275 tons of liquid fluosilicic acid product (approximately 23% by weight as H2SiF6) to be used for fluoridating the water supply of the City of Minneapolis for a twelve-month period. The material to be supplied, the handling, packing, shipping and testing thereof, except where otherwise herein specified, shall all conform to the latest revision of AWWA Standard B703. The material shall also possess certification by an accredited organization in accordance with ANSI/National Sanitation Foundation (NSF) Standard 60.
2. SECURITY PROVISIONS
The Minneapolis Water treatment complexes are secure facilities with controlled access. The following delivery practices are required for security reasons. Failure to follow these practices could result in police being summoned to City facilities or forfeiture of vendor’s contract to supply the City with chemicals.
Before any deliveries are made, the successful bidder will be required to furnish to the City a list of driver names delivering chemicals to City facilities. The list will include driver CDL numbers.
All chemical shipments (rail or truck) will leave the chemical vendor’s facility with security seals on the valves and openings into the product storage vessel. The seals will only be broken or removed in the presence of City staff at City facilities before unloading. If the seals are broken or tampered with before delivery, or without City staff present, the chemical shipment will be refused.
Before a delivery to City facilities is accepted, staff must be in receipt of an email from the vendor containing the following information. If an email has not been received, or the delivery driver is different from the information, the shipment will not be received until verification or authenticity can be established by City staff.
Vendors will email the following information before truck arrives on site:
• Driver name and CDL number and license photo
• Passenger(s) name, if any
• Seal numbers
• Tractor #
• Trailer #
• Bill of lading #
All drivers and passengers must stop at the City-designated staging area for pre-screening. No access is allowed until pre-screening process is complete.
• The pre-screening process requires all drivers and passengers to submit government issued photo identification.
• No weapons allowed on site unless they are secured (locked up) in the vehicle.
• Pets must remain in the vehicle or be on a leash at all times.
• Delivery vehicles are subject to search by City staff or City’s security personnel
• Visitor badges will be issued to drivers delivering to the Fridley Filtration Plant.
3. DELIVERY
Shipments shall be on order of the Water Treatment Plant Supervisor for the City. The supervisor shall provide the Supplier with a City of Minneapolis Purchase Order (PO) number. This PO number must be on each invoice subsequently submitted.
Deliveries will be accepted Monday through Friday after 7 a.m. and off-loading must be completed by 3:00 p.m. Material shall be delivered F.O.B. by tank truck of approximately four thousand (4,000) gallon capacity to the following locations:
a. Fridley Filtration Plant
4500 Marshall Street NE Minneapolis, MN 55421 (Note that delivery entrance is located at 4100 E. River Road) Email: anthony.thompson@minneapolismn.gov
b. Columbia Heights Membrane Plant
4500 Reservoir Boulevard NE Minneapolis, MN 55421 Email: eric.pederson@minneapolismn.gov
Prior to or upon delivery the Supplier shall furnish a certificate of analysis for each load of product delivered documenting the weight percent H2SiF6.
Weights on each bill of lading showing the full load (gross) and empty truck (tare) must be weighed on a certified truck scale.
• Driver shall remain at fill station throughout the unloading process and monitor the unloading process.
• Driver shall wear the appropriate protective face and body apparel, as required by the Occupational Safety and Health Act, when unloading the product.
• Driver will ensure that the pipe and valve system at the plant used for off-loading is clear after delivery.
• The supplier shall be responsible for cleanup of any spills resulting from the delivery or occurring during unloading of the product.
4. SAMPLING
Upon request of City personnel, the Supplier’s delivery driver shall take a sample of the liquid fluosilicic acid in the presence of City staff at the time of delivery. Testing of the sample will be performed by City staff to determine the specific gravity of the chemical and other parameters as needed. Driver will allow City personnel 15 minutes to examine sample and perform testing before unloading.

5. QUALITY
The material as delivered shall be twenty-three (23) percent H2SiF6 by weight, plus or minus three
(3) percent. The contractor shall furnish a certified copy of the analysis prior to or with each shipment upon delivery. See Part 8 regarding adjustment of payment based on content H2SiF6.
6. BIDS
Bids will be based on dollars per ton of twenty-three (23) percent (by weight) solution of H2SiF6 delivered by truck to the above-listed plant sites.
7. SUBMITTALS
Prior to contract award, successful bidder shall submit the following documentation for the product to be furnished:
a) Statement naming manufacturer and address (City, State) of the product proposed to be furnished.
b) Proof of ANSI/NSF Standard 60 certification.
c) Data sheet or Certificate of Analysis documenting the product’s concentration (weight percent as H2SiF6), specific gravity of product, free acid, and impurities.
d) Globally Harmonized System Safety Data Sheet.
e) Copy of certificate of scale(s) used to establish gross and tare weight on each bill of lading.
Current scale certification shall be re-submitted throughout the duration of the contract.
8. PAYMENT
Payment for each shipment will be on the tonnage basis of a twenty-three (23) percent by weight solution of H2SiF6. Vendor invoice shall include the City of Minneapolis Purchase Order number.
If the Certificate of Analysis submitted with each load indicates the assay weight percentage of the delivered H2SiF6 is more than twenty-five (25) percent or less than twenty-two (22) percent, the actual tonnage of each shipment will be adjusted according to the analysis to reflect the equivalent tonnage of a solution. This calculation will be shown on each invoice. Payment will be made on the equivalent tonnage thus calculated.
For example, if the bid price is $300 per ton of 23%W delivered, and 20.5 tons of 21.5%W is delivered, payment would be as follows:
$300 X 20.5 tons X 21.5/23.0 = $5,748.91
9. SUPPLY CHAIN PRICE ADJUSTMENT
In the event of increases in the contractor’s costs due to extenuating and not reasonably foreseeable circumstances, including but not necessarily limited to industry-wide or regional supply chain price increases or substantial increases in operational costs, the City may consider a request for increase in unit price made during the contract period. In order for requests and accompanying documentation to be considered, they must be submitted to the City of Minneapolis Procurement Office for consideration. The exact amount of escalation, if any, will be determined based upon the City’s sole judgment of the validity of the documentary evidence submitted. No price increase will be effective unless approved by the City of Minneapolis Procurement Office. The amount of any increase shall not exceed ten (10) percent. Requests for price increases shall be made no sooner than 60 days from the start of the contract period, and no more than one increase will be granted. The City will notify the Supplier in writing if the request for price increase has been accepted and will document the price adjustment in that notification.
10. RIGHTS RESERVED
The City of Minneapolis reserves the right to accept or reject any or all bids as the interest of the City might require.
11. INVOICE AND PAYMENT
All work requested under this Contract shall be placed on a City issued Purchase Order.
Contractor shall make all reasonable efforts to submit invoices and documentation in an electronic format, such as PDF or other format compatible with City software capabilities, in lieu of paper invoices and documentation, when so requested by City.

The Contractor shall provide complete cooperation during any such investigation.
The City will not pre-pay for service. All bills shall state the location and dates of service being billed. All fees, taxes, charges, surcharges, and revenue payments are to be itemized.
