About this file

This is a Request for Proposal (RFP) issued by the State of Minnesota Department of Administration for ordering services to be provided to the Minnesota Sex Offender Program (MSOP), a Direct Care & Treatment agency operating two secure facilities located in St. Peter and Moose Lake, Minnesota. The MSOP seeks a contractor to provide electronic ordering services and products for approximately 750 civilly committed clients (450 at Moose Lake, 300 at St. Peter) who collectively placed over 200,000 orders in 2023-2024 across more than 600 available items including over-the-counter medications, hygiene products, food and beverages, clothing, and electronics. The contractor must supply and maintain 25+ kiosks (12 mobile cart units for Moose Lake and 13 for St. Peter), provide all associated software and maintenance, and ensure individual packaging of orders in clear plastic bags with invoices. The response deadline is August 5, 2026, at 3:00 PM Central Time, with the anticipated contract term running from November 1, 2026, to October 31, 2028, with options to extend an additional 36 months in State-determined increments. The contractor must work cooperatively with Minnesota State Services for the Blind vending operations and cannot offer products identical to those sold through SSB vending machines, except for bulk, multi-pack, or larger-sized products unavailable in vending machines.

The estimated annual contract value is $300,000 to $500,000, though this represents neither minimum nor maximum obligation. Clients have a $140 weekly spending limit, and in 2023-2024, MSOP clients spent in excess of $1.1 million. The contractor bears all costs for the electronic ordering system, kiosk acquisition and building, maintenance, and software upgrades. Responses will be evaluated on a 1,000-point scale plus up to 120 preference points, with primary evaluation factors including acceptance of State terms (300 points), work and transition plans (50 points), technical questions response (150 points), VPAT accessibility documentation (100 points), ability to provide products from the wish list (50 points), and cost proposal (350 points). Preference points are available for certified Targeted Group, Economically Disadvantaged, Veteran-Owned, and DEED/DCT providers. All responses must be submitted through the SWIFT Supplier Portal; fax, email, and printed responses will not be accepted. Questions must be submitted by July 20, 2026, and the State anticipates completing evaluation and selection by October 31, 2026.

Minnesota’s Commitment to Diversity and Inclusion The State of Minnesota is committed to diversity and inclusion in its public procurement process. The goal is to ensure that those providing goods and services to the State are representative of our Minnesota communities and include businesses owned by minorities, women, veterans, and those with substantial physical disabilities.

Creating broader opportunities for historically under-represented groups provides for additional options and greater competition in the marketplace, creates stronger relationships and engagement within our communities, and fosters economic development and equality.

To further this commitment, the Department of Administration operates a program for Minnesota-based small businesses owned by minorities, women, veterans, and those with substantial physical disabilities. For additional information on this program, or to determine eligibility, please call 651.201.2402 or go to the Office of Equity in Procurement home page, at https://mn.gov/admin/business/vendor-info/oep/.

SPECIAL NOTICE: This is a request for proposal. It does not obligate the State of Minnesota to award a contract or complete the proposed program, and the State reserves the right to cancel this solicitation if it is considered in its best interest.

This Solicitation requires proposals to be submitted through the SWIFT Supplier Portal. Please note the security changes below that may impact responders from submitting a timely response.

SWIFT SUPPLIER PORTAL SECURITY CHANGES

There are new security measures that the Minnesota Management and Budget implemented on October 16, 2022. It is a new multi-factor authentication (MFA) to enhance the security of the State of Minnesota Supplier Portal. MFA is an authentication method that requires bidders and suppliers provide two verification factors to log into the SWIFT Supplier Portal. The goal of MFA is to create a layered defense that makes it more difficult for unauthorized system access to occur.

For information about these changes, please refer to the SWIFT Supplier Portal Multi-Factor Authentication FAQ document.

If you have not done so already, please make sure to log into the SWIFT Supplier Portal as soon as possible to get this authentication set up early so there are no issues when submitting a response to an RFP.

You are strongly encouraged to set your MFA during business hours of 8:00 A.M. to 4:00 P.M., Central Time, Monday through Friday. You may experience delay setting your MFA after hours.

SECTION 2 – SUMMARY OF SCOPE

Procurement Overview and Goals.

This Request for Proposal (RFP) describes a relationship to be established between Direct Care & Treatment (DCT) and a Responder to provide ordering services and products, on an as needed basis, for clients committed to the Minnesota Sex Offender Program (MSOP) located at these two locations:

• 100 Freeman Drive, St. Peter, Minnesota, 56082

• 1111 MN-73, Moose Lake, Minnesota, 55767

The RFP also specifies contractual conditions and details the basis for the responses, the subsequent review, and the final selection process.

Background.

The MSOP is an agency within Direct Care & Treatment (DCT) operating two secure facilities. The clients are civilly committed by the courts to complete treatment at the MSOP. By and large, the clients come from the Minnesota Department of Corrections (DOC) subsequent to serving their prison sentence within a DOC facility.

The MSOP has two campuses located at Moose Lake and Saint Peter, Minnesota. The MSOP has approximately 450 clients at our Moose Lake facility and another 300 clients at our Saint Peter facility. In 2023 and 2024, MSOP clients placed over 200,000 orders. Over 600 items were available for purchase ranging from over the counter medications, hygiene/health care, snack/soups/dinner foods, beverages, clothing and electronics. The MSOP clients have a $140 weekly spending limit. In 2 years (2023-2024) MSOP clients spent in excess of 1.1 million dollars.

An electronic ordering system for the ordering services is required with Contractor provided kiosks on each MSOP living unit strongly preferred. All costs of the electronic ordering system will be the responsibility of the Contractor, including but not limited to the purchasing/building of 25+ units (12 kiosks on a Mobile Cart for Moose Lake and 13 kiosks for St.

Peter/CPS), continued maintenance, and software upgrades. All products available to be ordered by MSOP must be processed through Kiosks.

These items must meet program security considerations. Each client order is to be delivered to the corresponding facility individually packaged in a clear plastic bag with two invoices.

Minnesota State Services for the Blind (SSB) within the Minnesota Department of Employment and Economic Development (DEED) operate vending machines within Minnesota Sex Offender Program (MSOP) facilities. The responder selected for the MSOP Ordering Service Contract agrees to work cooperatively with SSB and DEED. It is essential to the success of SSB at the MSOP facilities that their vending machine offerings are not subject to direct competition from identical products (same brand, size/quantity). Therefore, the ordering service may not offer identical products as are sold through SSB vending machines at MSOP facilities, except that the successful responder to the RFP may sell bulk, multiple, multi-pack, and/or larger-sized products that are not available in vending machines operated by

SSB.

The MSOP will, with the successful Responder and SSB, develop processes in order to prevent direct competition and to resolve disputes when direct competition is alleged.

Sample Tasks and Deliverables.

See Exhibit C, Specifications, Duties, and Scope of Work. This exhibit will be completed based on awarded Responders work plan and response to Attachment H, Mandatory Requirements and Desirable Capabilities.

SECTION 3 – PROPOSAL INSTRUCTIONS AND ADDITIONAL INFORMATION

Anticipated Contract Term.

The term of this contract is anticipated to be from November 1, 2026, to October 31, 2028, with the option to extend up to an additional 36 months in increments determined by the State.

Estimated Amount.

The estimated total dollar value of the contract for one year is $300,000 to $500,000 annually. However, this shall not be construed as either the minimum or maximum amount. It shall also be understood and accepted by the responder that any quantities shown in this solicitation are estimated quantities only and impose no obligation upon the State either minimum or maximum.

Question and Answer Instructions.

All questions should be submitted no later than the date and time listed in Section 1, Instructions to Responders. The State is not obligated to answer questions submitted after the question due date and time.

Only personnel listed above are authorized to discuss this solicitation with responders. Contact regarding this solicitation with any personnel not listed above could result in disqualification. This provision is not intended to prevent responders from seeking guidance from state procurement assistance programs regarding general procurement questions.

If a Responder discovers any significant ambiguity, error, conflict, discrepancy, omission, or other deficiency in the solicitation, please immediately notify the contact person detailed above in writing of such error and request modification or clarification of the document.

Additional Tasks or Activities.

Responders are encouraged to propose additional tasks, activities, or goods above and beyond the scope of what is requested in this solicitation if they will substantially improve the results of this procurement. Any costs associated with these additional tasks, activities, or goods should be clearly marked and separated from costs associated with the tasks, activities, or goods specifically requested under this solicitation. Because cost is a factor in the evaluation of responses to this solicitation, failure to separate costs for additional tasks, activities, or goods may result in those costs being included in a responder's cost proposal and result in a lower cost score for that proposal.

Dispute Resolution Procedures.

Any issue a responder has with the RFP document, which includes, but is not limited to, the terms, conditions, and specifications, must be submitted in writing to the contact person for this solicitation prior to the solicitation opening due date and time. Any issue a responder has with the Contract award must be submitted in writing to the contact person for this solicitation within five business days from the time the intent to award or the Contract award date is made public. This public notice may be made by any of the following methods: notification by letter or email, posted on the OSP website, https://mn.gov/admin/osp/, or electronic notification by our electronic procurement system, SWIFT. The State will respond to any protest received that follows the above procedure. For those protests that meet the above submission requirements, the appeal process is, in sequence: the contact person for this solicitation, the Office of State Procurement (OSP) Acquisitions Manager, and the OSP Director.

SECTION 4 – PROPOSAL CONTENT

Please submit the following information:

1. Work/Transition Plan. Responder should provide a description of the installation, set-up, and maintenance of kiosks or alternative electronic ordering system to be provided by the Responder along with a detailed work plan and transition plan that identifies the major tasks to be accomplished and be used as a scheduling and managing tool.

2. Specifications. Responder must offer goods that meet the product specifications detailed in Exhibit D: Price Schedule attached to the Sample Contract. The State will consider responses for brands that have comparable quality, style, and performance characteristics unless a particular brand is specifically requested in the Exhibit D: Price Schedule.

3. References. Responder must complete and submit “Attachment F: Reference Form” with their response.

References must include 3 projects from clients for whom the bidder supplied similar products and services.

Responder may add additional Reference Forms if needed. Responder should answer every question and provide all information requested on the reference form. The State reserves the right to verify the information submitted on Attachment F before an award is made. The State reserves the right to contact the references listed in Attachment F.

The solicitation response will be rejected if the State, in its sole discretion, receives information that indicates the responder is non-responsible or non-responsive.

4. Accessibility of Services or Products. The responder should complete, in an accessible format, a VPAT® 2.5 INT (April 24, 2025) for all software, hardware, and websites (as applicable) as proposed in response to the solicitation and attach it to the proposal as Attachment H. Vendors can use the VPAT form from the ITIC VPAT site. Vendors should complete the Section 508 and WCAG 2.1A and AA sections. The EN 301 549 section can be left blank or deleted. For systems with multiple interfaces (such as an admin and user interface), report on each interface whether in the same or separate VPATs. These documents may be scored according to the solicitation evaluation.

Responders are encouraged to reference the “Vendor VPAT Guidance” in the “Products” tab on the Accessible IT Procurement page (http://mn.gov/mnit/programs/accessibility/it-procurement.jsp) for information and instructions on completing the VPATs. Respondents should also review the related guidance documents on the same site for solicitation reviewers to understand expectations. The responder is strongly encouraged to provide remarks and explanation that both support compliance and detail any deficiencies, as even if you claim “supports” unless there are remarks and explanations, you may score low.

5. Cost Detail. Review Attachment C, “Cost Proposal,” attached to this solicitation, and complete and submit Exhibit D Price Schedule, attached to the Sample Contract.

5.1 The Price Schedule includes necessary and popular products that are currently being purchased by the Minnesota Sex Offender Program (MSOP) for its canteen operations. Brand or trade names referred to in the Price Schedules are for identification purposes only and do not limit the responder to such brands provided alternates offered are equal in quality and function to those specified and are approved by the MSOP, Property and/or Security Committees.

Descriptive literature that contains complete specifications must be included with the alternate product that is proposed.

5.1.1 Price Schedule A: The Responder(s) are encouraged to submit pricing for products on Price Schedule A “Must have Products”. If the product is labeled “No Substitute” or “No Change in Current Size Allowed”, then the Responder(s) must only provide that product; however, if this product is not available by the Responder(s) then the Responder(s) may leave the submission details blank or label it “n/a”.

5.1.1.1 Responders must also provide a catalog or list of products NOT listed in Price Schedule A, B and C. This price list must list the MSOP Contract Price per Unit Size proposed. This price list may include non-consumable canteen products that are available, including but not limited to:

electronics (e.g. televisions, stereos, headphones, video game systems, etc.); clothing items (e.g.

shoes, shirts, pants, etc.); media items (e.g. CDs, DVDs, Blu-rays, etc.); over the counter medications (e.g. ethnic hair care products, aspirin, contact solution, ibuprofen, etc.); medical devices (e.g. braces, bandages, sleeves, etc.); office supplies (e.g. paper, pens, markers, etc.);

and hobby items (e.g. yarn, paints, thread, etc.). Responders must submit a full product Price List with their response.

5.1.2 Price Schedules B and C: The products on B and C are to be submitted including as many products on those price schedules that can be provided by the Responder(s).

6. Sample Transaction Documents. Prior to award, a potential successful Responder must submit samples of any transaction documents proposed for use under the resulting contract. The State will review the transaction documents to ensure they contain sufficient detail and to review additional terms and conditions contained therein, if any. The State reserves the right to request additional detail in the transaction documents or to reject additional terms and conditions within transaction documents. Once approved by the State, Contractor may not materially change transaction documents unless a change has been approved in writing by the Commissioner of Administration, as delegated to the Office of State Procurement. Any terms and conditions included in transaction documents but not approved by the State are voidable by the State. Any terms and conditions that are in conflict with Minnesota law or in conflict with the terms of the State Contract are void. Failure to void a non-approved term or condition included in a transaction document does not waive the State’s right to void any non-approved term or condition.

7. Product Documentation. Responder must provide equipment sales literature, technical data or specifications, a user manual, or other documentation about the product upon request by the State, and at no cost to the State. Product documentation should include items such as, but are not limited to, product information, product functionality, and operation instructions. Product documentation may be provided digitally unless the State requires the documentation be provided in print.

8. License Agreements, Maintenance Agreements, or Other Terms and Conditions. The State may require Responder to provide any license agreements, maintenance agreements or any other terms and conditions relevant to the work under a resulting contract. Review and approval by the State will be required prior to contract execution. In the event Responder fails to comply with a request under this provision, Responder agrees that it will not seek to enforce terms and conditions of any such agreement against the State. Further, failure to provide any of the pertinent documents upon request may result in the State not agreeing to sign any additional documents, rejecting your response, or cancelling the award.

Submit all requested documentation, including, but not limited to, the following documents:

1. Attachment A: Responder Declarations

2. Work/Transition Plan (See Item #1 above)

3. Attachment B: Exceptions to State's Standard Terms and Conditions

4. Attachment D: Responder Forms

All specifications are for new items unless otherwise noted in the solicitation.
