About this file

This document is an Addendum to the Request for Qualifications (RFQ) 701-23-017 issued by the Texas Education Agency (TEA) for the Production of Accessible Electronic Files for Texas Public Schools. The RFQ seeks qualified contractors to produce master files in braille-ready format (BRF) from instructional materials adopted by the State Board of Education (SBOE) under Proclamation 2024, as well as future SBOE-approved materials and TEA-developed open education resources. The addendum addresses various questions from potential bidders, including insurance coverage requirements, the treatment of ELPS citations and TEKS references, anticipated page counts, and the distribution of work among awarded vendors. TEA indicated that it may award one or more contracts from this solicitation.

The RFQ does not require pricing information upfront, but contractors are expected to submit a Task, Activity, Deliverable, and Budget Plan with their proposals. The contract work will be distributed among awarded vendors based on subject area, evaluation ranking, and available capacity. The contract term and any renewal options were not specified in the provided information.

Texas Education Agency RFQ 701-23-017 Production of Accessible Electronic Files for Texas Public Schools

Addendum 2, December 15, 2023

This addendum incorporates the following changes to the above-referenced solicitation:

I. Questions - The following questions and associated responses are hereby incorporated into the above-referenced solicitation:

1. QUESTION: In Attachment B, Contract Terms: Minimum Required Amounts of Insurance Coverage, Types of Insurance:

Technology/Professional Liability Insurance, and Intellectual Property Infringement, and Data Protection Liability Insurance (Cyber Liability), Statutory Limits is $5,000,000. Is this negotiable? We currently have $3,000,000.00 and wanted to see if this would be ok and have the contract to reflect the $3,000,000 or if the $5,000,000 mandatory?

TEA RESPONSE: TEA does not require vendors to change any thresholds of insurance coverages during the solicitation process until the awarding of the contract. Vendors are also allowed to identify any exceptions they have to the Terms and Conditions and the negotiation of those exceptions would take place during contract development.

2. QUESTION: Are ELPS citations part of TEKS? Should these be omitted along with the TEKS?

TEA RESPONSE: Proposers may omit any English Language Proficiency Standards (ELPS) citations when producing the sample materials.

3. QUESTION: Can we please see a list of books (titles) and page counts for Proclamation 2024, for which the first six volumes will need to be transcribed by June 10, 2024?

TEA RESPONSE: The report titled Proclamation 2024 List of Materials Adopted by SBOE may be viewed on the TEA website, or on the Proclamation 2024 page, along with a link to the sample materials. Please note that this list contains digital materials as well as print and only the print materials will be produced in braille. TEA will post anticipated page counts in Addendum 3, as soon as we have that information available.

4. QUESTION: How many books are part of the Proclamation?

TEA RESPONSE: The report titled Proclamation 2024 List of Materials Adopted by SBOE may be viewed on the TEA website, on the Proclamation 2024 page, along with a link to the sample materials. Please note that this list contains digital materials as well as print and only the print materials will be produced in braille.

5. QUESTION: What are the anticipated page counts for input and output pages for Proclamation 2024?

TEA RESPONSE: TEA will post anticipated page counts in Addendum 3, as soon as we have that information available.

6. QUESTION: For this RFQ, will TEA be awarding to multiple vendors? If awarded to multiple vendors, will there be specific vendors for each subject matter area, including Proclamation 2024?

TEA RESPONSE: TEA may award one or more contracts from this solicitation. Distribution of scheduled contract work for awarded vendors will be by school subject, evaluation ranking, and available capacity of the vendor.

7. QUESTION: Please confirm that pricing information is not required with submission of an RFQ response and that a contractor’s budget plan will be negotiated once a contractor is TEA-qualified?

TEA RESPONSE: Each contractor will be evaluated solely on the firm’s experience, technical competence, capability to perform, past performance, and other relevant factors submitted in the response to this RFQ. Please note that while TEA will not be evaluating a budget plan during the qualification of each proposal, contractors are required to submit a Task, Activity, Deliverable, and Budget Plan with their proposal as described in Section 3.4.

8. QUESTION: The Science textbook contains pages that are meant to be cut out by a sighted student. Is the partially sighted or blind student expected to do the same with the braille version of the textbook? This will affect how we format the braille for this book?

TEA RESPONSE: In the science sample materials, proposers may omit or modify any directions that are meant for sighted students, such as directions to cut pages out of the workbook.

9. QUESTION: Should just the word TEKS be omitted or should the entire section/sentence that references TEKS be omitted?

TEA RESPONSE: In introductory sections, there may be references to the TEKS. Proposers may omit the references to specific TEKS, including lists of TEKS and any tables, charts, sidebars, or sections that are specifically meant to provide TEKS correlations. An example is the TEKS chart on page 495 of the social studies sample. However, a reference to the TEKS within the body of a sentence should not be omitted.

[Solicitation Type] 701-2_-___, Addendum _ 2

10. QUESTION: Should we follow the source file text or the received text in the RFP? Example: the title of the source file for the Foreign Language sample has a number 1 on the title page but the RFP text contains the letter I (Texas Auténtico Level 1 vs Texas Auténtico Level I)?

TEA RESPONSE: If there are any discrepancies between the description on the RFQ and the source files, please defer to the source file text.

11. QUESTION: Should a ToC be included for the sections being transcribed even if the pages weren’t requested in the RFQ?

TEA RESPONSE: Yes, if a Table of Contents would typically be provided to students receiving the volume, please include it in the sample volumes.

12. QUESTION: What is the anticipated number of tactiles for Proclamation 2024?

TEA RESPONSE: The number of tactiles will depend upon the individual titles; we do not have a specific count, as that is not part of the information that publishers are required to provide during the SBOE’s review and adoption process. Proposers may wish to access the Proclamation 2024 Pre-Adoption Samples on the TEA website to view the materials that are scheduled to be included in Proclamation 2024.

II. TEA will post Addendum 3 to address any outstanding questions that require additional research by the deadline date list in the RFQ.

III. All other provisions of the solicitation remain the same.
