About this file

This document is an amendment to a solicitation (RFP 696-PF-22-P024) issued by the Texas Department of Criminal Justice (TDCJ) for the operation and management of a multi-use facility providing various rehabilitation treatment services. The amendment revises the pricing schedule and list of exhibits, including updated staffing plan and budget justification forms for the Substance Abuse Felony Punishment Facility (SAFPF) Special Needs program, Driving While Intoxicated (DWI) Recovery program, Intermediate Sanction Facility (ISF) Substance Use Treatment Program (SUTP), and ISF Cognitive Intervention Program (CIP).

The pricing schedules provide per diem rates for operation and management services based on bed counts, as well as per diem rates for the rehabilitation treatment services programs. Offerors must provide pricing for both the full capacity and tiered bed count scenarios. The exhibits provide detailed staffing plans and budget justifications for the treatment services programs. Offers must be submitted by the revised due date, and the contract term is five years with three one-year option periods.

Amendment A-002

Questions and Answers:

Question #1: Section - B.2 Pricing Schedule

Question #1A: B.2.1 Pricing Schedule A – is it the department’s intent that we price and staff at 100% for Operations and Treatment on Pricing Schedule A? Can we change the inmate population to reflect the average inmate population over the last year?

Answer #1A: Yes, Pricing Schedule A is for the per diems for full capacity as indicated.

No, Pricing Schedule B is for the per diems based on the designated beds/bed ranges and cannot be changed.

Question #1B: B.2.2 Pricing Schedule B – is it the department’s intent that we price Operations at 1,632, 1,633-1,901, and 1,902-2,236. Note: The Treatment is priced and staffed at the 100% for each Treatment Service.

Shouldn’t the Treatment beds also adjust like the Operations beds so we can staff them with the ratios? Currently, it seems that Treatment will be priced at 100% of 2,236, and the Operations will be based on a sliding scale. Is this correct?

Answer #1B: No, treatment staffing and per diems are based on 100% capacity. The Department will continue to provide consideration on billing for treatment staff based on census and ratios.

Question #1C: Can we have the option to fill out A or B, or do we have to fill out both B.2.1 Pricing Schedule A and B.2.2 Pricing Schedule B? If so, do we have to fill out Exhibit J.1.A and Exhibit J.1B Staffing Plan and Budget Justification?

Answer #1C: No, proposals must include both Pricing Schedule A and Pricing Schedule B.

Question #2: Exhibit J.1.A only reflects B.2.1 Pricing Schedule A for the 100% Operations and Treatment. Do we need to adjust these forms for B.2.2 Pricing Schedule B (i.e., Three separate J.1.A’s for each population level, J.1.A Budget Justifications, Exhibit J.1.B Staffing Plans, and Exhibit J.1.B Budget Justifications)?

Answer #2: No, exhibits are not to be adjusted or modified. Proposals should only include one Exhibit J.1.A, Staffing Plan and Budget Justification Forms, and one Exhibit J.1.B, Staffing Plan with one Exhibit J.1.B, Budget Justification Form per each program.

Question #3: In reference to C.4.2 Staffing, R., Page 26 - Will the department accept one basic drawing of the facility that details color-coded Security Staff positions/posts at the full operational capacity of 2,236 beds (i.e., reflecting the 100% Staffed Operation and Treatment of Exhibit J.1.A)?

696-PF-22-P024

Answer #3: Only one basic drawing is necessary and required. The expectation of the Department is for these positions to be filled regardless of population fluctuations, unless beds are officially idled by the Department.

Therefore, please adjust per diems accordingly.

Question #4: Will TDCJ require direct treatment staff titles to be designated by program on the PCN/Exhibit J.8 reports (i.e., Substance Abuse Counselor – SN)?

Answer #4: Yes, this will allow the Department to reconcile all documents that reference staff positions, such as Exhibit J.1, Exhibit J.8, and Exhibit J.9.

Question #5: The number of beds on the forms are broken down as follows:

B.2 Pricing Schedule A & B - Rehabilitation Treatment Services

Substance Abuse Felony Punishment Facility Special Needs 672

Driving While Intoxicated Recovery Program 500

Intermediate Sanction Facility Substance Use Treatment Program 952

Intermediate Sanction Facility Cognitive Intervention Program 122

Exhibit J.1.B Staffing Plan and Budget Justification

SAFPF/IPTC/SAFPF Special Needs - 672

DWI 500

ISF CIP / SUTP 1,064

In order to develop pricing for B.2 Pricing Schedule A and Pricing Schedule B, do the totals for the ISF SUP (952) and the ISF CIP (122) need to be combined to match the current Exhibit J.1.B Staffing Plan and Budget Justification forms? If not combined (1,064), will TDCJ be providing additional Exhibit J.1.B Staffing Plan and Budget Justification forms to address ISF SUP (952) and ISF CIP (122)? Since staffing should be combined to operate these programs, we recommend the pricing schedule forms A & B be revised to match the operational staffing requirements. Please advise.

Answer #5: The treatment programs are not interchangeable and should not be combined. A revised Exhibit J.1.B is included with this Amendment.

Please note, ISF CIP is 112 beds rather than 122 beds.
