About this file

This document is a Supplementary General Conditions attachment for the Trinity 242T CCEL Office Buildout project in Texas, outlining specific insurance and damages requirements for the contractor. The contract requires the contractor to obtain and maintain umbrella liability insurance during the contract term in an amount equal to 100 percent of the total awarded contract sum, including any selected alternate pricing. The umbrella policy must provide coverage at least as broad as the primary liability coverages, apply in excess of those coverages, and include "drop down" coverage provisions to address situations where underlying primary insurance limits are insufficient or exhausted.

The document establishes liquidated damages at $300.00 per day, which represents the predetermined compensation for contractor non-performance or delay. This rate serves as the agreed-upon daily penalty assessment should the contractor fail to meet contractual obligations or timelines, eliminating the need for the contracting entity to prove actual damages resulting from delays or deficiencies.
