About this file

This is a Warranty and Complaint Resolution Form submitted by the Texas Health and Human Services Commission for the procurement of Coca Cola products for the Mexia State Supported Living Center under IFB HHS0017871. The contract period runs from September 1, 2026, through August 31, 2027, with renewal options available. The form serves as a binding agreement that must be submitted with the vendor's bid and requires certification by a company officer with authority to enter into fiscal and legal contracts on behalf of the organization.

The warranty and complaint resolution requirements establish specific performance standards and financial accountability measures. Vendors must guarantee product compliance with all contractual requirements and commit to resolving complaints within 90 days, including provision of a point of contact, root cause analysis, corrective and preventive actions, and reimbursement or product replacement as agreed by HHSC. Associated investigation costs borne by the contractor include storage costs beginning on the tenth day after vendor notification, HHSC employee time at $20 per hour beginning 30 days after notification, sample and shipping costs, and third-party laboratory testing at an FSIS-approved facility. If delivered products are found to be non-specification in any part, the entire shipment will be reimbursed or replaced without regard to production run dates. Vendors must respond to problem notifications within 72 hours, and failure to meet resolution standards or timeframes may result in vendor tracking reports and discontinuation of HHSC food awards to both the vendor and manufacturer.
