About this file

This is a Special Terms and Conditions document from the Texas Commission on Environmental Quality (TCEQ) outlining insurance requirements for vendors performing work on TCEQ-controlled or occupied premises. The document establishes mandatory insurance coverage provisions that vendors, their employees, agents, and subcontractors must maintain throughout contract performance. Vendors are required to maintain commercial general liability insurance in reasonable limits and worker's compensation coverage for all employees performing contract work on TCEQ premises, either through insurance policies or qualified self-insurance programs as permitted by law.

The insurance policies must include specific provisions naming TCEQ and its officers and employees as additional insureds on the Commercial General Liability Insurance policy. Additionally, vendors must provide a waiver of subrogation in favor of TCEQ, its officers, and employees for bodily injury including death, property damage, or any other loss arising from the contract. These insurance requirements are binding conditions of the contractual agreement and must be maintained throughout the contract term to ensure protection and risk mitigation for the state agency.
