About this file
This document is a comprehensive guide issued by the Texas Facilities Commission (TFC) Office of Business Opportunities detailing subcontracting plan requirements for respondents to state and local contract solicitations in Texas. The instructions establish two methods of compliance: self-performing, wherein respondents fulfill the entire contract scope with their own employees, supplies, materials, and equipment; and good faith effort solicitation, which requires respondents to solicit a minimum of two Veteran Heroes United in Business (VetHUB) certified vendors for each identified subcontracting opportunity, allowing a minimum of seven business days for vendor responses before plan submission. Respondents must submit completed subcontracting plans by the posted solicitation deadline through the Open Gov platform, with TFC offering a courtesy review upon request submitted no later than three business days before the deadline. The document outlines six mandatory sections: respondent information collection, declaration of compliance method, affirmation statements, identification of subcontracting opportunities with NIGP codes and estimated percentages, documentation of good faith solicitation efforts, and final respondent affirmation with required signatures.
Incomplete subcontracting plans lacking required signatures, supporting documentation, or responses to specified questions will result in disqualification from the solicitation. All respondents, including those certified as VetHUBs, must submit a subcontracting plan demonstrating good faith effort to utilize VetHUB subcontractors regardless of whether a utilization goal exists. Supporting documentation must include email communications with date and time stamps, subcontracting opportunity notifications, and evidence of solicitation sent to at least two VetHUB vendors for each identified opportunity. When fewer than two VetHUBs are available within a specific NIGP code category, respondents may expand the code classification or contact the TFC Office of Business Opportunities for guidance. Subcontracting plans deemed deficient will result in respondent disqualification from the applicable solicitation.
